Resolution approving the amendment to
Military Leave of Absence Policy in the Employee Handbook
For both short-term and long-term military leaves as required by
Minn. Stat. 192.26
BE IT RESOLVED by the City Council of the City of Lakeville that effective
July 1, 2003, .the policy entitled "Military Leave of Absence" is approved and replaces
page 75 in the Employee Benefits section of the. Employee Handbook.
APPROVED this 16 day of June , 2003, by the City Council of the City of
Lakeville.

POLICY
Leaves for 15 days or less:
-1-:--Employees serving in a military reserve program are entitled to a leave
of absence, without loss of pay, seniority, status, efficiency rating,
vacation, sick leave, or other benefits for time spent with such military
reserve program in .training or in active service,. not to exceed fifteen
(15) days in any calendar year, in the manner provided in Minn.. Stat. §
192.26.
~-A Request for Leave form must be completed and forwarded to the
Human Resources Department, through the employee's supervisor,.
two weeks in advance of the requested leave.
• Upon completion of the leave the employee must report for work for
the next regularly scheduled shift.

Leaves in excess of 15 days:
• Em to ees are re uired to ive the cit advance notice written or verbal
of the upcomin military service. Exceptions to this requirement. would be
if the notice is impossible or unreasonable to give notice.
• The leave is unpaid after the initial 15 days to engacLe in military service.
• Employees have the option of using accrued vacation during the period of
military service.
• Insurance coverage will continue to be offered in accordance with staid
and federal laws (COBRA). This provides up to 18 months of continued
covera a at the em to ee's ex erase. Cobra notification will be sent out
following the notification guidelines.
• Employees will continue to accrue seniority with respect to employment
while engaged in militaryservice.
• Reemployment rights upon completion of military service. Employ

calendar days:
• Up to 30 days: employees must report for work for the next
re olarl scheduled shift on the da after release includes time
necessary for safe travel home and eight hours of rest}.
• . From 31 - 180 days: employees must app_y for reemployment
within 14 days after release.
More than 181 da}~s: employees must apply for reemployment
within 90 days after release.
Failure to return to work or apply for reemployment within the specified
time .limits does not necessarily forefeet the individual's re~m~loyment
rights, but makes that person subject to the city's rules concerning
unauthorized absence fram work.

status and pay, as well as other rights and benefits (including pro-rated
