HomeMy WebLinkAbout03-02-89 CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES MARCH 2, 1989 The meeting was called to order by Chairman Langhorst at 7:00 p.m. in the Airlake Council Chambers. Roll call of members was taken. Present: Whitehouse, Miller, Langhorst, Whittingham, Walters, Steigerwalt. Absent: Sizer Also present was Alan Brixius, Consulting Planner, Elliott Knesch, City Attorney, Daryl Morey, Assistant Community Development Director and Bruce Robertson, Assistant to the City Administrator/Acting Recording Secretary. A decision was made informally to continue approval of the minutes of the February 16, 1989 Planning Commission meeting until the next meeting due to late receipt of the minutes. The public hearing to consider the application of Heritage Development for the preliminary plat of 41 single family lots to be known as Highview Heights 5th Addition was opened. The City Attorney attested that all legal notices had been duly published and mailed. Alan Brixius made a presentation on the proposed development in which he described: - zoning issues - the history of previous plat proposals on the site - lot sizes - setback concerns He stated the preliminary plat proposal was in compliance with R-2 standards and a proposed rezoning to R-3 on a portion of the .plat should be denied. He recommended the Planning Commission grant approval incorporating the recommendations from the Parks and Recreation Committee, City Engineer and the Planning Consultant reports. Pamela Backer, the project manager for the development appeared before the Commission. She stated the church, which is located on part of the land in the proposed plat wanted to remain an "exception" and not be formally designated a lot and block. She went on to describe the reason why a request was made for R-3 zoning for part of the site. Comments of the Commission were as follows: Whitehouse: - expressed concern that no representative of the church was in attendance to discuss their desire for an "exception". - stated he preferred R-2 zoning on the entire site • PLANNING COMMISSION MINUTES MARCH 2, 1989 Walters: - felt the plat should remain as R-2 zoning especially consider- . ing only two lots would be lost if the R-3 rezoning on part of the plat was denied. - agreed that the church representatives should be in attendance in the discussion of the plat. Whittingham: - preferred the R-2 zoning on the entire site Steigerwalt: - inquired why the church wanted to be an "exception" - inquired why the name of a street changed suddenly from one part of the plat to another Langhorst: - supported R-2 zoning on the entire site - stated the church representatives were contacted by the City but chose not to be at the meeting • 89.41 Motion was made by Miller, seconded by Walters to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. Significant Commission discussion followed and involved concerns over road access around the church area and pedestrian access to the plat. 89.42 Motion was made by Whittingham, seconded by Steigerwalt to recommend approval of the application of Heritage Development for the preliminary plat of 39 single family lots to be known as Highview Heights 5th Addition and a minor comprehensive plan amendment to bring the area into the 1990 Urban Service Area subject to the recommendations in the reports of the Consultant Planner, City Engineer, Dakota County and Soil and Water Conser- vation District and with the additional stipulation that within one year of final plat approval, access for Valley View Church be relocated to Hallmark Way. Recommend denial of R-3 zoning, as the plat should remain R-2. Roll call was taken on the motion. Ayes: Unanimous. 2 PLANNING COMMISSION MINUTES MARCH 2, 1989 The public hearing to consider the application of U.S. Homes for • the vacation of the right of way of a portion of Howland Avenue was opened. The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey described the reason for the right of way vacation request, stating that Howland Avenue is currently a gravel roadway that extends southerly off 160th Street approximately 1800 feet south. The road is currently maintained and snow plowed by the City. Because of the request by U.S. Homes and a desire by the City's Public Works Department to no longer maintain this gravel roadway, City staff recommends approval of the vacation request. Significant Commission discussion followed and involved concerns/questions regarding: utility service, the need for the road to be paved in the future and the need to plow the road until the right of way vacation is finally approved and legal. 89.43 Motion was made by Miller, seconded by Walters to closed the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 89.44 Motion was made by Whitehouse, seconded by Steigerwalt to recommend approval of the application of U.S. Homes for the vacation of the right of way of Howland Avenue from the intersection with County Road 46 to the south, to its termination point of approximately 1800 feet. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Robert H. Elfering for the preliminary and final plat of two single family lots to be known as Forest Hills 2nd Addition was opened. The City Attorney attested that all legal notices had been duly published and mailed. Daryl Morey presented the proposed application citing the following: - site location - reason for the application of both preliminary and final plat at the same time - neighboring land use and zoning - street access - lot size - drainage - easements 3 PLANNING COMMISSION MINUTES MARCH 2, 1989 Gary Huberty, a nearby resident, appeared before the Commission • and discussed his concern over the proposed plat being in a natural drainage area. He stated that because of the recent drought, the water table has been low in recent years. He asked the Commission to consider what will happen when the water table goes back to normal. Robert Engus, a nearby resident, stated his concern over the effects the development would have on the pond located adjacent to the proposed plat. 89.45 Motion was made by Whittingham, seconded by Whitehouse to continue the public hearing on the application of Robert H. Elfering for the preliminary and final plat of two single family lots to be known as Forest Hills 2nd Addition until the March 16th meeting of the Planning Commission so the developer can appear before the Commission. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Trinity Evangelical Church for a conditional use permit for a building expansion was opened. The City Attorney attested that all legal notices had been duly published and mailed. 89.46 Motion was made by Whitehouse, seconded by Whittingham to • continue the public hearing on the application of Trinity Evangelical Church for a conditional use permit for a building expansion until the March 16, 1989 meeting. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Lakeville Shopping Center Associates for preliminary plat, to be known as Crystal Point, a rezoning from R7 to R3 and a conditional use permit for gasoline sales in the B4 zoning district along with a minor comprehensive plan amendment to include the area in the 1990 Urban Service Area was opened. The City Attorney attested that all legal notices had been duly published and mailed. Alan Brixius made a presentation on the proposal in which he described: - the history of the proposal - the proposed multiple uses of the development - the zoning considerations on each part of the plat - the screening between the residential and commercial portions of the proposed development - the need for a conditional use permit for gasoline sales - road access, landscaping, signage and trash container location in the commercial section of the development • 4 PLANNING COMMISSION MINUTES MARCH 2, 1989 Mike Faulk of Lakeville Shopping Center Associates appeared • before the Commission and introduced his three associates who would be responsible for the project. He went on to describe the proposed development in depth. He stated that 28 acres of both commercial and residential development would be constructed simultaneously. He went on to describe the specific layout of both the residential and commercial development. He concluded his comments by stating that the commercial portion of the development would include a child care facility. Significant Commission discussion followed and involved: - concerns over school children running across the street to the commercial retail development, causing safety problems. - trail access to the plat - sharp elevation drops on portions of the site - problems with access off of Ipava onto the commercial portion of the development - runoff from Crystal Lake - the need for safe pedestrian access across County Road 46 - the need for a right turn lane off of 162nd Street in the proposed child care facility - the types of signs to be used at the gas pumps in the proposed retail service station • - drainage/ponding concerns at the site - concerns that the proposed landscaping islands may cause snow plowing problems - support of a sidewalk on 163rd Street 89.47 Motion was made by Walters, seconded by Whitehouse to close the public hearing'. Roll call was taken on the motion. Ayes: Unanimous. 89.48 Motion was made by Whittingham, seconded by Steigerwalt to recommend approval of the application of Lakeville Shopping Center Associates for preliminary plat, to be known as Crystal Point, a rezoning from R7 to R3 and a conditional use permit for gasoline sales in the B4 zoning district along with a minor comprehensive plan amendment to include the area in the 1990 Urban Service Area, subject to the recommendations in the Planner, Engineering, Dakota County Soil and Water. Conservation District reports and the Park and Recreation Committee and with the deletion of recommendations numbers 2 and 3 in the Planner's report of February 8th and the criteria that all City lighting should be deflected away from property lines and rights of way. Roll call was taken on the motion. Ayes: Whitehouse, Langhorst, Walters, Whittingham and Steigerwalt. Nay: Miller • S PLANNING COMMISSION MINUTES MARCH 2, 1989 Miller stated he voted nay because he would like to see sidewalks on the north side of 163rd Street. The public hearing to consider the application of the City of Lakeville for an ordinance amending Title 7, Chapter 4 of the City Code pertaining to excavations and mining was opened. The City Attorney attested that all legal notices had been duly published and mailed. 89.49 Motion was made by Miller, seconded by Whitehouse to continue the public hearing to consider the application of the City of Lakeville for an ordinance amending Title 7, Chapter 4 of the City Code pertaining to excavations and mining until the first meeting in April. Roll call was taken on the motion. Ayes: Unanimous. At this time, Whitey Whitehouse discussed a number of concerns he had with City issues which included: - A recommendation that the City Council, as part of the annual budget process, provide for an individual to encourage commercial and industrial development in the community. He stated the City needs an increased industrial tax base. - He asked that the City Council meet with all committee/commission members in a Saturday "goal setting" meeting to discuss Council/Commission joint concerns and goals. 89.50 Motion was made by Miller, seconded by Walters to adjourn the meeting.
