NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council: 1. The following public drainage and utility easement situated in Dakota County, Minnesota and legally described as follows is hereby vacated: That. part of the public drainage and utility easement lying over, under, and across Lot 2, Block 1, GRENADA BUSINESS PARK, Dakota County, Minnesota, according to the recorded plat thereof, said easement is described as follows Beginning at the southeast corner of said Lot 2; thence North 00 degrees 38 minutes 43 • seconds East,. assumed bearing, along the east Fine of said Lot 2 a distance of 68.43 feet; thence northwesterly a distance of .48.03 feet along said east line on a tangential curve concave to the southwest. having a radius of 60.00 feet and a central angle of 45 degrees 51 minutes 55 seconds; thence North 45 degrees 13 minutes 10 seconds West along the northerly line of said Lot 2 a distance of 61.00 feet; thence South 28.18. feet; thence South 45 degrees 13 minutes. 10 seconds East a distance of 5.65 feet; thence South 14 degrees 40 minutes 41 seconds East a distance of 47.28 feet; thence South 30 degrees 11 minutes 52 seconds West a distance of 71.43 feet; thence East a distance of 33.55 feet; thence South a distance of 15.00 feet to the south. line of said Lot 2 distant. 46.66 feet west from the point of beginning; thence. East 46.66 feet to the point of beginning. 2. Approval of the public drainage and utility easement vacation is conditioned upon the following: a) The applicant shall comply with the recommendations listed in the February 13, 2004 engineering report. b) Should any activity (including, but not limited to, grade. changes) within the existing or porposed vacation area,. necessitate relocation of any Xcel Energy electrical facilities located thierein, all costs associated with such relocation shall be the sole responsibility of the property owner. 3.
