RESOLUTION AUTHORIZING ACQUISITION OF CERTAINREAL
PROPERTY INTERESTS FOR OPEN SPACE, SCENIC AND PARK PURPOSES
WHEREAS, the City of Lakeville ("City") has the need for open spaces and public
parks;
WHEREAS, the City's Comprehensive Park, Trail and Open Space Plan ("Plan") has
established criteria for acquiring greenways, conservancy areas, open spaces and parks;
WHEREAS, consistent with the Plan, the City has acquired three parcels on the north
edge of the westerly backwaters of Lake Marion for greenway, conversancy area, open spaces,
park and scenic purposes ("Project Area"). The Project Area is depicted on Exhibit A;
WHEREAS, two residential parcels are located within the Project Area;
WHEREAS, acquisition of fee simple absolute interests affecting the properties
identified on Exhibit B within the Project Area is necessary to accomplish the City's objectives
as established by the Plan; and
WHEREAS, the City has the power of eminent domain to acquire real property for the
purposes described above pursuant to Minn. Stat. § 412.211.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Lakeville:
1. The City, through its designated attorneys, is hereby authorized to acquire the
necessary real property interests through voluntary acquisition or through the
commencement of eminent domain proceedings against all parties with interests
in the parcels identified in attached Exhibit B; and
2. The Mayor and City Clerk are hereby authorized to execute all documents
necessary to obtain, through involuntary or voluntary acquisition, real property
interests for the parcels identified in attached Exhibit B.
