Resolution Authorizing Application for Designation
of a Transit Improvement Area
Proposed Actions
Staff recommends adoption of the following motion: Adopt resolution authorizing the submittal
of an application to the Minnesota Department of Employment and Economic Development for
the designation of a Transit Improvement Area adjacent to the Lakeville Cedar Park and Ride.
Passage of this motion will result in the City's submittal of an application for this designation for
the area within one half mile of the park and ride located at Cedar Avenue and 181 Street.
Overview
The Minnesota Department of Employment and Economic Development (DEED) recently
announced a solicitation for applications from local units of government to seek designations of
Transit Improvement Areas (TIA). At this point, the State has not funded this program.
However, because of the increased availability of federal funds for transit and sustainable
communities, DEED has been requested to consider approving designations of TIAs to allow
local units of government to seek other sources of funding for these types of projects.
The City has received several inquiries regarding the possible development of properties
adjacent to the Lakeville Cedar Park and Ride located at the intersection of Cedar Avenue and
181S Street. Water and sewer services will have to be extended approximately one quarter of a
mile from the north to reach the properties immediately adjacent to this Park and Ride facility.
While there are no specific projects proposed or state or federal funding sources currently
identified and available, staff is recommending that the City submit an application for
designation of a TIA for the Lakeville Cedar Park and Ride in order to be able to pursue future
funding opportunities.

• The primary issues to consider were addressed in the attached memo that was reviewed at
the June 28 City Council Work Session.

RESOLUTION APPROVING THE APPLICATION AND THE LAKEVILLE CEDAR
PARK AND RIDE TRANSIT IMPROVEENT AREA PLAN
WHEREAS, the City of Lakeville has approved a Comprehensive Plan that
provides for a range of different types of residential and commercial development within
the undeveloped areas of the proposed Transit Improvement Area along the Cedar
Avenue Transitway; and
WHEREAS, the City of Lakeville wants to be able to pursue possible state and
federal programs that will help facilitate development projects that will increase the
effectiveness of transit service along the Cedar Avenue Transitway; and
WHEREAS, the Dakota County Regional Railroad Authority has adopted a
resolution supporting communities in Dakota County seeking Transit Improvement Area
Designation; and
NOW, THEREFORE, BE IT RESOLVED that the City of Lakeville has approved
the Transit Improvement Area Designation application submitted to the Minnesota
Department of Employment and Economic Development (DEED) on July 16 for the
Lakeville Cedar Park and Ride.
BE IT FURTHER RESOLVED that upon approval of this application by the state,
Mayor and City Clerk may enter into an agreement with the State of Minnesota for the
above - referenced plan and that the City of Lakeville certifies compliance with all
applicable laws and regulations as stated in all contract agreements.

Subject: Application for Designation of a Transit Improvement Area
The Minnesota Department of Employment and Economic Development (DEED)
recently announced a solicitation for applications from local units of government to
seek designations of Transit Improvement Areas (TIA). TIA designation was
established during the 2008 Session of the State Legislature and was created to
allow local units of government to designate properties within 1 /2 mile of a BRT, light
rail, or commuter rail station. Once designation was approved, TIAs would be
eligible to apply for state loan dollars to assist in the funding of projects that
"increase the effectiveness of transit" by incorporating commercial, residential, or
mixed use development. At this point, the State has not funded this program.
However, because of the increased availability of federal funds for transit and
sustainable communities, DEED has been requested to consider approving
designations of TIAs to allow local units of government to seek other sources of
funding for these types of projects.
In Lakeville we have the Kenrick Park and Ride along I -35 and the Lakeville Cedar
Park and Ride along Cedar Avenue that could possibly qualify for the designations of
TIAs. The City has not received any inquiries regarding development proposals near
the Kenrick Park and Ride with the exception of the former Jackson Landscape
property and the vacant parcel north of this property at the northeast corner of Co.
Rd. 46 and Keokuk. Both of these are currently being marketed for sale and are
located across I -35 from the Kenrick Park and Ride.
The City has received several inquiries regarding the possible development of
properties adjacent to the Lakeville Cedar Park and Ride located at the intersection
of Cedar Avenue and 181 Street. All of the properties immediately adjacent to this
Park and Ride are still undeveloped and thus will more likely be considered for
development in the short term. Water and sewer services will have to be extended
approximately one quarter of a mile from the north to reach the properties
immediately adjacent to this Park and Ride facility.
While there are no specific projects proposed or state or federal funding sources
currently identified and available, staff is suggesting that the City submit an
application for designation of a TIA for the Lakeville Cedar Park and Ride. It is not
certain that this application for designation will be approved by DEED, particularly
since there are no specific projects currently being proposed however, it would
appear it is worth the effort to submit the application for designation of a TIA for
this park and ride facility. DEED staff has indicated that there will likely be future
opportunities for designations of TIAs, particularly if State funding is appropriated
for this program in the future, or if this type of development is determined to be a
TIF eligible activity by the Legislature in the future.
If the Council is in agreement with this recommendation, a request to adopt a
resolution authorizing the submittal of this application for designation of Transit
Improvement Area for the Lakeville Cedar Park and Ride would be placed on the
July 16 Council Meeting Agenda.
The Minnesota Department of Employment and Economic
Development (DEED) is accepting applications for the desig-
nation of Transit Improvement Areas (TIA). Established by the
2008 legislature, M.S. §§ 469.35 and 469.351 were created
to designate land parcels in proximity to bus rapid transit light
rail transit and commuter rail stations. Upon designation, T1As
would be eligible to receive loan dollars to help fund projects
that increase the effectiveness of transit by incorporating com-
mercial, residential, or mixed -use development and provide
for safe, pedestrian friendly use. Unfortunately the program
remains unfunded since its inception. However, with the recent
availability of federal funds targeted towards transit and
sustainable communities, DEED has been requested to make
designations with the intention of leveraging applications for
other sources of funding.
Applications are only encouraged from applicants
seeking federal funding or those that find applying
beneficial for other immediate funding purposes.
Eligible Applicants:
■ Statutory or home rule charter cities
■ Counties
• Joint powers boards
• Eligible applicants must submit a Transit
Improvement Area plan.
Qualifying Plans:
■ The entire transit Improvement Area must be within
1 /2 mile radius of the transit station.
• The transit station must support at a minimum one
of the following modes: bus rapid transit, light rail
transit, or commuter rail.
• The transit station must be operational by the year
2020.
• The TIA plan must incorporate transit with
commercial, residential, or mixed -use development.
• Plans with a residential component must provide a
minimum of 12 units per acre or a density bonus that
allows for an increase in the number of residential
units.
The application deadline for the 2010 calendar year is July 16
at 4:00 pm. An applicant may seek designation for more than
one TIA; however, separate applications must be completed
for each.
