CITY OF LAKEVILLE.
DAKOTA COUNTY, .MINNESOTA
AN ORDINANCE AMENDING TITLE 11, THE ZONING ORDINANCE OF THE LAKEVILLE CITY
CODE CONCERNING PROPERTY OWNER NOTIFICATION REQUIREMENTS FOR
CONDITIONAL USE PERMITS, AMENDMENTS, AND VARIANCES.
THE CITY COUNCIL OF THE CITY OF LAKEVILLE DOES HEREBY ORDAIN:
Section 1. .Section 11-3-1.A.1 and 2, Amendments, of Title 11 of the Lakeville City. Code
is amended to read as follows:
1) .Request for rezonings shall be filed with the Zoning Administrator on an official
application form. Such application shall be accompanied by a fee as provided by
City Council resolution. Such application shall also be accompanied by ten {10)
copies of detailed written and graphic materials fully explaining the proposed
change, .development, or use and a list of property owners .located within. five
hundred (500} feet of the subject property obtained from and .certified by an abstract
company. The request for amendment shall be placed on the agenda of the first
possible Planning Commission meeting occurring after ten (10) days from the date
of submission, The request shall be considered as being officially submitted when
all the information requirements are complied with.
2) Upon receipt of said application, the City Clerk shall set a public hearing following
proper hearing notification. The Planning Commission shall conduct the hearing
and report its findings and make recommendations to the City Council. Notice of
said hearings shall consist of a legal property description, description of request
and property location, and. be published in the official newspaper at least ten (10)
days prior to -the hearing and written notification of said hearing shall be mailed at
least ten (10) days priorto all owners of land within five hundred (500) feet of the
boundary of the property. in question if notification is required by State Statute.
.Section 2. Section 11-3-2-B.1 and 2, Conditional Use .Permit -Procedure, of Title 11 of
the Lakeville City .Code is amended to read as follows:
1) Request for conditional use permits,. as provided within this Title, shall be filed with
the Zoning Administrator on an official application form. Such application shall be
accompanied by a fee as provided for by City Council resolution. Such application

shall also be accompanied by ten (10) copies of detailed written and graphic
materials fully explaining the proposed change, development, or use and a list of
property owners located within three hundred fifty (350) feet of the subject property
for applications involving single family detached dwellings and property, and five
hundred (500). feet for applications involving other uses. Said listing .shall be
obtained from and certified by an abstract company. The request for conditional
use permit shall be placed on the agenda of the first possible Planning Commission
meeting occurring after ten (10) days from the date of submission. The .request
shall be considered as being .officially submitted when all the .information
requirements: are complied with.

Section 3. Section 11-3-3.B.2.a and b, Major Variances, of Title 11 of the Lakeville City
Code is amended to read as follows:
a. Request for a variance or appeal shall be filed with the Zoning Administrator on an
official application form.. Such application shall be accompanied by -a fee as
established. by City Council Resolution. This fee shall not be refunded. Such
.application shall also be accompanied by ten (10) copies of detailed written and
graphic materials necessary for the explanation of the request, and a list of property
owners located within five hundred (500) feet of the subject property. obtained from
and certified by an abstract company.
b. The. Planning Commission shall: conduct a public hearing following proper hearing
notification. The Planning Commission shall conduct the hearing, and report: its
findings and. make recommendations to the City Council. Notice of the. hearing shall
consist of a legal property description, description of request .and be published in
the official newspaper at least ten (10) days prior to the hearing and written
notification of said hearing shall be mailed at least ten (10) days prior to all owners
of land within five hundred (500) feet of the boundary of the property in question.

Section 4. Section 11-7-3.B, Special Home Occupations of Title 11 of the Lakeville City
Code is hereby amended to read as follows:
B. Special Home Occupation: Any home occupation which does not meet the specific
requirements for a permitted home occupation as defined in this Section shall
require a "special home occupation permit" which shall be applied for, reviewed and
disposed of in accordance with the provisions of Section 11-3-2 of this Title, except
that mailed notification need not exceed three hundred fifty (350) feet..
Section 5. This Ordinance shall be effective following its passage and publication.
ADOPTED this 25th day of April , 1996 by the City Council of the City of
Lakeville.

(2) Maximum rate allowed by law for the above
matter: $16.20 per column inch.
(3) Rate actually charged for the above
