OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES SEPTEMBER 20, 1990 The meeting was called to order by Chairperson Whittingham at 7:D0 in the Lakeville City Hall Council Chambers. Roll call of members was taken. Present: Whitehouse, Miller, Holberg, Whittingham, Langhorst, Stegerwalt.- Absent: De Phillips. Also present was Elliot Knetsch, City Attorney; Aian Brixius, Consulting Planner; Robert Erickson, City Administrator and Mira Holliday, Recording Secretary. The minutes of the August 23, 1990 meeting were approved as written. Alan Brixius gave a status update on the revocation of a conditional use. permit to allow outside sales and storage of plants, shrubs and trees at 9200 - 202nd Street. He explained that this item had been continued from the August 2, 1990 Planning Commission meeting. He stated furtherthat there are two remaining items (outside sales be confined to the approved area of the CUP.and the tree farm be discontinued) which need to be completed to bring the property into compliance with City :Codes and Ordinances. He recommended that this item be continued until November 15, 1990 to allow the two remaining items to: becompleted. 90.148 .Motion was made: by Miller., seconded by Whitehouse to continue the consideration of the revocation of a conditional use permit to allow. outside storage of plants, shrubs and trees at 9200 - 202nd Street until November 15, .199.0. Roll call. of .members was taken. Ayes: Unanimous. The public hearing to consider the application of Meritor Development Corporation for a rezoning from R'2, Single Family Residential District to R-3, High .Density Single.. Family Residential District for a portion of Outlot A, Chapel. Hills was opened.. The City Attorney attestedthat. all legal notices had been duly published and mailed. Chairperson Whittingham stated that a letter had been received from Meritor Development Corporation requesting the . application be removed from the agenda. Alan Brixius gave a brief. review. of the background of the Chapel Hills area, outlining his planning report dated September 13, 1990. PLANNING COMMISSION MEETING MINUTES SEPTEMBER 20, 199Q Page 2 Jim Wenzel of Greenwood .Circle stated he was opposed to the request and submitted a petition from residents of the Chapel Hills area. He also requested that notification be sent to the surrounding residents if the application is reinstated. Brent Broncan and Warren Katchas, both of Griffon Trail also stated their opposition to the rezoning request. Bob Erickson read the letter from Meritor-Development Corporation for the record. He also stated he had received a letter from a Chapel Hill resident. who stated his house would fit on either an R-2 or R-3 zoned Iot; and a letter from a builder in the area. who stated R-3 zoned lots would be advantageous to his company. The Commission held a brief discussion and. all agreed that the zoning of the area should remain R-2, Single Family Residential .District rather .than R-3, High Density Single Family Residential District. 90..149 Motion was-.made by Langhorst, seconded by Holberg to table the public hearing to consider the application of Meritor Development Corporation for a rezoning from R'2, Single Family Residential District to R-3, High Density Single Family Residential District for a portion of Outlot A, Chapel Hills and that. notice be re-published and mailed to area residents if the application. is reconsidered. Roll call was. taken on the motion. Ayes: Unanimous. Alan Brixus gave a review of the final plat of Homestead Creek Third Addition. He explained that the final plat had been revised by the developer. due to the Army Corps. of Engineers having recently expanded the boundaries of the wetland that is located in the middle of the Homestead Creek subdivision. He stated that the original final plat for Homestead Creek Third Addition was unanimously recommended for approval by the Planning Commission May 3, 1990; however, the revisions to the final plat were made before the .City Council had an opportunity to act on it. He went on to review the final plat, outlining the planning report of August 8, 1990. He recommended approval subject to the seven stipulations listed in the report.. PLANNING COMMISSION MEETING MINUTES SEPTEMBER 20, 1990 Page 3 John Peterson of Good Value Homes .was present and stated he was in agreement with the recoYrunendations of the planning report. The Commission discussed the following: - Park and Recreation Commission recommendations - Future of Outlots C and D - Wetland area - Tree preservation - 100 year elevation for floodplain - Dakota County Soil and Water Conservation District recommendations 90.150 Motion was made by Steigerwalt, seconded by Langhorst to recommend approval of the final plat of Homestead Creek Third Addition subject to the planning report of August 8, 1990, the engineering report of August 22, 1990 and the Dakota County Soil and Water Conservation District report of August 27, 1990. Roll call was taken on the motion. Ayes: Unanimous. Alan Brixius gave a review of the final plat of Rolling Oaks South Plat Five, outlining the planning report of September 11 1990. Mr. Duane Dietrich of M & D Corporation was present and reviewed the background of the plat. .The Commission expressed concern over .the small lot sizes on Blocks 3 and 4. Mr. Dietrich explained that the surrounding. area adjacent to Blocks 3 and 4 (Mills Fleet Farm, MNDOT, and the Connelly Mobile Home Park) would effect the sale of homes in that area. Bob Erickson stated he had met with Mr. Green of Mills Fleet Farm who had agreed to screen the Mills Fleet Farm property adjacent to Rolling Oaks Plat Five. Mr. Erickson agreed with Mr. Dietrich that the adjacent area would effect the sale of homes. The Commission also discussed the preservation of trees.. Mr. Erickson stated that staff recommends that prior to City Council approval, the developer submit a tree preservation/custom grading plan which identifies the number, species and location of trees six inches or greater in diameter and the precautions to be used_to protect and preserve them. Mr. Dietrich. stated that more .people .than just the developer are involved in tree preservation {i.e. builders). 90.151 Motion was made by Miller, seconded by Whitehouse to recommend approval of the final plat of Rolling Oaks South Plat Five subject to the planning report of September 11, 1990 and the stipulation that no construction be allowed beyond the established building pad and special attention be given to tree preservation and custom grading. The public hearing to consider the application of the City of Lakeville for a minor comprehensive plan amendment to bring the area west of Orchard Lake, south of 168th Street and north of 175th Street into the Year 2000 Urban Service Area was opened. The City Attorney attested that all legal notices had been duly published and mailed.. Alan Brixius stated that this amendment is being requested by the City's Engineering Department to allow the City sewer and water improvements associated with the Judicial Road .Improvement Project. He stated this would allow surrounding property owners to connect to City sewer and water, which in turn will reduce lake and groundwater contamination in the. area as substandard private septic systems are discontinued. A brief discussion was held. 90.152 Motion was made by Miller, seconded by Steigerwalt to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 90.153 Motion was made by Miller, seconded by Whitehouse to recommend approval of the application of the City of Lakeville for a minor comprehensive plan amendment to bring the area west of Orchard Lake, south of 168th Street and north of 175th Street into the Year 2000 Urban Service Area. Roll call was .taken on .the motion. Ayes: Unanimous. Bob Erickson distributed City brochures-regarding tree preservation and thanked the Commission for their continued interest. Under other business, the Commission questioned Mr. Erickson concerning signage at the Southfork Shopping Center. Mr. Erickson stated he was to have a meeting the next morning regarding that issue. Whittingham stated that several ..senior citizens of .Lakeville had requested that benches be placed at the Enggrens mall. Mr. Erickson stated he would look into that matter. 90.154 Motion was made by Steigerwalt, seconded by Langhorst to adjourn the meeting. Voice vote was taken on the motion.
