AN-ORDINANCE AMENDING TITLE 11
OF THE LAKEVILLE CITY CODE CONCERNING
RE6ZUIRED PERMITS AND APPROVALS
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
SECTION 1. Section 11-18-7B of the Lakeville City. Code is amended to
read:
B. Zoning Permit Required: Detached accessory buildings not
exceeding one hundred twenty.(120) square feet in .floor area shall
be allowed without issuance of a building permit, but shall comply
with all other provisions of this Title. Such. buildings must .receive a
zoning permit before they are constructed or moved onto property.
The.. Zoning.. Administrator or designee shall review the site plan -and
construction drawings to determine compliance .with this Zoning.
Title and other applicable ordinances; laws, and. regulations.
SECTION 2. 'Section 11-18-7 of the Lakeville City Code is amended ; by
addingparagraph C to read as follows::.
C. Building Permit Required: Detached accessory buildings greater
than 120 square feet in floor area shall require a building permit:
The Building Official shall review the site plan and construction
drawings to determine compliance .with the Building Code and
other applicable ordinances, laws, and regulations.
SECTION 3. Section 11-21-5A of the Lakeville City Code. is amended to
read:
A. Permit Required: No person. except on a farm and related to
agricultural uses, but not including hobby farms, shall hereaffer
construct or cause to be constructed or erected within the City any
fence without first making an application for and securing a zoning

.permit for fences not exceeding. six feet {6') in height, and a
building permit for fences exceeding six feet. (6') in height.
SECTION 4. :Section 11-21-5G of the. Lakeville City Code is amended in its
entirety to read:
1. A permit as described herein shall be required for swimming pools
having. a .depth of twenty four inches (24") at any point and a surface
area exceeding one hundred fifty (150) square feet:.
a. Zoning permit required: Prefabricated swimming pools. in
which the pool walls. are .entirely above the adjacent grade and the
capacity does not exceed .5,000 gallons shall require. a zoning permit
before installation.
b. Building permit .required: All in ground pools regardless of
capacity and all above ground swimming pools that exceed b,000 gallons
shall require a building permit before installation.
2 Each application for e a permit to construct or erect a
swimming pool shall be accompanied by plans of sufficient detail to
show:
a. The proposed location of the pool and .its relationship to the
principal building on the lot.
b. The size of the pool
c. Fencing and other fixtures existing and proposed on the lot,
including utility location and trees.
d. The location, size, and types of equipment to be used in
connection with the pool,.. including, but not limited to, filter unit, pump
fencing, and thepool itself..
e. That the requirements contained. in subsections G2 and G3 of
this Section will be satisfied including submission and approval. of a site
plan.
3. All swimming pools for which a permit is required and granted
shall be provided with safeguards to prevent children. from gaining
uncontrolled access. This can be accomplished with fencing, screening

or other enclosure, or any combination thereof,. of sufficient density as to
be impenetrable: If fences are employed, they shall be at least four feet
(4') in height. The bottoms of the fences shall not be more than four
inches' (4" )..from the ground nor shall. any open space in the fence be
more than four inches (4" Fences sha l be of a noncorrosive material
and shall be constructed as to be not easily climbable. All fence
openings or points of entry into the pool enclosure shall be equipped with
gates or doors. All. gates or doors to swimming pools shall be equipped
with self-closing and self-latching: devices placed at a sufficient height so
as to be inaccessible to all small children. The fencing requirements of this
subsection G need .only be provided around- the means of access on
aboveground pools which have four feet (4') high, vertical or outward
inclined side walls.. Prior to filling the :pool, the approved fence and/or
,screen must be completely in place and inspected and .approved by the
City Building Official
4. In all residential districts, swimming. pools shall be set back ten
feet (70') -from all adjoining lots and; .except. for fences and: pump
.enclosures, shall be located at least ten feet (10') away from any other
building or structure on the same lot and shall not be located within a
drainage or utilityeasement. Swimming poolsshall. not be permitted in a
front yard or in the area between the street right-of-way and the minimum
:required building side yard setback .line.
.SECTION. 5. Section 11-55-156(4) of the Lakeville City-.Code is dmended to
read:
4. Fences: Fences are. prohibited ` on individual manufactured
home lots.
SECTION 6. This `ordinance shall be effective immediately upon its
passage and publication..

SECTION 5 Section 11-55-15B(4) of the
Lakeville City Code is amended to read:
4. Fences: Fences are prohibited on indi-
vidual manufactured home lots.
SECTION 6. This ordinance shall be
effective immediately upon its passage and
publication.
ADOPTED this 17th day of December,
2001, by the City Council of the City of
Lakeville, Minnesota.
