PLANNING COMMISSION MEETING MINUTES
February 6, 1986
7:00 p.m.
Dennis Miller, Chairman, called the meeting to order at 7:00 p.m.
in the Lakeville City Council Chambers.
Roll call of members was taken. Present: Cammack, MacGibbon,
Miller, Sizer, Walters, Whittingham. Absent: Langhorst
Also present: Roger Knutson, City Attorney; David Licht, City
Planner; Jim Robinette, Community Development Director; Shirley
Sorensen, Recording Secretary.
Chairman Miller called for additions or corrections to the
minutes of the January 16, 1986 planning commission meeting.
86.12 Motion was made by Sizer, seconded by Whittingham, to approve the
minutes of the January 16, 1986 planning commission meeting.
Roll call was taken on the motion. Ayes: Whittingham, Sizer,
MacGibbon. Abstain: Walters, Miller, Cammack
Chairman Miller opened the public hearing to consider the
application of Robert Carroll, et al by James F. Sheldon his
attorney, for subdividing a site to allow one commercial lot with
public street access to Cedar Avenue at 161st Street or 162nd
street. Mr. Knutson stated that the proper mailed and published
notices have been given for this hearing.
Mr. Robinette said that this is a preliminary plat only. Mr.
Licht stated they have reviewed this property to find that
setbacks are met, as well as necessary easements and right-of-
ways being provided. They recommend approval of this subdivision
preliminary plat.
.Miller questioned whether the access would be on 161st Street or
162nd Street, or both. He was told that it probably would be
161st Street, but in order to protect ourselves we are asking for
either/or at this time.
86.13 Motion was made by Sizer, seconded by Cammack, to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous
86.14 Motion was made by Sizer, seconded by Miller, to recommend to
city council approval of the application of Robert Carroll, et al
by James F. Sheldon his attorney, for subdividing a site to allow
one commercial lot with public street access to Cedar Avenue at
either 161st Street or 162nd Street, or both, subject to the
planner's report dated January 8, 1986 and any comments from city
staff.

Roll call was taken on the motion. Ayes: Unanimous
Chairman Miller opened the public hearing to consider the
application of Dallas Development Company for a sign variance
location to allow a 36 square foot free standing lighted cabinet
directional sign for Gephart's Furniture in SouthFork Center.
Mr. Knutson stated that the proper mailed and published notices
have been given for this hearing.
Mr. Licht explained the desired location of the sign, more than
50 feet from the store entrance, is necessary because of the
access, topography and obstructions that keep the Gephart Home
Center from being identified easily, thus feeling the variance
should be allowed.
The minutes will show that the City of Lakeville received a
letter from Richard Halbleib on January 27, 1986 voicing a
negative opinion about allowing additional signs of any size or
configuration at SouthFork Center. (Copy attached)
Mr. Bernie Frey, Dallas Development Company, explained that the
Gephart store is the anchor in this complex and feels they do
need to be identified. He went on to say they will not allow any
• of the smaller shops in the complex to have a directional sign
such as this.
Mr. Lennie Gephart explained that customers have missed them,
coming down from the Cities, because the building is not identi-
fied on the Highway 50 side.
Planning commission members Sizer, MacGibbon, Whittingham,
Walters and Cammack all felt there is a definite need for a sign
to direct people to the Gephart Store. Mr. Frey answered any
questions they had regarding the sign and placement of it.
Mr. Terry Langhorst was not present at the meeting, but a memo
from him voiced his disapproval of this variance, saying it would
set a precedent that could be followed by many businesses in that
area. Miller agreed with Langhorst, but later changed his mind.
Mr. Licht said that the primary sign at SouthFork Center is 40
square feet less than what is allowable in our ordinance,
therefore feels this sign should be allowed.
Sizer stated he was, and still is, opposed to the Lakeville Mall
signing, but feels there is definitely a need in the Gephart
case. He feels the store is buried, with no exposure at all, and
we should help them out.
It was reiterated that this is a variance for the placement of
the sign and not the sign itself.

Mr. Frey said they are very concerned about the aesthetics and
would not even consider a sign if it wasn't a nice one.
86.15 Motion was made by Walters, seconded by MacGibbon, to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous
86.16 Motion was made by MacGibbon, seconded by Sizer, to recommend to
city council approval of the application of Dallas Development
Company for a sign variance location to allow a 36 square foot

Furniture in SouthFork Center, subject to staff recommendations
and planner's report dated January 8, 1986.
Roll call was taken on the motion. Ayes: Unanimous
Mr. Robinette and Mr. Licht briefed the commission members on the
background of the accessory building matter and that there is a
City Council Work Session scheduled for Monday, February 10th,
that planning commission members may plan to attend, to again
express their feelings.
• A short discussion followed on portable signs in Lakeville.
86.17 Motion was made by Walters, seconded by Sizer, to adjourn the
meeting.
Voice vote was taken on the motion.
Chairman Miller adjourned the meeting at 7:45 p.m.
