RESOLUTION ADOPTING RESPONSE TO COMMENTS, FINDINGS OF FACT, AND
RECORD OF DECISION ON THE ENVIRONMENTAL ASSESSMENT WORKSHEET
(EAW) FOR THE BRANDTJEN FARM DEVELOPMENT
WHEREAS, Minnesota Rules Part 4410.4300 Subp. 19.D requires that an EAW
be prepared for the construction of at least 250 unattached or 375 attached units in a
city within the seven county Twin Cities metropolitan area that. has adopted a
comprehensive plan that contains the components listed under Minnesota Rules Part
4410.4300 Subp. 19.D; and
WHEREAS, on September 15, 2004 an EAW. was completed. for the Brandtjen
Farm Development, which will include approximately 709 life-cycle residential units and
50,000 square feet of commercial/community center on 236.4 acres in the City of
Lakeville; and
WHEREAS, beginning on September 22, 2004 copies of the EAW were
distributed to all persons and agencies on the official Environmental Quality Board
(EQB) mailing list and other interested parties; and
WHEREAS, press releases were submitted for publication in the Sun Current.
and This Week Life and Times newspapers to announce the completion. of the EAW., its
availability to interested parties, and the process for submitting comments on the EAW;
and

WHEREAS, on September 27, 2004 the EAW was publicly noticed in the EQB
Monitor, commencing the 30 day public comment period; and
WHEREAS, the 30 day comment period ended on October 27, 2004 and the City;
of Lakeville accepted and responded to all written comments received; and
WHEREAS, none of the comments received recommended preparation of an
Environmental Impact Statement (EIS) for the Brandtjen Farm Development.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lakeville, Minnesota:
1. The EAW was prepared in compliance with the procedures of the Minnesota
Environmental Policy Act and Minnesota Rules, Parts 4410.1000 to
4410.1700 j1997).
2. The EAW satisfactorily addressed all of the issues for which existing
information could have been reasonably obtained.
3. Based on the criteria established in Minnesota Ruies Part 4410.1700, the
project does not have the potential..for significant environmental effects.
4. The Response to Comments, Findings of Fact, and Record of Decision are
hereby adopted.
5. The City makes a Negative Declaration. An EIS is not required.
APPROVED AND ADOPTED by the City Council of the City of Lakeville, Minnesota this
