HomeMy WebLinkAbout03-049 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION Date March 17, 2003 Resolution No. 03-49 Motion By Luck Seconded By Bellows RESOLUTION AUTHORIZING CONDEMNATION OF PROPERTY FOR DRAINAGE AND UTILITY EASEMENT PURPOSES WHEREAS, the City Council of the City of Lakeville does hereby determine that it is necessary and for a public use and purpose to acquire easements over the property described on the attached Exhibit "A", subject to engineering modification, if any, for public drainage and utility purposes; • WHEREAS, City staff and consultants have and will continue to work with the roperty P owner(s) to acquire .the easements; and WHEREAS, the City Council finds that development and construction conditions related to the area make it necessary. to acquire title to, and possession of, the property as soon as possible in order for the project to proceed in an efficient, cost effective and expeditious manner; NOW, THEREFORE, be it resolved by the City Council of the City of Lakeville, Minnesota: 1. That the City Attorney is authorized to commence eminent domain proceedings pursuant to Minnesota Statutes Chapter 117 to acquire public drainage and utility easements legally described on the attached Exhibit "A", subject to engineering modifications, if needed. 1 2. That the City Attorney is authorized to acquire the necessary property interests pursuant to the "quick take" provisions of Minnesota Statutes Section 117.042. 3. That the Mayor. and the City Clerk are authorized to execute all documents necessary, in the opinion of the City Attorney, to effect the acquisition of the necessary property interests. R EXHIBIT "A" to RESOLUTION An easement for utility purposes over and across the West 30.00 feet of the South one-half of the Northeast Quarter of Section 11, Township 114, Range 20, Dakota County, Minnesota, lying Southerly of the following described line: Commencing at the Southeast corner of said South one-half of said Northeast Quarter;. thence on an assumed bearing of North 00 degrees 24 minutes 22 seconds East, along the East line of the South one-half of said Northeast Quarter, a distance of 88.81 feet; thence North 73 degrees 27 minutes 39 seconds West, a distance of 787.32 feet; thence West, a distance of 647.72 feet; thence North, a distance of 183.91 feet to the Point of Beginning of the line to be described; - thence North 73 degrees 45 minutes 14 seconds West, a distance of 1306.0$ feet to the West line of the South one-half of said Northeast Quarter and there terminating. And also a temporary construction easement over and across the East 30 feet of the West 60 feet of the North 111.25 feet of the North one-half of the Southeast Quarter of Section 11, Township 114, Range 20, Dakota County, Minnesota. The above temporary construction easements shall be terminated on June 1, 2004. 3
