HomeMy WebLinkAbout05-30-90 y t~ ; CITY OF LAKEVILLE SPECIAL PLANNING COMMISSION MEETING MINUTES MAY 30, 1990 The meeting was called to order by Chairperson Whittingham at 5:30 p.m. in the City Hall Council Chambers. Roll call of members was taken. Present: Whitehouse, Miller, Holberg, Whittingham, Steigerwalt and De Phillips. Absent: Langhorst. Also present: Bob Erickson, City Administrator; Councilmember Pat Harvey; Daryl Morey, Assistant Community Development Director and Mira Holliday, Recording Secretary. The public hearing to consider the application of Thomas Bertram for a conditional use permit to allow the. .construction of a garage on a non-conforming single family residential lot located at 8675 - 207th Street West was opened. Daryl Morey, Assistant Community Development Director attested that all legal notices had been duly published and mailed. • Daryl Morey gave a review of the request, outlining the planning report of May 24, 1990. He stated the it is the Bertram's wish to remove an old, existing one car garage/shed and construct a new, two story, two car garage in its place on a non-conforming lot. He stated the Bertram house is one of the oldest in Lakeville and that the house and garage were constructed prior to current Zoning Ordinance requirements. Mr. Morey reviewed the ordinance requirements and site plan. He stated with the exception of the north side yard setback, the proposed garage location will exceed all other minimum setback requirements. The 2.2 foot. north side yard setback is currently non-conforming and the proposed garage will be allowed to maintain the same setback under this conditional use permit request. Mr. Morey stated that as this is .the Bertram's only garage, the proposed accessory building has an obvious need, both now and in the future, for the parking of vehicles and for the storage of household items allowed by ordinance. He stated that the second story of the proposed garage will be utilized primarily for storage and the Bertram's have no .intention of utilizing the second story of the proposed • garage as living quarters. SPECIAL PLANNING COMMISSION MEETING MINUTES MAY 30, 1990 Page 2 Mr. Morey stated that staff considers the Bertram's garage plans as a positive step toward continued improvement of their property and recommended approval subject to the eight stipulations listed in the planning report. Mr. Bertram was present and stated he had spoken with the neighbors abutting his property and they have no problem with his proposed garage. He also stated that there are no closets in his house and he intends to use the second story of the proposed garage strictly for storage. The Commission held a discussion which included: - Possibility of the garage being attached to the house. - Use of existing paved driveway. - Possibility of expansion of paved driveway. - Electrical and water hook up to the garage. - Location of garage door. - Height of the garage and visibility of the property to the north. There was no public comment. 90.97 Motion was made by Miller, seconded by Holberg to close the public hearing: Roll call was taken on the motion. Ayes: Unanimous. 90.98 Motion was made by Holberg, seconded by Steigerwalt to recommend approval of the application of Thomas Bertram for a conditional use permit to allow the construction of a garage on a non-conforming single family residential lot .located at 8675 - 207th Street West subject to the planning report of May 24, 1990 and the findings of fact. Roll call was taken on the motion. Ayes: Whitehouse, Holberg, Whttingham, Steigerwalt, De Phillips. Nay: Miller. The reason given for Miller's nay was he felt that future owners of the. property might run water to the new structure .and it could then be used for a residence, making two residences on one parcel. Under new business, Whitehouse asked Mr. Erickson and Mr. Harvey what could be done to regulate the speed limit on Orchard Lake. He expressed his concern over the City's lack of authority over the activity on the lake. He went on to state that he felt the residents in the area should formulate a plan and submit it to the City Council. Mr. Harvey stated he felt more could be accomplished if the residents form a "united front". 90.99 Motion was made by Miller, seconded by Steigerwalt to .adjourn the meeting.
