Present: Mayor Holly Dahl Council Member Mark Bellows Council Member Kerrin Swecker Council Member Kevin Miller Absent: Council Member Laurie Rieb Presentations /Introductions Roger Knutson, City Attorney Steve Mielke, City Administrator Tom Vonhof, Police Chief Keith Nelson, City Engineer Dennis Feller, Finance Director Daryl Morey, Planning Director Steve Michaud, Parks Recreation Director Chris Petree, Operations Maintenance Director Charlene Friedges, City Clerk Chris Petree presented the January monthly report of the Operations Maintenance Department. Citizens' Comments Wayne Tonsager, 24311 Natchez Avenue, suggested the City Council consider the following: City employees should assist the Fire Department with clean -up after a fire or rescue call; Park Maintenance Department should hire retired persons who drive economy cars to take care of park restroom maintenance; The City should relocate the Senior Center to the former Blue Chip Sports Academy, rather than utilize the former Police Station building. Mayor Dahl thanked Mr. Tonsager for his comments and invited him to meet with herself and department directors to address his issues. Consent Agenda 10.09 Motion was made by Miller, seconded by Bellows to approve the consent agenda items as follows: a. Claims for payment. b. Minutes of the January 19, 2010 City Council meeting. c. Set a Council work session beginning at 5:00 p.m. on February 8, 2010, to interview advisory committee applicants. d. Confirmation of Planning Commission Chair, Bart Davis. e. Special home occupation permit to allow a personal fitness training business in a single family residence located at 16560 Flagstaff Way. f. Landscape maintenance contract with Gingko Gardens Lawns. g. Performance agreements with Ancia Saxophone Quartet and Vecchione /Erdahl Duo and Friends for performances at the Lakeville Area Arts Center. h. Instructor agreements with JoAnne Andres, Kathy Barry, Tammy Brand, Gary Holthusen, Barb Hughes, Hermine Magnus, Cindy Murphy, Alison Price, Tina Sheppard, Rod Hill, Jesse Stevenson, Lisa Westphal, Andy Wilkens and Jennifer Wolcott for classes and activities offered at the Lakeville Area Arts Center. Resolution No. 10 -13 accepting donation from Residential Mortgage Group to the Police Department. j. Tree work license for R.D. Associates Specialized Services. k. Reappointment of Dan Vlasak, Robert Brantly, Thomas Smith and Jerry Erickson to the Economic Development Commission; reappointment of Susan Landberg, Anna Marie Johnson and CITY OF LAKEVILLE COUNCIL MEETING MINUTES FEBRUARY 1, 2010 Page 3 Michelle Gensinger to the Arts Center Board; and appointment of Linda Maguire to the Planning Commission. Roll call was taken on the motion. Ayes, unanimous. Item 7 Conditional Use Permit for Minnesota School of Business Ms. Camille Mcardie requested Council approval of a conditional use permit to allow the operation of a Veterinary Technology Program at the Minnesota School of Business, located in the Southfork Shopping Center at 17645 Juniper Path. Planning Director Daryl Morey explained that Myhre Holdings Lakeville, LLC (Minnesota School of Business) has purchased the building and will be utilizing 5,515 square feet of the 23,676 square foot building. The existing tenants will remain in their current leased spaces. This past summer, Minnesota School of Business purchased the adjacent building for their new Lakeville campus and opened the first higher- education facility in Lakeville. Mr. Morey explained that the zoning ordinance considers the business school an adult education facility in the C -3, General Commercial District, which requires approval of a conditional use permit. While the adult education facility will not operate as a veterinary clinic, staff prepared an analysis to demonstrate the compatibility of the proposed Veterinary Technology Program with the City's ordinance standards for veterinary clinics. The Planning Commission held a public hearing on the conditional use permit request and recommended approval subject to six stipulations. 10.10 Motion was made by Swecker, seconded by Miller to approve Findings of Fact and a Conditional Use Permit to allow the operation of an adult education facility in the C -3, General Commercial District, located at 17645 Juniper Path.
