PLANNING COMMISSION MEETING MINUTES
AUGUST 3, 1989
The meeting was called to order by Acting Chairperson
Whittingham at 7:00 p.m. in the Airlake Council Chambers.
Roll call of members was taken. Present: Whitehouse,
Whittingham, Steigerwalt and Walters. Absent: Langhorst,
Miller.
Also present was Alan Brixius, City Planner, Elliott Knesch,
City Attorney, Daryl Morey, Assistant Community Development
Director, John Hennen, Zoning Violations and Recycling Coordina-
tor and Mira Holliday, Recording Secretary.
89.165 Motion was made by Steigerwalt, seconded Whitehouse to approve
the minutes of the July 20, 1989 Planning Commission meeting.
Roll call was taken on the motion. Ayes: Whitehouse,
Whittingham, Steigerwalt. Abstain: Walters.
The public hearing to consider the application of Richard S.
Storlie, 12393 205th Street, for a conditional use permit for
an accessory building was continued from the last meeting. The.
• public hearing to consider the application of Richard S.
Storlie, 12393 205th Street for a conditional use permit for a
second curb cut was opened and combined with the above continued
public hearing. The City Attorney attested that all legal
notices had been duly published and mailed.
Daryl Morey gave a review of the applications and his planning
report of 7/25/89. He recommended approval subject to the six.
stipulations listed in the report. He distributed pictures-which
an adjoining property owner (Bill Clifford) had supplied of his
view of the site of the proposed building. The adjoining
property owner had requested in a letter to the City that the
proposed building.. be screened. Mr. Morey stated that
recommendation number 4 of his report addressed the concern of
Mr. Clifford that the .proposed storage buidling be screened.
Mr. Storlie was present and stated he agreed with the
recommendations except for number 4; the installation of six, 3
- 4 foot tall evergreen trees along the north and east sides of
the proposed storage building by October 1, 1990. He stated
this would be very costly.
Commission members held a discussion including:

- Height of the building
- Future uses
- Screening
- Driveway surfacing
- Roof color
- Curb cut
It was the general feeling of the Commission that recommendation
number 4 of the planning report concerning sceening was too
excessive.
89.166 Motion was made by Walters, seconded by Whitey to close the
public hearings.
Roll call was taken on the motion. Ayes: Unanimous.
89.167.. Motion was made by Steigerwalt, seconded by Walters to recommend
approval of the applications of Richard S. Storlie for a
conditional use permit for a second curb cut and a conditional
use permit for an accessory building subject to the
recommendations in the planning report of 7/25/89 with the
deletion of recommendation number four and the addition of a
recommendation to provide landscape treatment along the north
and east sides of the proposed storage building and subject to
the findings of fact.
Roll call was taken'on the motion. Ayes: Unanimous.
Alan Brixius gave a review of the final plat of Kingsley Cove.
He recommended approval subject to recommendations in the
engineering report dated 7/25/89 and the planning report dated
6/26/89.
John Prinz, the developer was present and stated he was in
agreement with the recommendations.
The Commission members held a discussion which included:
- The exception
- Outlot B
Alan Brixius stated that recommendation number nine in the
report of 7/25/89 should read "the 2000 Urban Service Area"
instead of "1990 Urban .Service Area".
89.168 Motion was made by Whitehouse, seconded by Walters to recommend
approval of the final plat of Kingsley Cove subject to the
engineering report dated 6/26/89 and the planning report dated
7/25/89 with recommendation number nine as amended and any other
staff comments.
Roll call was taken on the motion. Ayes: Unanimous.

The public hearing to consider the application of Healey Ramme
Company for preliminary plat, planned unit development- condi-
tional use permit, variance for cul-de-sac length and rezoning
from R-2 to R-7 for a 72 unit apartment complex to be known as
Southfork Village 3rd Addition was opened. The City Attorney
attested that all legal notices had been duly published and
mailed.
Alan Brixius gave a review of the application, addressing each
request. He recommended approval subject to the recommendations
outlined in the report of 7/26/89. Mr. Tom Healy was present.
and distributed hand-outs concerning the Southfork Village
Apartments. He gave a description of the complex and reviewed
the recreational facilities and plans. He stated he is in
agreement with the recommendations of the planner's report.
Jerry McDonald of Kenwood Trail expressed concern over the
increased number of people that would be residing in the area.
He stated he had problems with people walking on his property.
Mr. Healey stated he would gladly have a notice placed in the
Southfork Village Apartment newsletter asking the residents to
respect the privacy of adjoining property owners.
Ray VonBank of Kenwood Trail stated his concern over the
effect the development would have on the property across Highway
. 50. Mr. Healey responded.
The Commission held a discussion which included:
- Access from Highway 50
- Grading
- Density
- Green space.
Whittingham stated she felt the entire Southfork Village
Apartment project was an asset to the City.
89.169 Motion was made by Whitehouse, seconded by Walters to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
89.170 Motion was made by Whitehouse, seconded by Walters to recommend
approval of the application of Healey Ramme Company for rezoning
from R-2 to R-7 subject to the recommendations of the planner's
report dated 7/26./89.
Roll call was taken on the motion. Ayes: Unanimous.

• 89.171 Motion was made by Whitehouse, seconded by Steigerwalt to
recommend approval of the application of Healey Ramme Company
for preliminary plat, planned unit development-conditional use
permit and variance for cul-de-sac length for a 72 unit apart-

subject to the planning report of 7/26/89 deleting recommenda-
tion number 5b on page three, the engineering report of 7/26/89
and any other staff recommendations.
Roll call was taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of the City of
Lakeville for an amendment to Ordinance No. 167, the Zoning.
Ordinance of the City of Lakeville, Section 9.15.5 as it relates
to the location of air conditioning units in residential
districts was opened. The City Attorney attested that all legal
notices had been duly published. John Hennen gave a review of
the proposed amendment, outlining his report of b/26/89. A
discussion was held among Commission members and staff. There
was no public comment.
89.172 Motion was made by Steigerwalt, seconded by Whitehouse to
continue the public hearing until the next meeting to enable
staff to do a redraft of the proposed ordinance that would
regulate. the loction of air conditioning units in a subsection
of its own.
Roll call was taken on the motion. Ayes: Unanimous.
A discussion concerning ordinance regulations regarding parking
of vehicles "for sale" was continued from the last meeting. The
Commission directed staff to draft an ordinance amendment with
wording similar to that proposed in Daryl Morey's report of
7/26/89 and publish a public hearing notice for September 21,
1989.
A discussion was held concerning farmers' markets. Alan Brixius
reviewed his report of 6/21/89. The Commission directed the
staff to prepare a draft ordinance for further review.
89.173 Motion was made by Steigerwalt, seconded by Whitehouse to
adjourn the meeting.
Voice vote was taken on the motion.
