CITY OF LAKEVILLE
DAKOTA COUNTY, MINNESOTA.
AN ORDINANCE AMENDING TITLE 10, THE SUBDIVISION ORDINANCE, OF THE LAKEVILLE
CITY CODE. CONCERNING PROPERTY OWNER NOTIFICATION FOR PRELIMINARY PLAT
REVIEW AND SUBDIVISION ORDINANCE VARIANCES.
THE CITY COUNCIL OF THE CITY OF LAKEVILLE HEREBY ORDAINS:
Section 1. Section 10-2-2, .Procedures for Filing and Review.- Preliminary Plat,
is hereby amended to read as follows:
A. Filing: Twenty-five (25) copies of the preliminary plat and list of property owners
located within five hundred (500) feet of the subject property obtained. from and
certified by an abstract company, shall be submitted to the City Administrator. The
- required filing fee(s) as established by City Council resolution shall be paid and any
necessary. applications for variances from the provisions of this Title shall be
submitted with the required fee. The plat shall be officially submitted when all the
information requirements are complied with.
B. Hearing: The Planning Commission upon receipt of the application shall instruct
the City Clerk to seta public hearing for public review of the preliminary plat. The
hearing shall be held after adequate time has been allowed for staff and advisory
body review of the plat. The Planning Commission shall conduct the hearing and
report its findings and make recommendations to the City Council. Notice of the
hearing shall consist of a legal property description and description of request and
shall be published in the official newspaper at least ten (10) days prior to the
hearing. Written notification o'f the hearing shall be mailed at least ten (10) days
prior to all owners of land within five. hundred (500) feet of the boundary of the
property in question.. .
Section 2. Section 10-6-2-2 G., Variances -Procedures, is hereby amended to
read as follows:
G. The Planning. Commission shall request the City Administrator to set a date for a
public hearing. Notice of such hearing shall be published in the official. newspaper
at least ten (10) days prior to said hearing, and individual property notices shall be
mailed not less than ten (10) days nor more than thirty (30) days prior to the hearing
to all owners of property within five hundred (500) feet of the parcel included in the
request.

.Section 3. This Ordinance shall. be effective following its passage and
publication.
ADOPTED this 15th. day of april , 1996 by the. City Council of the City of
Lakeville.
