RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING ACQUISITION
OF EASEMENTS AND
SETTING A BID DATE TO RECEIVE BLDS FOR
KLAMATH TRAIL TRAILWAY PHASE III -CITY IMPROVEMENT PROJECT 01-09
WHEREAS, The City of Lakeville has deemed it necessary to complete the Klamath Trail
trail corridor between Orchard Lake Elementary School and County Road 46, City Project 01-09
("Project"); and
WHEREAS, It is recommended that funding for the Project come from the 2003 Park
Dedication Fund budget; and
. WHEREAS, SRF Consulting Group, Inc. has prepared Plans and Specifications for the
Project; and
WHEREAS, The City now intends to acquire temporary construction easements and a
permanent easement for the Project.
NOW, THEREFORE BE IT RESOLVED by the City Council of the .City of Lakeville,
Minnesota:
1. The .Plans and Specifications for the Project prepared by SRF Consulting Group
dated January 31, 2003 area hereby approved;
2. The City, through its attorneys for the Project, Rider, Bennett, Egan & Arundel,.. LLP,
is hereby authorized to acquire the easements necessary to complete the Project
through voluntary acquisition;
3. The Mayor and City Clerk are hereby authorized. to execute all documents necessary
to obtain the easements;
4. The City's attorneys for the Project, Rider, Bennett, Egan & Arundel, LLP, is hereby
authorized to commence condemnation proceedings, if deemed necessary by City
Staff, including the "quick-take" provisions of Minn. Stat. Chapter. 117, since it is
necessary for the City to acquire temporary construction easements and a
permanent easement on an expedited basis in order. to commence and complete
construction of the Project during 2003..
BE IT FURTHER RESOLVED that bids for construction of.the Project will be advertised
as required and opened at 2:00 PM on Tuesday, March 4, 2003 at City Hall, 20195 Holyoke
Avenue, Lakeville, MN 55044.
APPROVED AND ADOPTED this 3rd day of February 2003.
