CITY OF LAKEVILLE
PLANNING COMMISSION MEETING MINUTES
MAY 18, 1989
The meeting was called to order at 7:00 p.m. by Chairman
Langhorst in the City Council Chambers. Roll call of members was
taken. Present: Steigerwalt, Whittingham, Langhorst, Miller,
Whitehouse. Absent: Walters, Sizer.
Also present was Alan Brixius, City Planner, Roger Knutson, City
Attorney, Bob Erickson, City Administrator, Jim Robinette,
Community Development Director and Daryl Morey, Assistant
Community Development Director.
89.106 Motion was made by Whittingham, seconded by Steigerwalt to
approve the minutes of the May 4, 1989 Planning Commission
meeting.
Roll call was taken on the motion. Ayes: Steigerwalt, Whitt-
ingham, Miller, Whitehouse. Abstain: Langhorst.
The public hearing to consider the application of Brandt
Engineering. and Surveying for the preliminary plat of 49 single
family lots to be known as Raven Lake and a minor comprehensive
plan amendment to bring the area into the 1990 Urban Service
• Area was continued from the last meeting. Alan Brixius gave a
review of the preliminary plat which outlined the design
elements of the proposed plat as well as a comparison of lot
size, width and densities between Raven Lake, Woodridge 1st,
2nd, 3rd and 4th Additions, Oak Hills 2nd Addition and Oakridge
Heights Addition. He recommended approval subject to the
NAC report of April 24, 1989.
Tom Crouch, developer of the project gave some background on his
proposed plat.
Terry Fear, 182nd Street, Woodridge 4th Addition, asked if the
covenants for Raven Lake would be the same as those in
Woodridge. Mr. Crouch answered that he could not guarantee
that.
Dale Lapee, Java Trail, asked why the developer doesn't make the
lots on the southern part of the plat larger and charge more
money. Mr. Crouch answered that you would not necessarily get
more money and that a nice house can be put on the lots as
.proposed.
Susan Lapee, Java Trail, stated that she thought there was going
to be continuity of development in the area around Woodridge and
that the protective covenants would. be similar to those of
Woodridge.

Mr. Pie, Jasper Path, accused Mr. Crouch of misrepresenting the
• net density of the lot size for the lots backing to Raven Lake.
Donald Lancious, Java Trail, urged the Planning Commission to
have a commitment to maintaining surrounding property values by
mandating larger lot sizes in this case. He stated that the
Planning Commission is required by law (the City Zoning
.Ordinance) to act in this manner. He also stated that the
concerns and input of the residents of Woodridge are being
ignored.
Bob Brantley, 182nd Street, felt that it was wrong for lots of
this size to be platted adjacent to Woodridge.
Tom Larson, Java Court, Fred Drexler, Java Court and Tom Maim,.
Jamaica Court all voiced their concern and opposition to the
proposed plat.
Whitehouse stated he would like to see a reduction of one lot on
the south side of the plat to bring the lot density down to a
level equivalent to Woodridge 2nd and 3rd Additions directly
abutting the proposed plat to the south.
Miller expressed concern about the cul-de-sac servicing Outlot
A. He stated he is in agreement with the May 11, 1989 NAC
report to eliminate Lot 5, Block 4 to reduce the .density
• adjacent to Woodridge.
Whittingham feels her job as a Planning Commission member is to
look out for what is best for the citizens of Lakeville. She
expressed concern with the small lots sizes.
Langhorst asked the developer if he considered putting the
smaller lots on the north side.
89.107 Motion was made by Miller, seconded by Whitehouse to close the
public hearing.
Roll call was taken on the motion. Ayes:. Unanimous.
The issue of protective covenants was discussed between the
Commission members and City staff.
89.108 Motion was made by Miller, seconded by Steigerwalt to recommend
approval contingent upon the elimination of Lot 5, Block 4 and
the area be distributed over lots 1 through 4; the extension of
the northern cul-de-sac to Outlot A, Woodridge 4th Addition; and
upon the recommendations contained in the planning report dated
4/25/89 and the engineering report dated 5/11/89 and any
comments of other City staff.

The public hearing to consider the application of North Creek
Company for a conditional use permit for a mobile home park and
a minor comprehensive plan amendment to include the area in the
1990 Urban Service Area was continued from the last meeting.
Jim Robinette stated that staff has made every attempt to work
with the developer but since items from Phase I and II have not
been completed, staff is recommending denial of this conditional
use permit request.
Alan Brixius gave a brief summary of his May 15, 1989 report.
Bill Block, developer of North Creek, was present and spoke
about items contained in the NAC planning report. He stated
that he has completed all of the necessary items from the first
two phases and that he will comply with all requirements for
.Phase III.
Mr. Robinette stated that when the developer completes the items
remaining from the first two phases, he can come back for
consideration of Phase III, but that staff does not recommend
approval until these items are complete.
Susan Erickson, resident of North Creek Mobile Home Park, asked
about the lack of parks and playground equipment.
Doug. Erickson and Betty Penn, residents of North Creek Mobile
. Home Park, expressed their concerns regarding Phase III.
Whittingham and Steigerwalt stated they are not in favor of
approval of Phase III when items in Phase I and II are not
complete and they agree with staff's recommendation.
Whitehouse stated his concern over the location of the proposed
storm shelter and feels there should be two storm shelters
proposed.
Miller concurred with the Park and .Recreation Committee
recommendation of 4/29/89 for denial. He stated his concern
over the location of the storm shelter as well.
Langhorst stated he concurred with Whittingham and City staff.
89.109 Motion was made by Miller, seconded by Whittingham to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
89.110 Motion was made by Whittingham, seconded by Steigerwalt to
recommend denial subject to the planning reports and findings of
fact .

The public hearing to consider the application of Eldon Fossum
• for a preliminary plat of 17 single family lots to be known as
Marion Hills 2nd Addition and a minor comprehensive plan
amendment to bring the area into the 1990 Urban Service Area
was continued from the May 4, 1989 meeting.
Alan Brixius gave a review of the preliminary plat as per the
planning report dated 4/24/89 and recommended approval.
Steigerwalt asked about bike paths. Miller questioned the
number of lots with a building pad elevation of 1050 and water
runoff .
Langhorst questioned where the property line of the plat is in
relation to the high school.
Whitehouse questioned whether the comp plan amendment is for
1990, as indicated in the planning report, or 2010, as indicated
in the engineering report. Staff stated 2000 is the correct
figure.
Motion was made by Whittingham, seconded by Steigerwalt to close
the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
. 89.111 Motion was made by Whitehouse, seconded by Miller to recommend
approval subject to the planning report dated 4/24/89 and the
engineering report dated 4/10/89 and any other comments of City
staff .
Roll. call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of William D.
Jackson for a rezoning from B-4 to P.U.D. was opened. Alan
Brixius attested that all legal notices had been duly published
and mailed. He gave an outline of this request as per his report
dated 5/10/89 and recommended approval.
The applicant was present at the meeting.
Rose Watrie of Lakeville Heights asked what type of use will
this property have when the interchange for County Road 46 is
put in place and will the on/off ramps interfere with Mr.
Jackson's property.
Tom and Judy Nelson were concerned about another use similar to
the "spaceship" (Golf Dome) developing on the site if Jackson
Landscaping moves away.
Whitehouse stated he has no problems with the request and feels
• it is a win-win situation.

Miller asked about the sign plan for the site.
Steigerwalt asked if there are provisions necessary for the
upgrading of County Road 46.
89.112 Motion was made by Miller, seconded by Whitehouse to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
89.113 Motion was made by Steigerwalt, seconded by Whittingham to
recommend approval of the application of William D. Jackson for
a rezoning from B-4 to P.U.D. subject to the planning report
dated 5/10/89 with the addition of stipulation of ~~8 being "that
all B-4 uses be allowed in this PUD" and #9 being "that all
signs erected comply with the City Sign Ordinance."
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Paul E. Szurek
for a variance for lot area was opened. The City Attorney
attested that all legal notices had. been duly published and
mailed.
Daryl Morey gave a review outlining his report dated 5/12/89
stating the lot does not meet the 70% requirement from Section
• 9.3 of the Zoning Ordinance. A similar variance was granted in
1987 for the lot immediately to the west.
Claudia Riste, 12088 175th Street, questioned the location of
the building on the lot and would like to see it more centered
on the lot.
Steigerwalt questioned the reason why the house is to be
situated toward the west lot line and asked if the basement ele-
vation is adequate for development.
Whitehouse asked his builders to be sensitive to placement of
trash on and along the 175th Street. He stated that grading
should be such that drainage does not affect the neighbors.
Langhorst pointed out that the Klotz variance in 1984 had been
recommended for denial by the Planning Commission but the City
Council approved it anyway.
89.114 Motion was made by Miller, seconded by Whitehouse to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.

89.115 Motion was made by Whittingham, seconded by Steigerwalt to
• recommend approval of the application of Paul E. Szurek for a
variance for lot area and adoption of the findings of fact
subject to the planning report dated 5/12/89 with the addition
of stipulation ~~2 being that "The applicant shall obtain any DNR
permits, if required, prior to the issuance of a building
permit" and any other comments of City staff.
Roll call was taken on the motion. Ayes: Unanimous.
Alan Brixius gave a review of the final plat of Lake Marion
Estates 3rd Addition outlining his report of 5/10/89 and
recommended approval.
Miller questioned stipulation number 3 in the planning report.
89.116 Motion was made by Whitehouse, seconded by Miller to recommend
approval subject to the planning report dated 5/10/89 and the
engineering report dated 5/12/89 and any other comments of City
staff .
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of James
Development Company for the preliminary plat of 23 single family
lots to be known as Kingsley Cove and a minor comprehensive plan
amendment to include the area in the 1990 Urban Service Area was
continued from the May 4, 1989 meeting.
Alan Brixius gave an outline of the request based upon his
report dated 4/24/89 and recommended approval. The developers,
Jim Ostensen and John Prins, were present.
Walt Sternberg questioned the outcome of the question of access
to his property, siltation in the pond and the accuracy of the
elevations by the surveyor.
Steigerwalt stated she had a problem with the variance for the
tennis court.
Whitehouse stated he would agree with the recommendation for
denial of the side yard setback variance.
Whittingham stated she has a problem with both the tennis court
and side yard variances.
The developers stated they will attempt to screen and soften the
effect of the fenced tennis court.
Miller questioned the measuring point for determining the length
of the cul-de-sac with the variance and the need for the side
yard variance.

89.117 Motion was made by Steigerwalt, seconded by Whittingham to close
. the public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
89.L18 Motion was made by Miller, seconded by Whitehouse to recommend
approval of the application of James Development Company for the
preliminary plat of 23 single family lots to be known as
Kingsley Cove and a minor comprehensive plan amendment to
include the area in the 1990 Urban Service Area subject to the
planners report dated 4/24/89 and the engineering report dated
4/25/89 and any other comments of City staff.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Wensmann
Realty for the preliminary plat of 107 single family lots to be
known as Royal Woods and a minor comprehensive plan amendment to
include the area in the 1990 Urban Service Area was continued
from the May 4, 1989 meeting.
Alan Brixius gave a review based upon his report dated 4/24/89
and recommended approval.
Boy Payette of Builders Development, representing Lake Marion
Estates, stated they will tie into the proposed street to Royal
• Woods.
Caroline Euber of Sullivan Estates 1st Addition asked if 208th
Street was being extended and are trees going to be removed.
She was also concerned with the type of storm sewer and drainage
to be implemented because they have water problems now.
She asked if there were springs in the area and what happens if
the builders run into springs.
Whitehouse stated he felt the pond should be fenced as it could
be a problem for small children. He also requested that no
burning of cleared trees be listed as a recommendation.
Whittingham asked the developers to look at the drainage problem
very carefully because there currently is standing water
problems in the area and suggested they look at the installation
of drain tile.
Langhorst questioned the phasing.
89.119 Motion was made by Whitehouse, seconded by Miller to close the
public hearing.

89.120 Motion was made by Whitehouse, seconded by Miller to recommend
approval of the application of Wensmann Realty for the prelimi-
nary plat of 107 single family lots to be known as Royal Woods
and a minor comprehensive plan amendment to include the area in
the 1990 Urban Service Area subject to the planning report dated
4/24/89 with the addition of recommendation ~~7 "no burning of
cleared trees" and the engineering report dated 4/14/89 and any.
other comments of City staff.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Highview
Associates, Inc. far the preliminary plat of 69 single family
lots to be known as Cherry Ridge Estates and a minor comprehen-
sive plan amendment to include the area in the 1990 Urban
Service Area was continued from the May 4, 1989 meeting.
Alan Brixius gave an outline of his report on this subject dated
4/24/89 and recommended approval.
The developer, Neil Lewis, was present at the meeting.
Miller recommended an alternate street configuration as shown in
Exhibit E of the planning report.
Whittingham asked how the developer felt about the alternative
street configuration.
Steigerwalt asked what the slope would be for the alternative
street configuration.
Whitehouse wants the developer to pay close attention to tiling
as per the engineering and DCSWCD reports in order to reduce the
effect on residents of the Woodbury Addition.
89.121 Motion was made by Steigerwalt., seconded by Whitehouse to close
the public hearing. Ayes: .Unanimous.
89.122 Motion was made by Steigerwalt, seconded by Whittingham to
recommend approval of the application of Highview Associates,
Inc. for the preliminary plat of 69 single family lots to be
known as Cherry Ridge Estates and a minor comprehensive plan
amendment to include the area in the 1990 Urban Service Area
subject to the planning report dated 4/24/89 and the engineering
report dated 4/17/89 and any other comments of City staff.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Render
Development, Inc. for a preliminary plat of 72 single family
lots to be known as Kenwood Oaks and a variance for building
setback from Lee Lake was opened. The City Attorney attested
that all legal notices had been duly published and mailed.

Alan Brixius gave an outline of his report dated 5/10/89 and
recommended approval of both the preliminary plat and the
variance. The developer, Jim Render, was present.
Rose Watrie asked what the impact of this development on County
Road 5 will be.
July Nelson who lives on Lee Lake asked what is being done
regrading common/public assess on Lee Lake.
John Nelson asked about truck traffic access to the site.
Dennis Chick who also lives on Lee Lake asked what the level of
Lee Lake will be determined to be with regard to outletting
water from the lake.
Ralph Schultz, Kenwood Trail, questioned building pad elevations
for a couple of lots.
Whittingham asked the developer to pay close attention to the
.water in the area.
Miller expressed concern with the variance for building setback.
Alan Brixius stated he felt there is an undue hardship unique to
. the site which would justify the variance.
89.123 Motion was made by Miller, seconded by Steigerwalt to close the
public hearing.
Roll call was taken on the motion.. Ayes: Unanimous.
89.124 Motion was made by Miller, seconded by Whittingham to recommend
approval of the application of Render Development, Inc. for a
preliminry plat of 72 single family lots to be known as Kenwood
Oaks and a variance for building setback from Lee Lake subject
to the planning report dated 5/10/89 and the engineering report
dated 5/12/89 and any other comments by City Staff.
Ayes: Unanimous.
Alan Brixius gave an outline of the Lakeway Park PUD final plat
as per his report dated 5/10/89 and recommended approval of this
request.
The developer, Byron Watschke was present at the meeting.
Whitehouse asked about apartment location in the plat.

89.125 Motion was made by Miller, seconded by Whittingham to recommend
approval of the final plat of Lakeway Park subject to the
planning report dated 5/10/89, the engineering report dated
5/12/89 and any other comments by City staff.
Roll call was taken on the motion. Ayes: Unanimous.
Under other business, Bob Erickson, City Administrator, gave a
brief overview of the most recent meeting with the G1enEagles
developers.
89.126 Motion was made by Miller, seconded by Whittingham to adjourn
the meeting.
Voice vote was taken on the motion.
