OF LAKEVILLE ORDAINS: SECTION 1. Section 8-1-1 of the Lakeville City Code is amended to read: FIRE DEPARTMENT CONT'IhTITED: There is hereby continued in the City a Volunteer Fire Department consisting of a Chief, one District Chief for. every two stations,. a Training Officer, a Captain for each station, a Lieutenant for each station, a Board of Directors and not less than fifty (50) and no more than ninety (90) firefighters including the. above positions. The. exact number of firefighters shall be determined by resolution of the'City Council. SECTION 2. Section 8-1-2 of the Lakeville City Code is amended to read: ELECTION OF OFFICERS; The members of the Fire Department shall elect the Fire Chief, Assistant Fire Chief, District Chiefs, Board of Directors, and Secretary of the Department, as prescribed in the bylaws of the Department. The annual election shall be held in January at a time and place set by the Board of Directors.... The election of .the Fire Chief, Assistant Fire Chief, and `District Chiefs are subject. to confirmation by the City Council SECTION 3. Section 8-1=3- of the Lakeville City Code is amended to read:. DUTIES OF THE DEPARTMENT OFFICERS: The duties of the Fire Chief, Assistant Fire Chief, District Chiefs, and all other elected or appointed officers of the Department shall be set forth in the bylaws of the Department. SECTION 4. Section 8-1-4 of the Lakeville City Code is amended to read: BOARD OF DIRECTIONS:. The Board of Directors of the Department shall consist of the Fire Chief, .Assistant Fire Chief, one District Chief, and six (6) directors elected in accordance with the bylaws of the Department. The duties of the Board of Directors shall be as .set forth in the Department's bylaws. ~ooo.~ SECTION 5. Section 8-1-6 of the Lakeville City Code is amended to read: QUALIFICATIONS. FOR. MEMBERSHIP: Membership in the Department, including officers, shall be restricted to individuals between the ages of eighteen (18) and sixty-five (65). Members shall retire no later than the first c3ay of the month following their 65th birthday. New members shall be at least eighteen (18) years of age at the time of application. Each applicant accepted by the Department shall serve atwenty-four (24) month probationary period during which the firefighter. may be .dismissed with or .without cause. Probationary firefighters shall meet such additional qualifications as set forth in the Department's bylaws. SECTION 6. Section 8-1-7 of the Lakeville City Code is amended to read: BYLAWS: The Department shall adopt bylaws by atwo-thirds (2/3) .vote of the total membership of regular firefighters, subject to the confirmation of the City Council. The bylaws shall be consistent with this Chapter and all other present or subsequent City ordinances.. If the Department's bylaws conflicts with a City ordinance, the .City ordinance shall prevail. SECTION 7. Section 8-1-11 of the Lakeville City. Code is amended to read: FIRE MARSHAL:. The City shall .employ a qualified person to exercise the powers and perform the duties of the Fire Marshal as set forth in the adopted uniform fire code. The Fire Marshal may or may not be a member of the Lakeville Volunteer Fire Department. SECTION Title 8, Chapter 1 of the Lakeville City Code is amended. by adding Section 8-1- 12 to read: 8-1-12. DISMISSAL: The City Council may dismiss, without cause, any probationary or .regular firefighter or remove from office .any appointed or elected official of the Volunteer Fire Department. SECTION 9.
