Ordinance No. 674 is 'hereby .amended. to rezone: from CC, Corporate Campus District to PUD, Planned Unit Development District the following described property located within. the City of Lakeville, Dakota County, Minnesota.: Lots 1-3, Block 1, Timbercrest At Lakeville `Lot 1, Block 2, Timbercrest At Lakeville Oulots A, B C, D, E, F, G, H, I, J, K, L, M, N, O and P, Timbercrest at Lakeville :.The zoning district. requirements for the C-3, General Commercial District, apply to the property except for the deviations approved in the Timbercrest at Lakeville preliminary and final plat, the Development Contract. for the Timbercrest at Lakeville plat, and the plans, exhibits, and reports referred to in or attached to the Development Contract. In addition, he following shall apply; • The zoning .district .requirements of -.the O-R, Office/Residential Transition District and C-1, Retail Commercial District shall apply to Outlot L, except that housing, personal wireless service antennas, and motor vehicle fuel sales are prohibited .uses. • The zoning district requirements of the CC, Corporate Campus District,. shall apply to Lot 1, Block 2 and Outlot 1. • Wine,. as defined in Minn. Stat. §,340A.101 (2000), may not be sold off.-sale. within Sthe plat boundaries .except by the City ofi Lakeville unless: (1) a grocery store outside the plat in the City of Lakeville legally sells wine, or (2) the City of Lakeville ceases operation of its municipal liquor stores .for a period. of one (1) year. • Certificates of occupancy., for buildings constructed on Outlots A, B, D, F, I, and L (to be replatted as buildable lots) shall not be issued until after the Phase IL CSAH 60/1-35 interchange improvements .have been completed or the proposed Interim Improvements have been completed as identified in the Environmental. Assessment Worksheet .completed for this project. Building 96407.01 1 RNK:09/26/2001 permits for such outlots may not be issued until after Dakota County has entered into a construction contract for the CSAH 60 improvements. • TimberCrest at Lakeville Design Guidelines and Architectural Standards. Section 2. The zoning map ofithe City of Lakeville shall not be republished to,show the .aforesaid rezoning, but the City Clerk shall appropriately mark the zoning map on file in the City Clerk's office for the purpose of indicating the rezoning hereinabove provided for in this Ordinance, and all of the .notations, references and other information shown thereon are hereby incorporated by reference and made a part of this Ordinance. Section 3. This ordinance shall be effective upon recording of the Timbercrest At Lakeville final plat. Adopted by the Lakeville City Council this 15th day of October,. 2001.
