HomeMy WebLinkAboutItem 08November 9. 2010 PUBLIC HEARING ON THE APPLICATION OF NORTHERN TIER RETAIL LLC FOR OFF -SALE 3.2% MALT LIQUOR LICENSES Proposed Action Staff recommends the following motion: Move to grant an off -sale 3.2% malt liquor license to Northern Tier Retail LLC, d.b.a. SuperAmerica #4337, SuperAmerica #4490 and SuperAmerica #4528, effective December 1, 2010 through June 30, 2011. Overview Item No. In accordance with Title 3 -1 -6 -2 of the Lakeville City Code, the City Council will conduct a public hearing on the application of Northern Tier Retail LLC for off -sale 3.2% malt liquor licenses at three SuperAmerica locations in Lakeville. The ownership change from Speedway SuperAmerica LLC to Northern Tier Retail LLC will become effective December 1, 2010. The applicant has submitted the required certificates of liquor liability insurance. Mayor Dahl will open the public hearing and ask the City Clerk to attest that notice of the hearing was duly published in the City's legal newspaper. Chief Vonhof will present the Police Department's report on the liquor license application. Mayor Dahl will then open the hearing to questions and comments. Peggy L. Perryman, Attorney with Faegre & Benson, will be present on behalf of the applicant to answer any questions that the Council members or public may have. Primary Issues to Consider Will there be any change in daily operations, management or business practices at any of the three stores as a result of the new licenses? No change is anticipated. On October 28, 2010, I was assigned to the liquor license background check for Northern Tier Retail LLC, D /B /A Super America. The following automated databases were checked to conduct this background; DVS, MNCIS, in -house records. criminal history files. As theses businesses have been in operation in the City of Lakeville for a long period of time and no changes in business practices are anticipated, interviews were not conducted as a part of this process. The application reports there will be no change in management so no application information was required of store managers. The operation and business practices of the Lakeville stores have not changed. Due the change in ownership, this background is required by ordinance. The Lakeville Police Department found no reasons for denial of a Liquor License.
