CITY OF LAKEVILLE
DAKOTA COUNTY, MINNESOTA
AN INTERIM ORDINANCE TEMPOP;ARILY
PROHIBITING NEW MOTOR FUEL FACILITIES
THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS:
SECTION 1. The following term when used in this ordinance shall mean:
"Motor Fuel Facilities" means a building or place or portion thereof used
for the retail sale of gasoline or diesel fuel for motor vehicles.
.SECTION 2. Intent. It is the intent of this ordinance to allow the City of
Lakeville time to complete an in-depth study. concerning changes in official controls,
including the City's zoning ordinance, and in the interim to protect the planning process
and the health, safety, and welfare of the citizens of the community.
SECTION. 3. Temporary Prohibition. Pending. the completion of the above
referenced study and adoption of appropriate official controls, new motor fuel facilities
are prohibited and no permit for a new motor fuel facility shall be processed or approved
and no applications for such approval will be accepted.
SECTION 4. Exemption. This ordinance shall not apply to the expansion of
motor fuel facilities. existing on the date of enactment of this ordinance or to locations for
which a conditional use permit has previously been issued allowing such facilities.
SECTION 5. Effective Date. This ordinance shall take effect from and after its
passage and publication and shall remain in effect until. the date of the adoption of the
official controls contemplated hereunder or November 17,' 1997, whichever occurs first.
ADOPTED this 18th day of November, 1996, by the City Council of the City of
Lakeville.
