RESOLUTION CONCERNING DEVELOPMENT
IN MUSA EXPANSION AREA "A"
WHEREAS, on June 7,.2004, the City adopted Resolution 04-115, a resolution
concerning development in MUSA Expansion Area "A"; and,
WHEREAS, the City Council approved a concept plan for the proposed Spirit of
Brandtjen Farms. development prior to adoption of Resolution 04-115; and,
WHEREAS, the Planning Commission has engaged in extensive discussions with the
• developer regarding the planning for this development since approval of the concept plan in
anticipation of a preliminary plat and other related applications; and,
WHEREAS, the City Council has .approved the required environmental review studies
and made findings that the project will have no potential for negative environmental effects; and,
WHEREAS, the proposed preliminary plats of Spirit of Brandtjen Farms and East Lake
> Estates provide for dedication of land to the City for public park and trail facilities identified by
the 2000 Parks Trails and Open Space Plan; and,
WHEREAS, the Spirit of Brandtjen Farms development will allow the City to acquire
additional land for public park purposes utilizing grant monies that have been secured by the
City; and,
WHEREAS, the proposed Spirit of Brandtjen Farms and East Lake Estates
developments are connected, as one project would directly induce the other and one project is a
prerequisite for the other.
WHEREAS, to further orderly development, it is in the public interest of the City to
advance these certain development applications.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville,
Minnesota:

1. Following passage of this Resolution, the City will consider the extension of
public sewer to the following described properties:
The Southeast Quarter and the Northeast Quarter of the Southwest
Quarter of Section 1, Township 114, Range 20, Dakota County,
Minnesota. (Spirit of Brandtjen Farms)
AND
The Southeast Quarter (SE 1/a) of the Southwest Quarter (SW'/a) of
Section 1, Township 114, Range 20, situated in the County of Dakota,
State of Minnesota. (East Lake Estates)
2. Following passage of this Resolution, the City will consider development
applications with public sewer to the property described in Paragraph L
ADOPTED this 18~' day of April, 2005 by the City Council of the City of Lakeville,
Minnesota.
