Proposed Action
Staff recommends adoption of the following motion: Approve Resolution adopting
assessment of Weed /Grass Removal for 2010.
Overview
Notice of Special Assessment letters were sent on October 19, 2010 to the property owners
who were in violation of City Ordinance 4-1 -3 (Weed /Grass Ordinance). During the past
year, the Building Inspections Department authorized the contractual mowing of grass and
removal of weeds on property where the property owners had failed to correct the
violation.
The total amounts proposed to be assessed to the parcels are as follows:
Contract Weed Cutting $1,608.98
Legal Notice Publication 55.00
Special Assessment Administrative Fee 770.00
Dakota County Special Assessment Fee 77.00
Interest 502.04
Total Proposed Special Assessment $3,013.02
Staff has not received any written objections from the owners of the properties being
assessed for weed/grass removal.

RESOLUTION ADOPTING ASSESSMENT
OF WEED /GRASS REMOVAL
WHEREAS, pursuant to proper notice duly given as required by law, the City Council
has met, heard and passed upon all objections to the proposed special assessment of
Weed /Grass Removal.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville, Minnesota:
1. Such proposed Assessment No. 1276 in the amount of $3,013.02 is hereby accepted
and shall constitute the special assessment against the and named therein, and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the
amount of the assessment levied against it. The Special Assessment was calculated as
fol lows:

Dakota County Special Assessment Fee 77.00
Interest 502.04
Total Proposed Special Assessment $3,013.02
2. Such assessments shall be considered payable and collected with the taxes payable
in 2011 and shall bear interest at the rate of 18% per annum from the date of the adoption of
this assessment resolution to December 31, 2011.
3. The owner of the property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole of the assessment on such property, with
interest accrued to the date of payment, to the City Treasurer, except that no interest shall be
charged if the entire assessment is paid within 30 days from the adoption of this resolution.
The owner may, at any time following certification, pay to the City Treasurer the entire amount
of the assessment remaining unpaid, with interest accrued to December 31 of the year in
which such payment is made.
4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the
County Auditor to be extended on the property tax lists of the County, and such assessments
shall be collected and paid over in the same manner as other municipal taxes. The affected

NOTICE OF HEARING
ON PROPOSED ASSESSMENTS
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that the City Council will meet at 7:00 p.m. on November
15, 2010, at the City Council Chambers, 20195 Holyoke Avenue, Lakeville, Minnesota,
to pass upon the proposed assessment for the costs incurred as a result of City
Ordinance 4 -1 -3 (Weed/Grass) violations, The areas to be assessed are within the City
of Lakeville.
The total amount to be specially assessed against the properties is $3,076.01. The
proposed assessment "roll is on file for public inspection at the City Clerk's office.
Written or oral objections will be considered at the City Council meeting. No appeal
may be taken as to the amount of the assessment unless a signed written objection is
filed with the City Clerk prior to the hearing or presented to the presiding officer at the
hearing.
An owner may appeal an assessment to District Court pursuant to Minnesota Statutes
429.081, by serving notice of the appeal upon the Mayor or City Clerk of the City within
thirty (30) days after the adoption of the assessment and filing such notice with the
District Court within ten (10) days after service upon the Mayor or City Clerk.
Minn. Stat. §§ 435.193 -195 allows the City of Lakeville, at its discretion, to defer the
amount of a special assessment for any homestead property owned by a person sixty -
five (65) years of age or older, or retired by virtue of a permanent and total disability
for whom it would be a hardship to make payments. The City of Lakeville has
established a deferment procedure pursuant to these sections.
