HomeMy WebLinkAbout04-098 p_4 CITY OF LAKEVILLE RESOLUTION SATE May 17, 2004 RESOLUTION N0. 04-98 MOTION BY Bellows SECONDED BY Wulff RESQLUTION VACATING KENYON AVENUE RIGHT-OF-WAY AN[} AUTHORIZING TRANSFER OF CERTAIN REAL PROPERTY i WHEREAS, the Planning Commission has conducted a public hearing, preceded by two (2) weeks published notice, to consider the following described street,right-of-way vacation, and WHEREAS, the City Council has determined that it is in the public interest to approve the street right-of-way vacation; and WHEREAS, maintaining ownership of the street right-of-way by the City would not serve the public interest; artd WHEREAS, the proposed transfer of the vacated street right-of-way has no relationship to the City's Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council: 1. The following Kenyon Avenue public street right-of-way situated in Dakota County, Minnesota and legally described as follows is hereby vacated: That part of the Northwest Quarter of the Southwest Quarter of Section 13, Township 114, Range 21 Dakota County, Minnesota lying. easterly of the easterly line of Lot 9, Block 1, PARK RIDGE ESTATES, according to the recorded plat thereof; lying southwesterly of a line parallel with the distant 50.0 feet northeasterly of said easterly line; lying southerly of the easterly extension of the y'L south line of the North 25.0 feet of said Lot 9; and lying westerly of a line described as commencing at the southeast corner of Lot 8, Biock 1, PARK RIDGE ESTATES; thence northerly along east line of said Lot 8 a distance of 242.21 feet to the paint of beginning of the line to be described; .thence ' northwesterly, deflecting to the Left 07 degrees 01 minutes 40 seconds, a distance of 526.53 feet; thence northwesterly along a tangential curare concave to the southwest havng.a radius of 1,834.86-feet to the easterly extension of the north line of said Lo# 9 and there terminating. Said "Line 1" i described as beginning at the intersection of the west line of said Lot 9 with the south line of the North 25 feet thereof; thence easterly along- said south tine 578.07 feet; thence easterly along anon-tangential curve concave to the north having a radius of 11,512.16 feet to the east line of said Lot 9 and there terminating. The chord of said .curve deflects 1 degree 35 minutes 00 seconds to the right from said south line. .Subject to a perpetual easement for drainage and utility purposes in favor of the City of,Lakeville, Minnesota, thee. use of said:: easement shall not prevent.the Owners from traversing across, over, or through the southwesterly half of the Turn Back Area. 2. The requirements: of Minn. Stat. § 426.356 are hereby dispensed with as the same related to the transfer of the vacated street right-of=way from the: City to Janet M. Lebens and Mark A. Cruciani. 3. The Mayor and City Clerk are. hereby authorized to execute and°deGver a Quit Claim Deed from the City to Janet M. Lebens and Mark A. Cruciani covering the vacated.. street right-of-way. 4. The City Clerk is directed to file a certified copy of this resolution with the Dakota County Recorder. APPRUVED AND ADAPTED this 17t~' day of May, 2004..
