RESOLUTION AUTHORIZING TRANSFER
OF CERTAIN REAL PROPERTY
WHEREAS, the City is the owner of the following described real property:
That part of the South half of the Northwest Quarter of Section 28, Township 114, Range
20 according. to the United States Government Survey thereof, Dakota County,
Minnesota, described as follows:
Commencing at the southwest corner of said South half of the Northwest Quarter; thence
on an assumed bearing. of North 89 degrees 28 minutes 58 seconds East, along the south
tine of said Sauth half of the Northwest Quarter, a distance of 2084.03 feet, to the point
of beginning; thence North 30 degrees 39 minutes 47 seconds West,. a distance of 542.64
feet; thence .North 00 degrees 24 minutes 10 seconds East, parallel .with the east line of
said South half of the Northwest Quarter, a distance of 850.00 feet, to .the north line of
said South half of the Northwest Quarter; thence North $9 degrees 52 minutes 49 seconds
• East, along said north line of said South half of the Narthwest Quarter, a. distance of
600.00 feet, to the west line of McNEARNEY AND CARSON ADDITION, accarding to
the recorded plat thereof; thence South 00 degrees 24 minutes 10 seconds West,. parallel

with he east line of said South half of the Northwest Quarter, along said west line of said
McNEARNEY AND CARSON ADDITION, a distance of 1317.89 feet, to the south line
of said South half of the Northwest Quarter, also known as the north line of VILLAGE
CREEK 2MD ADDITION, according. to the recorded plat thereof; thence South 89 degrees
58 minutes 28 seconds West, along said north line of said VILLAGE CREEK 2ND
ADDITION, a distance of 320.00 feet, to the point of beginning,
("Subject Property"}.
WHEREAS, the City desires to transfer the Subject Property to Joe Miller Farms, Inc.
pursuant to a proposed Real Estate Exchange Agreement;
WHEREAS, maintaining ownership of the. Subject Property by the City would not serve "
the pubtic interest; and
WHEREAS, the proposed transfer of the Subject. Property has no relationship to the
City's Comprehensive Flan.
NOW, THEREFORE, BE IT RESQLVED by the City Council of the City of
Lakeville:
1. The requirements of Minn.. Stat: § 462.356 are hereby dispensed with as the same
relate to the transfer of the Subject Property from the City to Jae Miller Farms,
Irte.; and
• 2. The Ma or and Cit Clerk are hereb authorized. to execute the Real Estate
Y Y Y
Exchange Agreement and all documents referenced. therein, in order to convey the
Subject Property to Joe Miller Farms,-Inc.
ADOPTED this 15th day of Deceinber , 2003, by the City Council of the
City of Lakeville,
