LAKEVILLE CITY CODE CONCERNING REFERENCE TO THE ENVIRONMENTAL AFFAIRS COMMITTEE AND PARK AND RECREATION COMMITTEE THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS: SECTION 1. Section 7-14-4B ofithe Lakeville City Code is amended to read: B. The application shall be referred to the City's Parks, Recreation, .and. Natural Resources Committee for recommendation. Following receipt of the i-ecornmendation, the City Council .shall approve or deny the permit, subject to reasonable conditions, based upon the standards set forth in this Chapter. SECTION 2. Section 9-5-4B of the Lakeville City Code is amended to read: B. Sequencing And Replacement Plan Decisions: Sequencing and.. replacement .plan decisions ..under Minnesota Rules, parts 8420.0520- .0550 shall be made by the City Council .after the plansare :reviewed by the Parks, Recreation,_and Natural Resources. Committee and following notice and time requirements of part 8420.0230. if the amount of wetland to be drained or filled is less than one-tenth (1/10) of an .acre, the .sequencing determination under Minnesota Rules, part 8420.0520 shall be made by'the Zoning Administrator.. SECTION 3 Section 9-5-4G of the Lakeville City Code is amended to read: G. Technical Evaluation Panol: The. City Council shall appoint a person to serve on the technical evaluation panel The person must be a technical professional .with .expertise in water resources management. Decisions under. this Chapter must. not. be made until after receiving: the determination of the technical evaluation panel.- regarding wetland public values, location, size andJor type if the City Council, the landowner, or a member of the technical evaluation panel asks for such determinations: This requremen#s does not apply to wetlands for which such. date is included in an approved. comprehensive wetland management plan per. part 8420.0240: The Parks, .Recreation, and Natural Resources 97462.03 {C) 1 SRN:11/19/2001 Committee and the City Council may seek and consider recommendations,. if any, .made by the technical evaluation .panel in making replacement plan decisions.. .SECTION. 4. Administrator shall refer .copies of .the preliminary plat to the- Parks, Recreation, and Natural Resources. Committee; County Soil .and Water Conservation District;' County, Metropolitan, .State, or other. public jurisdictions for their review and comment, whereappropriate and when required. SECTION 5. Section 10-4-7D of the Lakeville City Code is amended. to read: D. The submission of a tree preservation plan. subject to the review of the Parks, Recreation, and Natural Resources Committee and the approval of the City Council SECTION 6. Section 10-4-8 of the Lakeville City Code is amended by amending subsections C and D to read: C. The Parks, Recreation, and Natural Resources Committee shall recommend to the City Council the land and/or cash contribution requirements for proposed subdivisions. D. Any increase. in density of subdivisions shall be reviewed by the Parks, Recreation, and Natural Resources .Committee for reconsideration of park land and/or cash contribution requirements. SECTION 7. This ordinance shall be effective immediately upon tspassage and publication. ADOPTED this 17th day of December , 2001, by the City .Council of the City of Lakeville, Minnesota.
