RESOLUTION AUTHORIZING TRANSFER
OF CERTAIN REAL PROPERTY
(Ritter Farm Park Property Transactions)
WHEREAS, the City is the owner of the following described real property, which
constitutes a portion of Ritter Farm Park:
That part of the west 61.49 feet of Government Lot 6, Section 24, Township 114,
Range 21, Dakota County, Minnesota, lying southerly of the easterly extension of
the north line of the South Half of the Southeast Quarter of the Northeast .Quarter
of Section 23, Township 114, Range 21, Dakota County, Minnesota,
("Subject Property");
WHEREAS, in order to redefine the location of boundary lines of properties and
delineate the location of public access roads in the Ritter Farm Park area (the "Project"), the City
is conveying the Subject Property to Stephen G. Kippels and Robin L. Smith ("Kippels/Smith");
WHEREAS, Kippels/Smith in return is conveying to the City real property described as
follows:
The west 421.00 feet of the east 1047.26 feet of the north 60.00 feet of the
South Half of the Southeast Quarter of the Northeast Quarter of Section
• 23, Township 114, Range 21, Dakota County, Minnesota;

• and granting the City a permanent easement for roadway, utility and drainage purposes
for real property described as follows:
A permanent easement for roadway, utility and drainage. purposes over,
under and across that part of the Southeast Quarter of the Northeast
Quarter of Section 23, Township 114, Range 21, Dakota County,
Minnesota, the southeast and southwest corners thereof being marked by
Judicial monuments, which lies within. the circumference of a 60.00 foot
radius circle, the center of said circle is a point on the south line of said
Southeast Quarter of the Northeast Quarter, distant 1011.80 feet easterly
from, as measured along said south line, the southwest corner of said
Southeast Quarter of the. Northeast Quarter;. and that part of the south
30.00 feet of the east 251.26 feet of said Southeast Quarter of the
Northeast Quarter lying easterly of the above described 60.00 foot radius
circle; and the south 30.00 feet of the west 61.49 feet of Government Lot
6, Section 24, Township 114, Range 21, Dakota County, Minnesota, lying
within the parcel owned by Kippels/Smith;
WHEREAS, also involved in this Project are these additional property transactions:.
1. Atherton Bristol and Patricia A. Bristol ("Bristol") is conveying to the City -real
property described as follows:
. That part of the north 60.00 feet of the South Half of the Southeast
.Quarter of the Northeast Quarter of .Section 23, Township 114,
Range 21, Dakota County, Minnesota, lying westerly of the east
1047.26 feet of said South Half of the Southeast Quarter of the
Northeast Quarter, Dakota County, Minnesota;
and granting the City a permanent easement for roadway, utility and drainage
purposes for real property described as follows:
A permanent easement for roadway, utility and drainage purposes
over, under and across that part of the Southeast Quarter of the
Northeast Quarter of Section 23, Township 114, Range 21, Dakota
County, Minnesota,. the southeast and southwest corneas thereof
being marked by Judicial monuments, which lies within the

County, Minnesota, lying within the parcel owned by Bristol;
and
2. Kippels/Smith is conveying to Bristol real property described as follows:
That part of the west 23.00 feet of the east 649.26 feet of the South
Half of the Southeast Quarter of the Northeast Quarter of Section
23, Township 114, Range 21, Dakota County, Minnesota, lying
southerly of the north 60.00 feet of said. South Half of the
..Southeast Quarter of the Northeast Quarter, and lying northerly of
the south 60.00 feet of said South Half of the Southeast .Quarter of
the Northeast Quarter; and the west 88.62 feet of the east 626.26
feet of the north 32.53 feet of the south 92.53 feet of said South
Half of the Southeast Quarter of the Northeast Quarter;
WHEREAS, maintaining ownership of the Subject Property by the City would not serve
the public interest; and
WHEREAS, the proposed transfer.. of the Subject Property has no relationship to the
City's Comprehensive Plan.
. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lakeville:
1. The requirements of Minn._ Stat. §-.462.356 are hereby. dispensed with-as the-came
relate to the transfer of the Subject Property from the City to Kippels/Smith.
2. The Mayor and City Clerk. are hereby authorized... to execute and deliver a Quit
Claim Deed serving to convey the Subject Property from the City to
Kippels/Smith.
ADOPTED this 1st day of December, 2003, by the City Council of the City of
Lakeville.
