LAKEVILLE CITY CODE CONCERNING WATER SURFACE USAGE, REGULATING OPERATION OF WATERCRAFT ON LAKE MARION, MAKING PERMANENT EMERGENCY ORDINANCE NO. 60S THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: .SECTION 1. Section 7-2-2 of the Lakeville City Code is amended to add the following new subsection: B. Except as otherwise provided under Section 7-2-3E, the location and boundaries of zones set forth in subsection A over Lake Marion are as shown on the map. entitled Water Surface Use Zoning Map of Lake Marion, dated November 16, 199$, which is attached hereto and incorporated herein as Exhibit A. SECTION 2. Section ?-2-3 paragraph E of the Lakeville City Code is amended to read as .follows: 7-2-3: WATERCRAFT OPERATIONS REGULATED E. All of Lake Marion shall be subject. to aslow-no wake requirement for any person operating a watercraft. as defined in M.S. Section 86B.005, Subd. 18, when the level of the lake exceeds. 983.6 feet. The restrictions shall become effective upon posting at the public access, posting at City Hall, and upon other notice to the residents abutting Lake Marion, and it shall be unlawful for any person. to operate a watercraft anywhere on Lake Marion in excess of the slow minimum wake speed, defined by this ordinance as the slowest speed possible while still maintaining steerage control. When high water levels have subsided and have remained below an elevation of 983.6 feet, for three (3) consecutive days, said restrictions may. be removed, as .evidenced by removal of the posted notices. 53554.03 Reva1110198 -1- SECTION 3. This ordinance shall be effective immediately upon its passage and publication. City staff shall provide public notice of this emergency ordinance by posting in appropriate areas-and by publication.
