FIRE FIGHTING SERVICE AGREEMENT BETWEEN CITY OF
LAKEVILLE AND EUREKA TOWNSHIP
Proposed Action
Staff recommends adoption of the following motion: Move to approve Fire Fighting Service
Agreement between the City of Lakeville and Eureka Townshin.
Approval of the motion will approve the Fire Fighting Service Agreement between the City of
Lakeville and Eureka Township.
Overview
The City of Lakeville has contractually provided fire services to the western half of Eureka
Township for decades; the City of Farmington serves the eastern half.
The proposed Agreement is for a four year term with all terms and conditions consistent with
those of prior Agreements. The Agreement is premised on an approximate 3% per year increase
in costs. Eureka Township therefore has agreed to reimburse the City of Lakeville $33,240;
$34,240; $35,270 and $36,330 for the years 2011 - 2014 respectively.
The Town Board approved the agreement at their June 14 meeting.
Primary Issues to Consider
Agreement relative to cost of services. Eureka's taxable property valuation is
approximately 2.21% of Lakeville's total valuation; Eureka is paying approximately
2.26% of Lakeville's Fire Department costs.

FIRE FIGHTING SERVICE AGREEMENT
THIS AGREEMENT made and entered into this 14th day of June 2010, by and
between the City of Lakeville, a municipal corporation, party of the first part, and Eureka
Township, a municipal corporation, party of the second pant
WHEREAS, the party of the second part deems it advisable to have available
for the benefit of the residents of said Township services of the Fire Department operated
under the direction of the party of the fast part; and
WHEREAS, the electors of said Township have, pursuant to law, made the
necessary arrangements to provide a fund out of which to pay the expenses of fire
protection of said Township; and
WHEREAS, each of the parties has, by appropriate action, authorized its
officers to enter into this Agreement for the furnishing of such fire fighting service; and
WHEREAS, the State of Minnesota annually distributes to the county auditor
state aid to be apportioned for fire relief pension funds; and
WHEREAS, the City of Lakeville has such a fire relief fund; and
WHEREAS, Eureka Township contracts with the City of Lakeville for fire
protection services.
NOW, THEREFORE, it is mutually agreed by and between the parties hereto
that the party of the first part will, through its Fire Department, furnish and man suitable
fire fighting apparatus and will make all reasonable efforts to respond to fire calls and
fight fires at any place within 18 Sections West of Cedar Avenue known as: All Sections
4, 5, 6, 7, 8, 9, 16, 17, 18, 19, 20, 21, 28, 29, 30, 31, 32 and 33 provided, however, that
roads and weather conditions must be such that in the judgment of the Fire Chief or other
Fire Department officer in charge, whose judgment shall be final, the fire ran can be
made with reasonable safety to men and equipment.
IT IS FURTHER AGREED that the county auditor is hereby instructed to
remit the state aid fire relief funds, for the contracted service area, to the City of Lakeville
to be applied to fire relief pension funds for the contract period of January 1, 2011 to
December 31, 2015.
IT IS FURTHER AGREED that the party of the second part shall pay to the
party of the first part the sum of Thirty Three thousand two hundred forty ($33,240) prior
to September 1, 2011; Thirty four thousand two hundred forty Dollars ($34,240) prior to
September 1, 2012; Thirty five Thousand Two Hundred Seventy Dollars ($35,270) prior
to September 1, 2013 and Thirty Six Thousand Three Hundred Thirty Dollars prior to
September 1, 2014, which sum shall not be prorated or refunded if the contract is
cancelled.
IT IS FURTHER AGREED that this contract shall be in effect from January 1,
2011 to December 31, 201

IT IS FURTHER AGREED that while every reasonable effort will be made to
respond to fire calls and fight fires as provided above, the party of the first part, through
its Fire Department, shall be under no obligation to respond to fire calls received when
then engaged in responding to other fire calls or fighting one or more other fires. The
party of the first part shall not be liable in any way to the party of the second part or any
inhabitant or property owner or any other person, firm or corporation for failure of its Fire
Department to attend a fire, or to put out a fire, or for damage to property caused by a fire.
IN TESTIMONY WHEREOF, each of the parties hereto has caused this
Agreement to be executed on its behalf by its respective officers as of the date and year
first above written.
