Staff recommends adoption of the following motion: Move to approve the Resolution Adopting
2011 Schedule of Fees.
Approval of the Resolution will result in the approval of the schedule of fees.
The proposed 2011 budget anticipated adjustment of certain utility fees. The proposed changes
are consistent with the discussions conducted at the budget work sessions.

Utility Fee Summary
The utility rate structures and proposed changes in rate structures are discussed in the Executive
Summary (pages 14 - 16) and in the Utility Fund section (pages 208 - 223) of the 2011 proposed
budget and 2012 estimated budget document. The proposed rate structure is as follows:

Utility Fund - Water Operation
The Utility Fund — water operations is delineated on pages 212 - 216 of the 2011 . proposed
budget and 2012 estimated budget document.
Overview:
The Water Operations budget includes several major maintenance projects such as the
rehabilitation of well #15, painting of the Fairfield water tower, and the replacement of a high
performance pump at the Water Treatment Facility for a total cost of $806,200. The 2012
estimated budget includes rehabilitation of wells #9 and #10 and repainting of the Airlake water
tower for a total cost of approximately $882,734. The proposed Utility Fund budget does not
include any new personnel positions.
Construction of the water system infrastructure such as wells, towers and Water Treatment
Facility are financed with water connection charges collected at the time building permits are
issued. The current economic conditions have resulted in a significant decrease in housing
construction and hence reduction in water connection revenue. As such, the water operations
will be required to contribute $1.6 million in the next two years for debt service payments.

Tier I (less than 30 thousand gallons) is primarily water consumption for sustaining life and good
health. Businesses are subject to Tier I and Tier II. Tier III is predominately for irrigation.
Providing safe water to our residents and businesses is considered amongst the highest priorities
of our residents. City staff therefore does not recommend reductions in operations or major
maintenance projects.
The most significant increase is on Tier III for irrigation which is considered discretionary.
Those customers who do not wish to pay for the increased rates have the prerogative to reduce
irrigation consumption to reduce costs. Increasing Tier III is consistent with the City and DNR
objective of promoting water conservation through higher water rates for high consumption.
Utility Fund - Sanitary Sewer Operation
The 2011 proposed Utility Fund - Sanitary Sewer Operation budget is delineated on pages 217 -
220 of the 2011 proposed budget and 2012 estimated budget document.
Overview:
The Metropolitan Council Environmental Services (M.C.E.S.) has increased sanitary sewer rates
3.2% for the coming year. Sanitary sewer rates are proposed to increase accordingly. Major
maintenance projects include infiltration and inflow and mitigation efforts, and lift station
rehabilitation. The lining of the Lake Marion sanitary sewer main is scheduled for 2012 - 2013.
The Sanitary Sewer Operation change in working capital is summarized as follows:

M.C.E.S. has increased its rates as a result of cost of operations and decrease in sewer area
connection (S.A.C.) charge revenues. Subsequent to approval of the preliminary budget on
September 9, M.C.E.S. has provided the sanitary sewer charges for the coming year. The 2011
proposed rate increases for the coming year are as follows:

The proposed sanitary sewer rate increase is important to maintain the fund's financial stability
and provide financing for major maintenance projects.
Utility Fund — Street Light Operation
The 2011 proposed Utility Fund — Street Light Operation budget is delineated on pages 221 - 223
of the 2011 proposed budget and 2012 estimated budget document.
Overview:
Dakota Electric implemented significant rate increases for street lights effective July 1, 2010. In
order to finance electric utility rate increases, staff is recommending increasing its street light
quarterly rates accordingly. The 2011 proposed rate increases are as follows:

Utility accounts not serve by water and sanitary sewer is billed annually. The annual rate
therefore increases from $27.00 to $30.60.
Surface Water Management
The surface water programs will be financed with a $.50 per quarter increase in the surface water
management fee. The proposed 2011 fee is therefore $7.00 per quarter. Utility accounts not
serve by water and sanitary sewer is billed annually. The annual rate therefore increases from
$26.00 to $28.00.
The surface water management fee is appropriated to administration of state and federal
regulations and for projects which affect every major body of water in the City of Lakeville. A
hydrologic modeling project will be undertaken in the coming year to ensure the storm water
systems are properly designed to handle major storms.

C. Manufactured home parks and multiple - family dwellings served by a single meter
shall be charged for the number of units each quarter at the time the meter is
read. The sewer charges for each quarter shall be determined by dividing the
total gallons of water by number of units.

2. Utility accounts not served by water and /or sanitary sewer shall be billed
annually.
A. The residential equivalent utility factor Surface Water Management Utility Fee
shall be $28.00 /dwelling unit per year for those accounts not served by water
and/or sanitary sewer.
3. New subdivisions, as part of development contracts, $28.00 /residential
dwelling unit.
VI. Head of households over 65 years of age or living on social security or
pension income alone:

1. Enrolled on or before December 7, 1998 shall be entitled to a 30% discount
on water and sanitary sewer services to homesteaded residential properties
as described above. Said accounts are also exempt from street light charges
as described above.
2. Enrolled after December 7, 1998 shall be entitled to a 30% discount on water,
sanitary sewer and street light services to homesteaded residential properties
as described above subject to a maximum discount based on ten thousand
gallons of usage.
3. Persons qualifying for the discount must annually certify that they meet the
requirements of this section prior to December 31 of each year in order to
receive the benefits in the following year.
VII. A monthly penalty of 1.5% of the unpaid balance or $1.00, whichever is greater
will be charged on all delinquent accounts that are greater than $10.00. No
penalty will be charged on closed accounts.
VIII. Accounts certified to the County Treasurer /Auditor for collection with the
subsequent year's taxes will be charged a $35.00 service charge plus 18%
interest per year.
