CITY OF LAKEVILLE
DAKOTA COUNTY, MINNESOTA
AN ORDINANCE AMENDING ORDINANCE NO. 167,
THE CITY'S ZONING ORDINANCE, CONCERNING
WETLANDS AND NIIN1aVIUM BUILDING ELEVATIONS
THE CITY COUNCIL OF THE CITY OF LAKEVII.LE ORDAINS:
SECTION 1. Section 48, including .its subsections, entitled "'W' .Wetland
Systems" of Ordinance No. 167 is repealed.
SECTION 2. Section 9 of Ordinance No. 167 is amended by adding Subsections
9.22 and 9.23 to read:
9.22 High Water Elevation. No structure, except piers, docks, and retaining
walls shall be placed at an elevation such that the lowest floor, including
basement floor, is less than three feet (3') above the highest known water
level, or less than one foot (1') above the 100-year flood level, if
determined, of any adjacent lake, pond, river, watercourse, or wetland. If
sufficient data on known high water levels is not available, the elevation of
the line of permanent aquatic vegetation shall be used as the estimated high
water elevation. When fill is required to meet this elevation, the fill shall
be allowed to stabilize, and construction shall not begin until the property
has been inspected by the Building Inspector.
9.23 Groundwater Elevation. The lowest floor, including basement floor, of
all structures shall be at a level. at least three. feet (3') above the highest
known groundwater table elevation. If requested by the Building Inspector,
the groundwater table elevation shall be determined by a licensed .soils
engineer using soil borings, piezometers, or the observation of mottled
soils.
SECTION 3. Section 47.9(2) of Ordinance No. 167 is deleted.
SECTION 4. This ordinance shall be effective immediately upon its passage and
publication.

BUILDING ELEVATIONS
THE CITY COUNCIL OF THE CITY OF
LAKEVILLE ORDAINS:
