HomeMy WebLinkAboutItem 06.kDate: 28 June 2010 Item No. CONTRACT ADDENDUM WITH SCR - SOUTHERN DIVISION ADDING WAGE DETERMINATIONS TO THE AGREEMENT FOR THE INSTALLATION OF AN ENERGY MANAGEMENT SYSTEM Proposed Action Staff recommends adoption of the following motion: Move to approve the contract addendum with SCR - Southern Division to add wage determinations to the agreement for the installation of and Energy Management System. Passage of this motion allows compliance with requirements of the Energy Efficiency and Conservation Block Grant Program to add wage determinations to the contracts funded through the program. Overview Wage determinations set forth the minimum wages to be paid to various classes of laborers and mechanics employed under a contract. For EECBG projects like the installation of an energy management system, provisions of the Davis -Bacon Act apply requiring wage determinations to be a part of the contract. Wage determinations are established by the Department of Labor. In May 2010, Council awarded the contract to SCR - Southern Division for the installation of an energy management system. Information regarding the Davis -Bacon Act was included in the contract documents, however, the wage determinations needed to be added to the original agreement. This addendum adds the appropriate wage determinations to the agreement. Staff has reviewed the contract addendum and recommends its approval. INCORPORATION BY REFERENCE. The parties have previously entered into a contract dated May 3, 2010 for the Installation of an Energy Management System project which is incorporated herein by this reference shall remain in full force and effect except as specifically modified by this Addendum. 2. PREVAILING WAGE. The Contractor, for itself and its subcontractors, agrees to pay prevailing wages pursuant to the requirements under Davis Bacon Act, 47 USC § 276A, and in accordance with any local, state or federal laws, rules or regulations relating to federal funding obtained by the Owner for the project. Contractor shall provide Owner verification of wages paid under this paragraph upon request. The current prevailing wage rates are set forth on the attached Exhibit "A ". Other designations indicate unions whose rates have been determined to be prevailing. WAGE DETERMINATION APPEALS PROCESS 1.) Has there been an initial decision in the matter? This can be: • an existing published wage determination • a survey underlying a wage determination • a Wage and Hour Division letter setting forth a position on a wage determination matter Page 5 of 6 http: / /www.wdol.gov /wdol /scafiles /davisbacon/MN68.dvb 6/25/2010 Page 6 of 6 * a conformance (additional classification and rate) ruling On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis -Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed. With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7).
