AN ORDINANCE AMENDING TITLE 4, CHAPTER 1 OF THE LAKEVILLE.
CITY CODE CONCERNING ACCUMULATION AND DISPOSAL OF WASTE;
TITLE S, CHAPTER l OF THE LAKEVILLE CITY CODE CONCERNING
CARE OF ANIMALS; TITLE 7, CHAPTER 5 OF THE LAKEVILLE-CITY.
CODE CONCERNING WATER AND SANITARY SEWER SYSTEMS; TITLE 9,
CHAPTER 1 OF THE LAKEVILLE CITY CODE CONCERNING
ADMINISTRATION OF THE CITY BUILDING CODE
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
SECTION L Title 4, Chapter 1 of the Lakeville City Code is amended by adding Section 4-1-
S to read:
4-1-5: WASTE:.
A. Any accumulation of refuse on any premises not stored in containers which comply with City
Code, or any: accumulation of refuse. on any premises which has remained thereon for :more
than one (1) week is-hereby declared to be a nuisance and may be abated by order of the City.
Health Officer, as provided: by Minnesota Statutes, section I45A.04, subdivision 8, as may be
amended, and the cost of abatement may be assessed on the.. property where the. nuisance was
found, as provided. by law.
B. All .waste generated shall be disposed in a manner consistent with all' Minnesota Pollution
Control: Agency rules.:
C. Any accumulation of waste generated on any premises not stored in containers which comply
with Title 4, Chapter 2 of the City Code-and Minnesota Polluton'Control Agency rules:;. or any
accumulation of mixed municipal solid waste generated on any premises .which.. has remained
thereon for more than one (1 }week, or any accumulation of infectious, nuclear, pathological, or
hazardous waste which is not stored and disposed in a manner consistent with the Minnesota
Pollution Control Agency .rules is a nuisance and may be abated and the cost of abatement may
be assessed against the property where the nuisance is found.
D. The accumulation, storage,. processing, and disposal of waste on any premises, which is not
generated- on that premises, is prohibited, .except as specifically provided in the Lakeville
:..Zoning Ordinance.

SECTION 2. Title 5, Chapter. l of the Lakeville City Code is amended by adding Section 5-1-
18 to read:
5-1-18: CARE OF ANIMALS: Animals kept .within the City of Lakeville shall be subject to the
.following requirements.
A. The. size, number, species, facilities for and location of animals kept shall be maintained so as
not to constitute a danger or nuisance by means of odor, noise or otherwise.
B. The person caring for any animal(s) shall be of sufficient age, knowledge and experience to
.adequately and safely care for and control the animal(s).
C. Facilities for housing animal(s) shall be:
l . Constructed of such material as is appropriate for the animal(s) involved.
2. Maintained in good repair.
3. Controlled as to temperature, ventilated and lighted compatible with .the health and
comfort of-the animal(s).
4. Of sufficient size to allow each animal to make normal postural and social adjustments
with .adequate freedom of movement. .Inadequate space may be indicated by evidence of
malnutrition, poor condition of debility, stress or abnormal behavior patterns.
5. Cleaned as often. as necessary to prevent. contamination of the_ animal(s) contained
therein and to minimize disease hazards and reduce odors.
D. Animals shall bz provided wholesome, palatable food and water free from contamination and
of sufficient quantity and nutritive value to maintain all animals in good health.
E. Animals kept in pet shops or in kennels shall be kept in accordance with regulations for pet
shops and kennels in addition to the regulation. provided by the Lakeville Zoning Ordinance.
SECTION 3. Section.?-5-2-A of the Lakeville City Code is amended to read:
It shall be unlawful for. any person. to install a private. water system
which is intended to provide water for human consumption or a private
sewer. system in the City except in cases where the public water or sewer
.systems are not accessible to the .premises where such 'private ystems
are requested. To determine whether or not such public .water .and/or
sewer systems are available for connection, each person or ..corporation
desiring to install a private water or sewer .system. must first make
application. for connection to a public system. Upon determination by
.the City that it is not feasible to connect the applicant's premises to the
public water or sewer system, then the. applicant shall be granted a

.permit to install a private water and/or sewer system in accordance with.
all appropriate State and .local regulations. The installation of on-site
sewage treatment systems shall be in conformance with the provisions of
Section 7-5-16 of the Lakeville City Code.
SECTION 4. Section 7-5-16 of the Lakeville City Code is amended to read:
Dakota County On-Site Sewage Treatment System Ordinance No. 113,
as amended, is hereby adopted by reference. A copy of the Ordinance
shall be kept on file. in the City offices,
SECTION 5. Title 9, .Chapter 1 of the Lakeville. City Code is amended by adding Section 9-1-
2-C to read:
C. Except for agricultural buildings and structures, no building or structure hereafter erected or
moved, or that portion of an existing structure or building erected or moved shall be occupied
or used in whole or in part for any purpose whatsoever until a certificate' of occupancy shall
have been issued by the Building Official.
..Site and construction plans will be required and shall be .submitted to and approved by .the
Building. Official prior to the .issuance of any building permit. Prior to installation of a system.
of plumbing other than for a single family dwelling, :complete plumbing plans. and
specifications, together with any. additional information that the Building Official may require,
shall be submitted in triplicate and approved by the Building Official No construction shall
proceed except in accordance with the approved plans.. Any alteration or extension of an
existing plumbing system shall be subject to these same requirements.
SECTION 6. This ordinance shall be effective immediately: upon its passage and publication.
ADOPTED this 17th day of July, .2000, by the City Council of the City of Lakeville,
Minnesota.

Lakeville City Code is amended by adding
Section 9-1-2-C to read:
