PLANNING COMMISSION MEETING MINUTES
OCTOBER 19, 1989
The meeting was called to order by Acting Chairman Miller at
7:00 p.m. in the Airlake Council Chambers.
Roll call of members was. taken. Present: Steigerwalt, Holberg,
Miller, Walters, Whitehouse. Absent: Langhorst, Whittingham.
Also present was Elliott Knesch, City Attorney, Alan Brixius,
Consulting Planner and Daryl Morey, Assistant Community
Development Director.
89.216 Motion was made by Holberg, seconded by Whitehouse to approve
the minutes of the October 5, 1989 Planning Commission meeting.
Roll call was taken on the motion. Ayes: Steigerwalt, .Holberg,
Miller, Whitehouse. Abstain: Walters.
Alan Brixius gave a presentation of the final plat of Kenwood
Oaks. Comments of the Commission included:
- Future development potential of the two outlots.
- Stubbed street turnaround.
- Drainage and ponding area affects on Lee Lake and surrounding
property owners.
Whitehouse expressed his concern .over drainage and stated he
would like to see the engineering study on drainage in the Lee
Lake area that was being prepared. He felt this pending report
should have been submitted with the rest of the application
materials for consideration with the final plat.
89.217 Motion was made by Steigerwalt., seconded by Walters to recommend.
approval of the final plat of Kenwood Oaks subject to the
planning report of 10/11/89, the engineering reports dated
10/3/89 and 10/11/89, the DCSWCD report dated 10/15/89 and any
other staff recommendations.
Roll call was taken on the motion. Ayes: Steigerwalt, Holberg,
Miller, Walters. Nay: Whitehouse
The reason for Whitehouse's nay was that he would like to see
the engineering study on drainage in the Lee Lake area .prior to
making a final recommendation on this final plat.
The public hearing to consider the application of Marvin and.
Linda Moe for a conditional use permit to construct a storage
building at 9446 210th Street was opened. The City Attorney
attested that all legal notices had been duly published and
mailed.

• Daryl Morey gave a review of the application as outlined in his
report dated 10/19/89. A discussion was held which included:
- Possibility of applicant installing a paved driveway.
- Electricity to proposed storage .building.
- Possibility of exterior lights on proposed storage building.
- Removal of .existing, detached 150 foot accessory building.
Commission members agreed that the proposed storage building
.should. not be used for the storage of commercial vehicles "or
for rental purposes", the driveway should be paved by June 1,
1990 and the applicant should have 60 days following the
issuance of the building permit to remove the existing, 150
square foot storage building.
89.218 Motion was made by Whitehouse, seconded by Walters to close the
public hearing.
Ro11 call was taken on the motion. Ayes: Unanimous.
89.219 Motion was made by Whitehouse, seconded by Steigerwalt to
recommend approval of the application of Marvin and Linda Moe
for a conditional use permit to construct a storage building at
9446 210th Street subject to the planning report of .10/12/89,
the findings of fact and the conditional use permit stipulations
. as modified.
Roll call. was. taken on the motion. Ayes: Unanimous.
The public hearing to consider the application of Messiah
Lutheran Church for a conditional use permit for a day care
center to be located at 16725 Highview Avenue was opened. The
City Attorney attested that all legal notices had been duly
published and mailed.
Daryl Morey gave a review of the application as outlined in his
report dated 10/19/89. A discussion was held which included:
- Size of outdoor play area and rotation of children utilizing
the outdoor play area.
- Existing well and septic system adequacy.
- Size of outdoor play area.
- Permanent play equipment.
89.220 Motion was made by Steigerwalt, seconded by Walters to close the
public hearing.
Roll call was taken on the motion. Ayes: Unanimous.
89.221 Motion was made by Steigerwalt, seconded by Whitehouse to
recommend approval of the application of Messiah Lutheran Church
for a conditional use permit for a day care center to be located
at 16725 Highview Avenue.

The public hearing to consider the application of the City of
Lakeville for an amendment to Ordinance 167, the Zoning
Ordinance, as it pertains to dog kennels was continued from a
previous meeting.
Daryl Morey gave a presentation of the proposed amendment. A
discussion was held which included:
- Definition of domestic animals.
- Size of fence and adequacy to keep dogs contained.
- Definition of "sufficient".
- Proper disposal of animal wastes.
- Barking dogs.
- Types of non-porous materials and effectiveness of sealing
porous materials.
- Possible use of artificial turf for indoor exercise areas.
- Running one dog at a time leashed in exercise area.
- A boundary fence surrounding the containment fence to be
stipulated for exercise areas to keep people/children
away from animals.
- Negative effect of keeping dogs inside that have been trained
to relieve themselves outdoors.
- Animals exercised outdoors be supervised by an adult.
Staff will obtain a copy of American Boarding Kennel guidelines
which relate to a number of the above mentioned issues. Staff
will also further research this issue and prepare a revised
zoning ordinance amendment.
89.222 Motion was made by Whitehouse, seconded by Steigerwalt to
continue the public hearing to consider the application of the
City of Lakeville for an amendment to Ordinance 167, the Zoning
Ordinance, as it pertains to dog kennels.
Roll call was taken on the motion. Ayes: Unanimous.
Other business:
Commission members stated they would like to have City Council,
Park and Recreation Committee, Natural Resources Committee,
Economic Development Commission and Cable TV Board minutes
included in their agenda packets.
89.223 Motion was made by Holberg, seconded by Walters to adjourn the
meeting.
Voice vote was taken on the motion.
