CITY OF LAKEVILLE
PLANNING COMMISSION MEETING MINUTES
MAY 4, 1989
The meeting was called to order at 7:00 p.m. by acting
Chairman Miller in the Airlake Council Chambers.
Roll call of members was taken. Present: Whitehouse, Walters,
Miller, Whittingham, Steigerwalt. Absent: Langhorst, Sizer.
Also present was Alan Brixius, City Planner, Elliott Knesch, City
Attorney and Mira Holliday, Recording Secretary.
89.92 Motion was made by Walters, seconded by Whitehouse to approve. the
minutes of the April 20, 1989 Planning Commission meeting.
Roll call was taken on the motion. Ayes: Whitehouse, Walters,
Steigerwalt. Abstain: Miller, Whittingham.
The public hearing to consider the application of Brandt
Engineering and surveying for the preliminary plat of 49 single
family lots to be known as Raven Lake, a rezoning to R2 and a
minor comprehensive plan amendment to bring the area into the
1990 Urban Service Area was opened. The City Attorney attested
that all legal notices had been duly published and mailed.
• Miller stated that per the request of the staff, the item was to
be continued until the next meeting pending further review by the
City Engineer. A number of residents of the Woodridge area were
present and stated their opposition to the project. They asked
that a review be given since so many of them were present. Alan
Brixius reviewed the preliminary plat and .answered questions.
Mr. Fred Grester of Java Trail had a map drawn to scale, compar-
ing the proposed Raven Lake lots to lots in Woodridge. It was
the general feeling of all the residents present that the
proposed development would decrease the value of their homes and
that the area surrounding Woodridge should have more continuity.
It was suggested by Mr. Percel of Jasper Trail that the next
meeting on this matter be held in a larger capacity setting. The
residents were advised to check with City Hall staff as to the
time and place of the next meeting.
89.93 Motion was made by Whittingham, seconded by Walters to continue
the public hearing to consider the application of Brandt
Engineering and Surveying for the preliminary plat of 49 single
family lots to be known as Raven lake, a rezoning to R2 and a
minor comprehensive plan amendment to bring the area into the
1990 Urban Service Area.
Roll call was taken on the motion. Ayes: Unanimous.

The public hearing to consider the application of Eldon Fossum
for a preliminary plat of 27 single family lots to be known as
Marion Hills 2nd Addition and a minor comprehensive plan
amendment to bring the area into the 1990 Urban Service Area was
opened. The City Attorney attested that all legal notices had
been duly published and mailed. Miller stated that per request
of the staff the item would be continued pending .further review
by the City Engineer and recommendation by the Natural Resources
Committee. Eldon Fossom was present and stated that all
problems had been resolved and requested the item be reviewed.
The Commission explained that until they receive all the
materials and recommendations they cannot make a recommendation
to the Council.
89.94 Motion was made by Whittingham, seconded by Steigerwalt to
continue the public hearing to consider the application of Eldon
Fossum for a preliminary plat of 17 single family lots to be
known as Marion Hills 2nd Addition and a minor comprehensive plan
amendment to bring the area into the 1990 Urban Service Area.
Roll call was taken on the motion. Ayes: Unanimous.
Alan Brixius gave a review of the final plat of Lake Marion
Estates 2nd Addition. He recommended approval subject to the
recommendations in his report of April 27, 1989. Rick Murray of
• Builders Development was present. The Commission discussed
phasing, the connection of County Road 64, adjacent unfin-
ished streets and the report of the City Engineer dated 4/27/89.
89.95 Motion was made by Whitehouse, seconded by Walters to recommend
approval of the final plat of Lake .Marion Estates 2nd Addition
subject to the Planner's report of 4/27/89, the Engineer's report
of 4/27/89 with the correction that the area be brought into the
1990 Urban Service Area instead of the 2000 Urban Service Area
and subject to a cul-de-sac being placed at the south end of Juno
Trail between Blocks 2 and 4 and any other staff recommendations.
Roll call was taken on the motion. Ayes: Unanimous.
It was decided to postpone item numbers 7 and 8 until later in
the meeting when a representative of ISD 194 would be present.
Alan Brixius gave a review of the proposed sign plan amendment
for McStop Convenience Center outlining his reports of April 24
and May 2, 1989. Mr. Wally Klus, representing McStop was present
and stated that he was not in complete agreement with the
Planner's report. He stated he feels the tenants of the
convenience. center are at a disadvantage as their shops are not
easily visible. There were several tenants of the convenience
center present and stated they felt the proposed signs are
crucial to their businesses because their shops are totally
hidden by parked semi trucks.

A lengthy discussion was held between staff, the Commission and
Mr. Klus which included various locations for the signs and
various sizes and types of signs.
89.96 Motion was made by Whittingham, seconded by Whitehouse to
recommend approval of a sign plan amendment for the McStop
Convenience Center to include two 50 square foot monument signs
to be located as shown on Exhibit B of the planning report dated
4/24/89.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of James Develop-
ment Company for the preliminary plat of 23 single family lots to
be known as Kingsley Cove and a minor comprehensive plan amend-
went to include the area in the 1990 Urban Service Area was
opened. The City Attorney attested that all legal notices had
been duly published and mailed for the preliminary plat aspect of
the application but that no legal notice had been published for
the requested variances. Alan Brixius gave a review of the
proposed plat, outlining his report of April 24, 1989. He
recommended approval of the plat subject to the recommendations
in his report.
Jim Ostenson and John Prins of James Development was present and
discussed the larger lot sizes stating they intended for the area
to be an upper bracket neighborhood. Wayne Tower of Pioneer
Engineering discussed the natural environment lake, stating they
intended to maintain the natural vegetation around the lake as
much as possible. Walt Sternberg, an adjoining property owner
was present to state his objections to the project. He stated
that Robert Street, a street of record, had not been legally
vacated and was his access out of his property. He also had
concerns over the sanitary sewer ponding which would adjoin his
property. Mr. Tower addressed Mr. Sternberg's concerns stating
that Robert Street had been duly vacated and that the ponding was
storm sewer, not sanitary sewer.
The Commission discussed runoff, setbacks, cul-de-sac length,
storm sewer, and access for existing residences in the area.
89.97 Motion was made by Whittingham, seconded by Whitehouse to
continue the public hearing to consider the application of James
Development Company for the preliminary plat of 23 single family
lots to be known as Kingsley Cove and a minor comprehensive plan
amendment to include the area in the 1990 Urban Service Area
.pending further review by staff and publication of the variance
requests.
Roll call was taken on the motion. Ayes: Unanimous.

Realty for the preliminary plat of 107 single family lots to be
known as Royal Woods and a minor comprehensive plan amendment to
include the area in the 1990 Urban Service Area was opened. The
City Attorney attested that all legal notices had been duly
.published and mailed.
The applicant was not present due to a death in the family.
89.98 Motion was made by Steigerwalt, seconded by Walters to continue
the public hearing to consider the application of Wensmann Realty
for the preliminary plat of 107 single family lots to be known as
Royal Woods and a minor comprehensive plan. amendment to include
the area in the 1990 Urban Service Area.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Highview
Associates, Inc. for the preliminary plat of 69 single family
lots to be known as Cherry Ridge Estates and a minor comprehen-
sive plan amendment to include the area in the 1990 Urban Service
Area was opened. The City Attorney attested that all legal
notices had been duly published and mailed.
. The applicant was not present.
89.99 Motion was made by Whitehouse, seconded by Steigerwalt to
continue the public hearing to consider the application of
Highview Associates, Inc. for the preliminary plat of 69 single
family lots to be known as Cherry Ridge Estates and a minor
comprehensive plan amendment to include the area in the 1990.
Urban Service Area.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of North Creek
Company for a conditional use permit for a mobile home park and a
minor comprehensive pla~.amendment to include the area in
the 1990 Urban Service Area was continued from the last meeting.
Alan Brixius gave a review of the proposal, outlining his report
of April 14, 1989. He stated he had discussed the
recommendations listed in the report with Mr. William Block and
he agreed with the landscaping recommendations but not with the
park dedication. Mr. Jack Wilkie, engineer for the project was
present to answer questions. There were several residents of the
North Creek Mobile Home Park, Phase I and II present to voice
their concerns over the completion of the first two phases before
the third phase begins.

- Storm shelter
- Completion of first two phases
- Park dedication requirements to be resolved by Park Committee
- On site inspection to be made by staff
89.100 Motion was made by Steigerwalt, seconded by Whittingham to
continue the pubic hearing to consider the application of North
Creek Company for a conditional use permit for a mobile home park
and a minor comprehensive plan amendment to include the area
in the 1990 Urban Service Area pending further review by staff.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of the City of
Lakeville for a text amendment to the City Zoning Ordinance 4167,
Section 35, 36, 37, 38 and 39 to allow a public or private
educational institution limited to pre-school, latch key and
adult education in B-l, B-2, B-3, B-4 and CBD-C Districts by
conditional use permit was opened. The City Attorney attested
that all. legal notices had been duly published and mailed.
The public hearing to consider the application of Independent
. School District 194 for a conditional use permit to operate a
pre-school latch key and adult education facility was opened.
The City Attorney attested that all legal notices had been duly
published and mailed.
Alan Brixius gave a review of the proposed text amendment and
the application of ISD 194, outlining his report of 4/27/89. He
recommended approval subject to the recommendations in the
report.
Faith McKay of ISD. 194 was present to answer questions. There
was no public comment. The commission discussed the following
items:
- Parking
- Hours of operation
- Return of property to original form if vacated by school
89.101 Motion was made by Whittingham seconded by Walters to close the
public hearing for consideration of the application of the
City of Lakeville for a text amendment to the City Zoning Ordi-
nance 4167, Section 35, 36, 37, 38 and 39 to allow a public or
private educational institution limited to pre-school, latch key
and adult education in B-l, B-2, B-3, B-4 and CBD-C Districts by
conditional use permit.

89.102 Motion was made by Steigerwalt, seconded by Whittingham to
recommend approval of the application of the City of Lakeville
for a text amendment to the City Zoning Ordinance #167, Section
35, 36, 37, 38 and 39 to allow a public or private educational
institution limited to pre-school, latch key and adult education
in B-1, B-2, B-3 and B-4 and CBD-C Districts by conditional use
permit subject to amendment of hours and 3 parking spaces to 6
parking spaces.
Roll call was taken on the motion. Ayes: Unanimous.
89.103 Motion was made by Whitehouse, seconded by Walters to close the
public hearing to consider the application of Independent School
District 194 for a conditional use permit to operate a pre-school
latch key and adult education facility.
Roll call was taken on the motion. Ayes: Unanimous.
89.104 Motion was made by Whittingham, seconded by Miller to recommend
approval of the application of Independent School District 194
for a conditional use permit to operate a pre-school latch key
and adult education facility subject to the recommendations in
the Planner's report of April 27, 1989 with the addition that the
playground area be returned to original form should the school
move to another location and subject to six parking spaces
instead of three and approval of the findings of fact.
Roll call was taken on the motion. Ayes: Unanimous.
89.105 Motion was made by Whittingham, seconded by Steigerwalt to
adjourn the meeting.
Voice vote was taken on the motion.
