Mayor Dahl called the meeting to order at 7:00 p.m. The pledge of
allegiance to the flag was given.

Chief Nelson introduced 15 firefighters who have successfully completed
their two -year probationary period with the Lakeville Fire Department.
David Olson presented the 2009 Economic Development Annual Report.
Steve Michaud presented the 2009 Annual Report of the Parks
Recreation Department.
Chief Vonhof presented the January Police Department monthly report.

10.11 Motion was made by Rieb, seconded by Miller to approve the consent

Item 7 Public Assessment Hearing on Code Violations
Mayor Dahl opened the public hearing to consider proposed assessments
for City ordinance and public maintenance code violations at 7439
165th Street West. The City Clerk attested to legal notice being duly
published and mailed. Finance Director Dennis Feller presented the
proposed assessment for contractual mowing of weeds and grass and
incurred labor and equipment charges to remove rubbish. The total
amount proposed to be assessed to the parcel is $1,144.82.
There were no questions or comments.
10.12 Motion was made by Rieb, seconded by Swecker to close the public
hearing. Voice vote was taken on the motion. Ayes, unanimous.
10.13 Motion was made by Miller, seconded by Swecker to approve Resolution
No. 10 -18 adopting assessment No. 1269 for City ordinance and public
maintenance code violations at 7439 165th Street West.
Roll call was taken on the motion. Ayes, unanimous.
Item 8 Cedar Avenue Bus Rapid Transit Corridor
City Engineer Keith Nelson asked the City Council to consider a Joint
Powers Agreement with Dakota County for right -of -way acquisition,
highway and transitway construction, signal construction, utility relocation
and streetscape improvements for the Cedar Avenue Bus Rapid Transit
(BRT) Corridor. He explained that the City of Lakeville will be responsible
for 2.58% of the construction costs and right -of -way acquisition, which is
estimated at $358,000. He explained that Dakota County will front -end
the City's share of cost without interest until 2014 when the City has
available state aid funding. In addition, the City will share in contract
administration and inspection costs for the highway improvements, which
is estimated at $100,000. Lakeville's total cost is estimated at $458,000.
Kristine Elwood, Project Manager, Dakota County Transportation
Department, explained that the Cedar Avenue transitway will connect
Lakeville to the Mall of America, and the downtowns, by a bus rapid
transit system that will operate on the shoulders of Cedar Avenue.
Improvements along Cedar Avenue will include landscaping, decorative
concrete borders and benches, retaining walls and privacy fences. The

City will be responsible for maintaining the aesthetic elements of the
project.
Ms. Elwood explained the project cost breakdown and funding sources,
which include Federal, State, County Transit Improvement Board and
local funds. Utility work, resulting in temporary lane closures, and bidding
will take place in the fall of 2010. Major construction and permanent lane
closures in Lakeville will take place in the spring through the fall of 2011.
Ms. Elwood indicated that Dakota County will host public meetings to
discuss the project on February 18 and March 18 at the Dakota County
Western Service Center in Apple Valley. She further stated that public
informational meetings will be held monthly throughout the project.
Mr. Mielke explained that overhead utility lines on the east side of Cedar
Avenue will be buried with this project. Also, new signal systems will be
constructed at Glacier Way and at Griffin Trail /Upper 164th Street. Access
modifications include a three quarter intersection at 162nd Street /167th
Street and right -in /right -out only at Upper 167th Street. These
improvements will improve the overall speed and safety along the
corridor.
10.14 Motion was made by Swecker, seconded by Rieb to approve a Joint
Powers Agreement with the Dakota County Department of Transportation
for right -of -way acquisition, highway and transitway construction, signal
construction, utility relocation and streetscape improvements for the
Cedar Avenue Bus Rapid Transit, Improvement Project 08 -12.
Roll call was taken on the motion. Ayes, unanimous.

Mayor Dahl read a letter to the City of Lakeville from the Mayor of
Coral Gables, Florida, commending the Lakeville North High School
Marching Band on their participation in the Jr. Orange Bowl Parade
Winter Ritter Fest at Ritter Farm Park, February 28
Chaplaincy Benefit Concert at the Arts Center, February 28
Mayor Dahl adjourned the meeting at 8:27 p.m.
