PLANNING COMMISSION MEETING MINUTES
JULY 20, 1989
The meeting was called to order by Chairman Langhorst at 7:00
p.m. in the Airlake Council Chambers.
Roll call of members was taken. Present: Whitehouse, Miller,
Langhorst, Whittingham, Steigerwalt. Absent: Walters.
Also present was Alan Brixius, Consulting Planner, Elliott
Knesch, City Attorney, Daryl Morey, Assistant Community
Development Director and Mira Holliday, Recording Secretary.
89.155 Motion was made by Whittingham, seconded by Miller to approve
the minutes of the June 15, 1989 Planning Commission meeting.
Roll call was taken on the motion. Ayes: Whitehouse, Miller,
Whittingham. Abstain: Langhorst, Steigerwalt.
The public hearing to consider the application of Richard S.
Storlie for a conditional use permit for an accessory building
was opened. Alan Brixius attested that all legal notices had
been duly published and mailed. Staff requested that the matter
be tabled due to an additional conditional use permit for a curb
• cut being added to the application. Anew legal notice is
currently being published.
89.156 Motion was made by Miller, seconded by Steigerwalt to continue
the public hearing for consideration of the application of
Richard S. Storlie for a conditional use permit for an accessory
building.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Progress Land
Company, Inc. for a conditional use .permit for planned unit
development with R-2 zoning and preliminary plat for single
family development along with a minor comprehensive plan
amendment to bring the area into the 1990 Urban Service Area was
opened. The City Attorney attested that all legal notices had
been duly published and mailed. Alan Brixius gave a review of
the preliminary plat and PUD. He stated that an EAW is cur-
rently in progress and that the Natural Resources Committee had
not reviewed the EAW. He suggested the Commission table the
matter.
Mr. Paul Grusho of Finch Path had questions regarding the flood
plain area and screening. Alan Brixius addressed these ques-
bons. The Commission held a discussion which included:

- Screening
- Street access
- Culverts
- Price range of houses
- Phasing of the project
- Zoning of the adjacent Dodd Ridge project
- Corner lot sizes
Dale Harris, an adjoining property owner described drainage
problems on his property. It was recommended he contact either
Jim Robinette, Community development Director or Keith Nelson,
City Engineer.
Commission members and City staff discussed continuing the
public hearing to the August 3, 1989 meeting. The developer,
Warren Israelson, stated he would not be available on August 3rd
and asked that the public hearing be continued to the August 17,
1989 meeting.
Rick Leversen of Finch Path also questioned the drainage of the
area.
89.157 Motion was made by Steigerwalt, seconded by Whittingham to
continue the public hearing until August 17, 1989 to consider
the application of Progress Land Company, Inc. for a conditional
• use permit for planned unit development with R-2 zoning and
preliminary plat for single family development along with a
minor comprehensive plan amendment to bring the area into the
1990 Urban Service Area pending review of the EAW by the Natural
Resources Committee.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Bradford and
Audrey Johnson for a planned unit development conditional use
permit for a multiple family development within an R-7 zoning
district was opened. The City Attorney attested that all legal
notices had been .duly published and mailed. Alan Brixius gave a
review of the proposal for a 70 unit apartment development. He
recommended approval subject to the 16 recommendations in his
report dated July 13, 1989.
Brad Johnson was present and gave a description of the structure
of the apartments. He stated the DNR had given approval of the
grading. There was no public comment. The Planning Commission
held a discussion and all agreed that they approved of the plans
and commended Mr. Johnson on the added green space and
playground facility.
89.158 Motion was made by Miller, seconded by Whitehouse to close the
public hearing.

89.159 Motion was made by Whitehouse, seconded by Whittingham to
recommend approval of the application of Bradford and Audrey
Johnson for a planned unit development conditional use permit
for a multiple family development within an R-7 .zoning district
subject to recommendations in the Planner's report of July 13,
1989, with an additional stipulation that the turning radius on
interior street corners be adequate to accomodate 55 foot vans,
and the Findings of Fact.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of John Friedges
for a rezoning from B-4 to PUD was opened. The City Attorney
attested that all legal notices had been duly published and
mailed. Alan Brixius gave a review of the request and
recommended approval subject to recommendations of the Planner's
report dated July 13, 1989. The applicant was present and
stated he was in agreement with the Planner's report. There was
no public comment. The Commission held a discussion which
included:
- Future commercial use
- Screening
- Curb cuts
• - Berming
- Boundary lines
89.160 Motion was made by Miller, seconded by Steigerwalt to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
89.161 Motion was made by Miller, seconded by Whitehouse to recommend
approval of the application of John Friedges for a rezoning from
B-4 to PUD subject to the Planner's report of July 13, 1989 and
the Findings of Fact.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Messiah
Lutheran Church for an amendment to a conditional use permit for
building expansion was opened. The City Attorney attested that
all legal notices had been duly published and mailed. Daryl
Morey gave a review of the application stating the original
conditional use permit for construction of the church had been
issued last year. He recommended approval subject to the five
recommendations in his report of July 14, 1989 with the addition
of stipulation ~~6 being the church agree to assessments for the
improvement of Highview Avenue (Project 88-2).

Vernon Lovstad, representing the church was .present and stated
he had no problem with meeting the stipulations and responded to
each one. Mr. Lovstad commended staff and the Planning Commis-
sion for the efficiency with the public hearing process. Daryl
Morey stated that stipulation number one should be amended to
read "no later than June 1, 1990". There was no public comment.
The Commission held a brief discussion.
89.162 Motion was made by Miller, seconded by Steigerwalt to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
89.163 Motion was made by Whitehouse, seconded by Miller to recommend
approval of the application of Messiah Lutheran Church for an
amendment to a conditional use permit for building expansion
subject to the Planner's report of July 14, 1989 as amended.
Roll call was taken on the motion. Ayes: Unanimous.
A discussion was held concerning ordinance regulations regarding
.parking of vehicles "for sale". Daryl Morey summarized a report
dated July 14, 1989. The Commission discussed various aspects
of the report and opted to discuss the matter in more detail at
the next meeting.
• 89.164 Motion was made by Steigerwalt, seconded by Whittingham to
adjourn the meeting.
Voice vote was taken on the motion. Ayes: Unanimous.
