RESOLUTION NO. 10 -78
RESOLUTION ORDERING SECURING
OF VACANT BUILDING
WHEREAS, the building situated at 16108 Fairgreen Avenue, Lakeville,
Minnesota sustained damage as the result of flooding;
WHEREAS, the building is unsecured and vacant and is left open to trespass;
WHEREAS, the City Council has determined that the vacant building on the
property constitutes a hazardous building within the meaning of Minnesota Statute
§463.15, Subd. 3.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lakeville, Minnesota:
1. Pursuant to Minnesota Statute §463.251, the City hereby adopts and
approves the Order to Secure the Vacant Building attached hereto as Exhibit "A ".
2. The City Attorney, Campbell Knutson, Professional Association, 317
Eagandale Office Center, 1380 Corporate Center Curve, Eagan, Minnesota 55121, is
directed to serve the Order and to proceed with enforcement in accordance with
Minnesota Statutes §463.15 et seg.

PLEASE BE ADVISED, that pursuant to order of the Lakeville City
Council and by authority of Minnesota Statutes §463.15 et seq. you have six
(6) days from the date of service of this Order upon you to remedy the
unsecured building situated on property at 16108 Fairgreen Avenue, City of
Lakeville, County of Dakota, State of Minnesota, and legally described as
follows:
PIN: 22- 21177- 060 -12
Lot 6, Block 12, Donnay's Valley Park 8th Addition, according to the
recorded plat thereof, Dakota County, Minnesota.
The foundation of the building sustained damage from flooding. The
damage to the building has not been repaired. The building is vacant and open

to trespass and has not been secured and the building could be made safe by
securing this building.
If you fail to remedy the situation, the City will secure the building as
provided in Minn. Stat. §463.251, Subd. 3.
