BY ADDING AN R-2A SINGLE FAlVIILY RESIDENTIAL ..DISTRICT AND AMENDING EXISTING REGULATIONS TO INCLUDE THE R-2A DISTRICT THE CITY COUNCII. OF THE CITY OF LAKEVILLE ORDAINS: SECTION 1. The definition of "Lot, Width" in Section 11-2-2 of the Lakeville City Code is amended to read: Lot, Width: For lots of record. and preliminary platted lots having legal standing on January 1, .1994, lot width .shall mean the minimum required horizontal distance between the side lot lines measured at right angles to he lot depth, at the front setback .line. For lots of record created after January 1, 1994, lot width shall mean the minimum required horizontal distance between the side lot lines, measured along a straight lot line at the midpoint of the front setback line. SECTION 2. The- table in Section 1 i~-4.E.1. of the Lakeville City Code is amended by adding the following: 1. Zoning District Maximum Height R-2A 15 ft. SECTION 3. The table in Section 11-6-4.F. of the Lakeville City .Code is amended by adding the following: 69425.03 .The Percentage Of The Required Minimum Lot Maximum Size That May Be Allowable Occupied By The Floor Area Zoning District Accessory Building (Sq. Ft•,~ R-2A** 10% (interior lot) 1,100 sf (corner lot) 1,250 sf (lots l acre or larger) ..1,400 sf SECTION 4. The text following the table in Section 11-6-4.F. of the Lakeville. City Code is amended to read as .follows: **For lots in the R-A District and. for lots of record in the R-1, R-2 and R-2A Districts created after Januaryl, 1994, and pre-19941ots in the R-1 and R-2 Districts one acre or larger, a garage attached to the principal building shall .not exceed the following: Single-family homes with an above-grade finished floor area of more than two thousand (2,000) square feet are permitted a maximum attached garage. area of one thousand two hundred fifty (1,250) square feet. A detached. accessory building area of not more than one hundred. fifty (150) square feet is permitted. in addition to the 1,250-square-foot attached garage. Attached garages on lots of record created after January 1, 1994, and pre-19941ots greater -than one acre may exceed. one thousand two hundred .fifty (1,250) square feet by conditional use permit- subject to the provisions listed in subsection. l l-6- 4H of this.. Section. Storage spaces located directly below attached garages shall not be considered in determining allowable accessory building .floor area. SECTION 5. The table in Section `11-6-7.E.1. of the. Lakeville City Code is amended by adding the following: Minimum Lot Depth District For Buffer Lots R-2A Single-Family. 150 ft. .SECTION 6. Section 11-6-7.E. of the Lakeville City Code is amended to add the. following as a .new. subparagraph 3 and to renumber the existing subparagraphs 3-6 accordingly: 69425.03 2 3. Setbacks along Major..Collector and Arterial Streets: Except. as may be approved by the City Council,. the following minimum setbacks shall be required: Side Yard Abutting Rear Yard Abutting A Major Collector A Major Collector Zonin District Or Arterial Street Or Arterial Street R- l Low Density .Single-Family* 40 ft. 50 ft. Section 11-8-3.B. of the Lakeville City Code is amended to read as follows: B. No structure in the A-P, R-A, R-l, R-2, ,R-2A, R-6, R-7, R-B, B-3, B-4, CBD-C, B-W, BC and I-1 Districts shall exceed three (3) stories or thirty five feet {35'), whichever is less. SECTION 8. Section 11-8-S.B. of the .Lakeville City Code is amended to read as follows: B. Restricted Uses and Areas: In the case of a residential lot in an R-2, R-2A, R-3, R-4, and R-5 District backing onto a dedicated limited. access highway, a flood plan, a public park or trail, or other such similar publicly reserved and development restricted areas (excluding shorelands or wetlands), the required rear yard .setback may be reduced one. foot {1') for each. foot of public space, but in no case shall the rear yard requirement be reduced more than ten feet (10'). SECTION 9. Section 11-9-6.E. of the.Lakeville City Code is amended to read as follows: E. Setback Area: Required accessory off-street parking shall not be provided in required front yards or in side yards in the case of a corner lot, in A-P, R-A, R-1, R-2, R 2A, R-3, R-4, R-S, R-B, and B-l Districts. 69425.03 3 ..:SECTION 10. Sectionll-22-1.A. of the Lakeville -City Code is amended by adding the following: A. Residential Districts: R-2A Single .Family Residential District SECTION 11. Title 11 of the Lakeville. City Code is amended by adding. a new. Chapter 26A to read as follows: CHAPTER 26A R-2A SINGLE-FAMII,Y RESIDENTIAL DISTRICT SECTION: 11-26A-1: Purpose 11-26A-2: Permitted Uses 11-26A-3: Permitted Accessory Uses 11-26A-4: Conditional Uses 11-26A-4.5: Interim Uses 11-26A-5: Lot. Requirements and Setbacks 11-26A-1: PURPOSE: The purpose. of the R-2A Single-Family District is to provide for urban density single-family detached residential dwelling units and directly related, complementary uses. 11-26A-2: PERMITTED USES: The following are permitted uses in an R-2A District: All permitted uses as provided for in the R-2 District.. 11-26A-3: PERMITTED ACCESSORY USES: The following' are permitted accessory uses in an R-2A District: All permitted accessory uses as allowed in the. R-2 .District. 69425.03 4 11-26A-4: CONDITIONAL USES: The following are conditional uses in the R-2A District (requires a conditional use permit based upon procedures set forth in and regulated by Section 11-3-2 of this Title): All conditional uses. allowed in the R-2 District. subject' to the same conditions as in .the R-2 District. 11-26A-4.5: INTERIlVI USES: Subject to applicable provisions ofthis Title, governed by Section 11-3-5 of this- Title:. All interim uses as allowed in the R-2 District. 11-26A-5: LOT REQUIREMENTS AND SETBACKS:.. The following minimum requirements shall be observed in the R-2A .District subject to additional requirements, exceptions, and modifications set forth in this Title: Lot Area:.' Corner.. 12,500 sq. ft. Interior 11,000 sq. ft. Lot. Width: Corner 100 ft. .Interior 85 ft. Setbacks: Front Yards Not less than 30 ft. Rear Yards 30 ft. Side Yards Not less than 10 ft. on each side nor less than 20 fl. on the side yard abutting a public right-of--way. SECTION 12. Section 11-27-2 of the Lakeville City Code is amended to read as follows: 11-27-2 PERMITTED USES: The following. are permitted uses in an R-3 District: .All permitted uses as provided for in the R-2A District. SECTION 13. Section 11-27-3 of the Lakeville City Code is amended to read as follows: 11-27-3 PERMITTED ACCESSORY USES: The following are permitted accessory. uses in an R-3 District: ` All permitted accessory uses as provided :for in the R-2A District. 69425.03 5 SECTION 14. Section 11-27-4 of the Lakeville City Code is amended to read as follows: 11-27-4 CONDITIONAL USES: The following are conditional uses in the R-3 District (requires a conditional use permit based_upon procedures. set forth in and regulated by Section 11-3-2 of this.Title): All conditional uses allowed in the R-2A ..District subject to the same conditions as in the R-2A District.. SECTION 15. Section l 1-27-4.5 of the Lakeville City Code is amended to read as follows: 11-27-4.5 INTERIM USES: Subject to applicable provisions of this Title,: the following are interim uses in the R-3 District and are governed by Section 11-3-5 of this Title: All interim uses. as allowed in the R-2A District. SECTION 16. Section 11-46-7.A. of the Lakeville City Code is amended by adding R-2A as follows: A. Residential (R-l, R-2,_R-2A, R-3, R-4, R-5, R-6, R-7): SECTION 17. Section i 1-46-9.A.2. of the Lakeville .City Code is amended to read as follows: 2. Exceptions: a. No conditional. use permit or shoreland impact plan shall be required for -the development of permitted uses contained within the A-P, R-A, R-1, R-2, R- 2A, R-3, or R-4 Districts provided that such uses are constructed on conforming lots and when abutting a .shoreline that -all such uses ..are. serviced with public sanitary sewer, or are located on lots which are ten (10) .acres or more. in size. b. No conditional use permit or shoreland impact plan shall be required for the development of permitted accessory. uses within the A-P, ,R-A, R-1, R-2, R- 2A, R-3, or R-4 Districts. SECTION 18.
