HomeMy WebLinkAbout11-01-90 C s 4, • t CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES NOVEMBER 1,1990 The meeting was called to order by Chairperson Whittingham at 7:00 p.m. in the City Hall Council Chambers. Roll call of members was taken. Present: Miller, Holberg, Whittingham, Steigerwalt. Absent: Whitehouse, Langhorst, De Phillips. Also present was Robert Erickson, City Administrator; Alan Brixius, Consulting Planner; Roger Knutson, City Attorney; Daryl Morey, Assistant Community Development Director; and Mira Holliday, Recording Secretary. The minutes of the October 18, 1990 Planning Commission meeting were approved as written. Don Stenzel of OSM, Consulting Engineers, presented a review of the West Orchard Lake/Judicial Road Improvement Project. He stated that this project involves the extension of sewer and water into the west Orchard Lake area and the improvement and realignment of Judicial Road. He discussed- the three segments of the project, existing lot configurations, neighborhood input into the project, and. • proposed future development in the area. He stated .the project should be completed by August 15, 1991. The Commission held a brief discussion. The public hearing to consider the application of Paul Anderson for a conditional use permit and a variance to allow the installation of a satellite dish with a height in excess of 15 feet and a building setback of less than 10 feet located at 18698 Kanabec Court was continued from the October 18, 1990 meeting. Alan Brixius presented a review of the. request, stating it had been tabled at the October 18, 1990 meeting to allow the applicant the opportunity to be in attendance to respond to questions raised by Commission members, residents and City staff. Mr. Brixius went on to discuss the location of a mature oak tree which prevents the applicant from locating the satellite dish support pole the required 10 feet from the site's principle building. Mr. Anderson was present to answer questions. Mr. Paul Dodge of Kanabec Court questioned the position of the pole and whether or not the satellite dish would be connected to the house. Mr. Wilson Hall of Home Satellite Systems, who will be installing the dish for Mr. Anderson, • described the installation process and presented pictures to the Commission of houses in Edina which had been granted variances for satellite dishes mounted in the same manner. PLANNING COMMISSION MEETING MINUTES NOVEMBER 1, 1990 PAGE 2 Mr. Jon Ahlberg of Kanabec Court requested that Mr. Anderson answer the questions which had been submitted to City staff dated October 25, 1990. Mr. Brixius stated that satellite. dishes are a permitted use and the Commission is only being asked to resolve whether or not the height of the dish presents a problem and whether or not a variance is justified. He stated that many of the questions which had been submitted by Mr. Ahlberg are unrelated to the issue on which the Commission is to make a recommendation. Roger Knutson stated that the lightening and safety concerns are building code and electrical code issues. Mr. Ahlberg stated he felt the applicant had not proved the existence of an undue hardship. Mr. Dale Fitterer of Kanabec Court stated he had also submitted a list of questions dated October 25, 1990 and felt they were valid. He stated. his main concern is over safety and if a hardship is warranted. Mr. Brixius stated that he feels the variance is justified. Mr. Hall described the grounding methods and other safety • features. The Commission held a discussion which included: - Trimming of the oak tree. - Safety features of the satellite dish. - Mounting of the satellite dish. - Retaining wall. - Operating angle of the satellite dish. - Visibility of the satellite dish from Orchard Trail. - Color of .the satellite dish (available in gray or black) Mr. Erickson suggested Mr. Anderson choose gray for the color of the satellite dish because the dish would blend in better with its background during the many months the trees are without leaves. Mr. Russ Hasey of Orchard Trail stated his concern over-the safety of the dish. from potential lightening strikes given its closeness to the oak tree. Mr. Anderson. read a letter from his insurance company stating he would be fully insured should any damage occur due to the satellite dish. The letter further stated there has been no proof that satellite dishes attract lightening. • PLANNING COMMISSION MEETING MINUTES NOVEMBER 1, 1990 PAGE 3 Mr. Fitterer stated he contacted Star Cablevision and was informed that cable will be available in the area in 1991. Mr. Anderson stated he had contacted Star Cablevision also and had been told cable would not be available for 2 - 5 years. He stated the developer of the subdivision would have to pay between $10,000 and $12,000 for hook up of cable if it is installed before the development is relatively full. Mr. Brixius stated that access to cable television would not prohibit the applicant from having the satellite dish. Mr. Alhberg questioned other possible locations for the satellite dish where a variance would not be required. Mr. Brixius stated if the satellite dish was placed where no variance would be required, it would be even more visible from the neighboring property. 90.166 Motion was made by Miller, seconded by Holberg to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous.. • Mr. Erickson asked if Mr. Anderson would be agreeable to changing the color of the satellite dish from black to gray. Mr. Anderson was. in agreement. 90.167 .Motion was-made by Steigerwalt, seconded by Miller to recommend approval of the application of Paul Anderson for a conditional use permit and a variance to allow the installation of a satellite dish with a height in excess of 15 feet and a building setback of less than 10 feet located at 18698 Kanabec Court subject to the planning report of October 8, 1990, with the additional stipulation that the color of the satellite dish be gray, and the findings of fact. Roll call was taken on the motion.. Ayes: Unanimous. There was no unfinished business. Under new business, Mr. Erickson informed the Commission. that Mr. Michael Sobota, newly appointed Community and Economic Development Director, will be present at the next Planning Commission meeting. He also stated that Mr. Steve Michaud, Parks and Recreation Director, will be present at the December 6, 1990 Planning Commission meeting to present the Parks and Open Space System Plan. . 90.168 Motion was made by Steigerwalt, seconded by Whittingham to adjourn the meeting.
