Proposed Action
Staff recommends adoption of the following motion: Approve Resolution adopting Special
Assessment No. 1277 for costs incurred by the City in securing a vacant building located at 16108
Fairgreen Avenue.
Overview
At its October 18, 2010 meeting, the City Council adopted a resolution calling a public hearing to
assess the costs of securing a vacant building, in accordance with Minn. Stat. §463.21. Following
due notice, the property owners and lien holders failed to secure the vacant building. In accordance
with an Order for Securing Vacant Building, Staff contracted to have the building secured.
The total amount proposed to be assessed to the parcel is as follows:
Contract repair work: $1,474.70
Attorney fees: 213.20
Legal Notice publication: 49.50
Special Assessment Administrative Fee: 35.00
Dakota County Special Assessment Fee: 3.50
Other: 120.00
Interest computed thru 12/31 /11: $ 379.18
Total Proposed Special Assessment: $2,275.08
The Notice of Hearing on the proposed assessment was published in the Dakota County Tribune on
October 21, 2010 and mailed on October 19, 2010 to the property owners and lien holders. Staff
has not received any written objections from the owner of the property being assessed.

RESOLUTION ADOPTING ASSESSMENT
FOR COSTS INCURRED TO SECURE A VACANT BUILDING

WHEREAS, pursuant to proper notice duly given as required by law, the City Council has
met, heard and passed upon all objections to the proposed special assessment costs incurred to
secure a vacant building, in accordance with Minn. Stat. §463.21.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville, Minnesota:
1. Such proposed assessment No. 1277 in the amount of $2,275.08 is hereby accepted
and shall constitute a special assessment against property legally described as Lot 6, Block 12,
Donnay's Valley Park 8 Addition, Dakota County, Minnesota, PID No, 22- 21177- 060 -12, with a
street address of 16108 Fairgreen Avenue, Lakeville, Minnesota. The subject property is hereby
found to be benefited by the improvement in the amount of the assessment levied against it.
2. Such assessment shall be considered payable and collected with the taxes payable in 2011
and shall bear interest at the rate of 18% per annum from the date of the adoption of this
assessment resolution to December 31, 2011.
3, The owner may at any time prior to certification of the assessment to the County
Treasurer- Auditor, pay the entire assessment on such property, with interest accrued to the date of
payment, to the City Finance Director. No interest shall be charged if the entire assessment is paid
within thirty (30) days from the adoption of this assessment. An owner may at any time thereafter
pay to the City the entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. If an owner decides not to prepay the
assessment before the date given above, the rate of interest that will apply is Eighteen (18 %)
percent per year.
4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the
County Auditor to be extended on the property tax lists of the County, and such assessment shall be
collected and paid over in the same manner as other municipal taxes.

NOTICE OF HEARING
ON PROPOSED ASSESSMENTS
NOTICE IS HEREBY GIVEN that the City Council will meet at 7:00 p.m. on November 15,
2010, at the City Council Chambers, 20195 Holyoke Avenue, Lakeville, Minnesota, to pass
upon the proposed assessment for costs incurred as a result of securing property located at
16108 Fairgreen Avenue in Lakeville, Minnesota.
The total amount to be specially assessed against the property is $2,345,64. The proposed
assessment roll is on file for public inspection at the City Clerk's office. Written or oral
objections will be considered at the City Council meeting. No appeal may be taken as to the
amount of the assessment unless a signed written objection is filed with the City Clerk prior
to the hearing or presented to the presiding officer at the hearing.
An owner may appeal an assessment to District Court pursuant to Minnesota Statutes
429.081, by serving notice of the appeal upon the Mayor or City Clerk of the City within thirty
(30) days after the adoption of the assessment and filing such notice with the District Court
within ten (10) days after service upon the Mayor or City Clerk.
Minn. Stat. §§ 435.193 -195 allows the City of Lakeville, at its discretion, to defer the amount
of a special assessment for any homestead property owned by a person sixty -five {65) years
of age or older, or retired by virtue of a permanent and total disability for whom it would be a
hardship to make payments. The City of Lakeville has established a deferment procedure
pursuant to these sections.
