HomeMy WebLinkAbout03-16-89 M CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES • MARCH 16, 1989 The meeting was called to order by Chairman Langhorst at 7:00 p.m. in the Airlake Council Chambers. Roll call of members was taken. Present: Whitehouse, Walters, Miller, Langhorst, Sizer, Whittingham, Steigerwalt. Also present was Jim Robinette, Community Development Director, Daryl Morey, Assistant Community Development Director, Pat Farrell, City Attorney, Alan Brixius, Consultant Planner and Mira Holliday, Recording Secretary. 89.51 Motion was made by Miller, seconded by Whittingham to approve the minutes of the February 16, 1989 meeting. Roll call was taken on the motion. Ayes: Unanimous. Whitehouse stated that on page five of the March 2 minutes, it should read Crystal Point instead of Crystal Lake. 89.52 Motion was made by Walters, seconded by Whittingham to approve the minutes of the March 2, 1989 meeting as amended. Roll call was taken on the motion. Ayes: Unanimous. 89.53 Motion was made by Whittingham, seconded by Whitehouse to continue to public hearing to consider the application of Trinity Evangelical Church for a conditional use permit for a building expansion per recommendation of staff. Roll call was taken on the motion. Ayes: Unanimous. Daryl Morey gave a review of the final plat of the Downtown Addition by Dakota County HRA. He stated that the City Engineer recommends approval subject to recommendations in his report of March 10, 1989. A brief discussion was held among Commission members. 89.54 Motion was made by Miller, seconded by Walters to recommend approval of the final plat of the Downtown Addition by Dakota County HRA subject to the 3/10/89 report of the City Engineer and any other recommendations of staff. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of Robert H. Elfering for the preliminary and final plat of two single family lots to be known as Forest Hills 2nd Addition was continued from the March 2, 1989 meeting. Daryl Morey gave a review of the plat. He stated it had been reviewed by the Natural Resources Committee, the Park and Recreation Committee, the City Engineer PLANNING COMMISSION MINUTES MARCH ~2, 1989 r~6 and the Dakota County Soil and Water Conservation District. He stated the staff recommends approval subject to the recommenda- tions of the above listed committees and the City Engineer. Gary and Kelly Huberty of 173rd Court and Craig Turner of Jonquil Avenue expressed concern over the elevation of the lots, drainage and the value of the homes to be built in comparison with the surrounding homes. The staff and Mr. Elfering responded to their concerns. The Commission discussed issues which included: - slab elevation - future of Jonquil Avenue - possible water problems - area storm sewer - berming around the homes - FHA standards which must be met 89.55 Motion was made by Miller, seconded by Walters to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 89.56 Motion was made by Miller, seconded by Steigerwalt to recommend approval of the application of Robert H. Elfering for the preliminary and final plat of two single family lots to be known as Forest Hills 2nd Addition subject to the recommendations of the 2/23/89 report by Daryl Morey., the City Engineer's reports of 2/23/89 and 1/13/89 and the report of the Dakota County Soil and Water Conservation District and that all requirements of the FHA concerning water levels be met. Roll call was taken on the motion. Ayes: Whitehouse, Miller, Langhorst, Steigerwalt. Nays: Sizer, Whittingham, Walters. The reason for Sizer's nay was he feels there would be too many water problems and that a storm sewer project for the area is necessary before the plat should be ,considered. The reason for Whittingham's nay was. the same as Sizer's. The reason for Walter's nay Was that. he feels the water problem will not. go away. The public hearing to consider the application of Independent School District 194 for a conditional use permit to construct a school and a rezoning from B-4 to R-2 was opened. The City Attorney attested that all legal notices had been duly published and mailed. Alan Brixius gave a review of the proposals. He recommended approval of the rezoning. He then reviewed the conditional use permit and discussed circulation of traffic , 2 PLANNING COMMISSION MINUTES MARCH 1989 layout, and landscaping. He recommended approval. He stated that a variance had been applied for the height of the gymnasium and that a public hearing would be held in April. There was no public comment. The Commission held a discussion which included: - Turn lanes on Dodd Blvd. into the site - Traffic flow on Dodd Blvd. - Only one entrance into the site 89.57 Motion was made by Miller, seconded by Walters to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 89.58 Motion was made by Sizer, seconded by Whitehouse to recommend approval of the application of Independent School District 194 for a conditional use permit to construct a school and a rezoning from B-4 to R-2 subject to the Planner's report of March 13, 1989 as amended to direct the City Engineer to request Dakota County to install turn lanes, and adoption of the findings of fact. Roll call was taken on the motion. Ayes:. Unanimous. The public hearing to consider the application of the City of Lakeville for an amendment to Ordinance 167, the Zoning • Ordinance, to allow retail sales of welding accessories in a B-4 District was opened. The City Attorney attested that all legal notices had been duly published and mailed. Alan Brixius gave a review of the amendment and conditions. Mike Faulk of Linville Properties, representing Toll Company was present and stated his support of the amendment. The Commission held a discussion including: - Propane tanks - Ventilation in storage area - Comparison of Lakeville with other communities - Appropriate terminology for the ordinance 89.59 Motion was made by Miller, seconded by Whittingham to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 89.60 Motion was made by Whittingham, seconded by Whitehouse to recommend approval of the application of the City of Lakeville for an amendment to ordinance 167, the Zoning Ordinance, to allow retail sales of welding accessories in a B-4 District. Roll call was taken on the motion. Ayes: Unanimous. 3 PLANNING COMMISSION MINUTES MARCH / b , 1989 The public hearing to consider the application of Toll Company for a conditional use permit to allow the retail sale of welding accessories in a B-4 District was opened. The City Attorney attested that all legal notices had been duly published and .mailed. Alan Brixius gave a review of the site plan and recommended approval subject to his report of 3/9/89. Several representatives of Toll Company were present. Betty Sindt inquired about the location of their sign. The architect of the project, Denny Griswold responded. The Commission held a discussion which included: - Ventilation - Building material - Delivery to and from site - Square footage of lot 89.61 Motion was made by Whitehouse, seconded by Walters to close the public hearing. Roll call was. taken on the motion. Ayes: Unanimous. 89.62 Motion was made by Whitehouse, seconded by Whittingham to recommend approval of the application of Toll Company for a conditional use permit to allow the retail sale of welding accessories in a B-4 District subject to the March 9, 1989 • Planner's report and adoption of findings of fact. Roll call was taken on the motion. Ayes: Unanimous. The public hearing to consider the application of the City of Lakeville for an amendment to Ordinance No. 167, the Zoning Ordinance, concerning water surface management standards for Crystal Lake was opened. The City Attorney attested that all. legal notices had been duly published. Jim Robinette gave a review of the proposed amendment stating it was in conjunction with the Burnsville ordinance. A brief discussion was held. 89.63 Motion was made by Miller, seconded by Sizer to close the public hearing. Roll call was taken on the motion. Ayes: Unanimous. 89.64 Motion was made by Miller, seconded by Steigerwalt to recommend approval of the application of the City of Lakeville for an amendment to Ordinance No. 167, the Zoning Ordinance, concerning water surface management standards for Crystal Lake. Roll call was taken on the motion. Ayes: Unanimous. • 4 r PLANNING COMMISSION MINUTES MARCH ~y2, 1989 The public hearing to conside//~rbb the application of the City of Lakeville for an amendment to Ordinance No. 167, the Zoning Ordinance, concerning standards in the R-Mfi District was contin- ued from the January 19, 1989 meeting. Daryl Morey reviewed the revised ordinance which was re-drafted by the City Attorney. Several citizens were present. Beth Horsman, the APEC Chairman expressed her support for the amendment. Betty Sindt expressed concern over the upkeep of the areas around mailboxes and presented pictures. She stated she would like to see something stated in the ordinance amendment concerning keeping the mailboxes accessible. Ms. Horsman stated her concern over the civil defense sirens which can not be heard inside. Mrs. Sindt explained that the sirens were not designed to be heard indoors. Pat Farrell, City Attorney stated he felt the current zoning ordinance would be adequate to enforce mobile home street maintenance. Jim Robinette stated he felt the ordinance amend- ment could cause problems in that the mobile home park owners would delay the snowplowing and street repair. Mr. Farrell stated that the mobile home park residents have the right to complain to the City if the streets are not maintained. A discussion was held concerning possible wording of the ordinance amendment and different ways to inform the mobile home park residents of their rights. 89.65 Motion was made by Sizer, seconded by Whittingham to continue the public hearing to allow time for a re-draft of .the ordinance amendment. 89.66 Motion was made by Sizer, seconded by Whittingham to adjourn the meeting.
