HomeMy WebLinkAbout0684 ORDINANCE NO. 684 CITY OF LAKEVILLE DAKOTA, COUNTY, iv1INNESOTA AN INTERIM ORDINANCE TEMPORARILY PROHIBITING APPROVAL OF INTERIM USE PERMITS FOR MINING IN MUSA EXPANSION AREA "B" THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS: SECTION 1. Definitions. The following terms whenever used in this ordinance shall be interpreted to mean: MINING means removing the topsoil or overburden for the purpose of extracting earthly deposits or minerals, or stockpiling, storage, and processing of sand, gravel, black dirt, clay, and other materials. MUSA EXPANSION AREA "B" means that area in the City's Comprehensive Plan designated as MUSA Expansion Area "B". SECTION 2. Purpose and Intent. It is the intent of this ordinance to allow the City time to complete planning studies and adopt appropriate land use controls, and in the .interim to protect the planning process and the health, safety, and welfare of the citizens of the community. SECTION 3. Factual Background. The study and subsequent amendments to the zoning ordinance are needed for the following reasons: • City Code Section 11-25-5 currently prohibits mining within the current MUSA boundary and MUSH Expansion Area "A". • There is currently substantial development pressure adjacent to MUSA Expansion Area "B". • The City is concerned that appropriate buffers be maintained between mining and urban residential development. • There are sensitive natural resources in MUSA Expansion Area "B" such as public waters, parks, and greenways that could be adversely impacted by mining. 93826.01 i SECTION 4. Temporary Prohibition. Pending the completion of the above referenced study and adoption of appropriate official controls, interim. use permits for mining within MUSA Expansion Area ``B" shall not be approved and no applications for such approval shall be accepted. SECTION Effective Date. This ordinance shall take effect upon passage and shall remain in effect until it is repeated in conjunction with the date of the adoption of the official controls contemplated hereunder or May 20, 2002, whichever occurs first.
