HomeMy WebLinkAbout02-055 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA RESOLUTION Date March 18, 2002 Resolution 02-55 Motion By Mulvihill Seconded By .Bellows RESOLUTION AUTHORIZING ACQUISITION OF PERMANENT AND TEMPORARY EASEMENTS IN CONNECTION WITH CITY PROJECT 01-10 (Ipava Avenue Widening 165th St. West to 176th St. West) WHEREAS, the. City of Lakeville ("City") has .identified the need to undertake a public improvement project ("Project") in order to improve the driving surface of Ipava Avenue; increase. adjacent trail and street lighting;. widen the 175th Street and Ipava Avenue intersection with turn lanes to improve capacity and reduce backups; and improve pedestrian safety by installing a flashing crossing signal at North Park; WHEREAS, in August 2001, the City authorized the preparation of preliminary surveys and conceptual plans for the Project; WHEREAS, the conceptual plans identify easements to be acquired in .connection -with the Project ("Easements") affecting certain properties adjacent to Ipava Avenue identified on Exhibit "A" attached hereto ("Parcels"); and WHEREAS, the City intends to acquire the Easements as needed for the Project. NOW THEREFORE BE IT RESOLVED, by the City Council of the City: 1. The City, through its attorneys in this matter, Rider, Bennett, Egan & Arundel, LLP (with assistance from the City's consulting engineer, Toltz, King, Duvall, Anderson and Associates, Inc.),: are hereby authorized to acquire the Easements through voluntary acquisition or through the commencement of eminent domain proceedings against all parties with interests in the Parcels; 2. The Mayor and City Clerk are hereby authorized to execute all documents necessary to obtain, through. voluntary acquisition, the Easements required for the Project; 15275/000169 815402-1 3. The City, through its attorneys, Rider, Bennett, .Egan & Arundel, LLP, is hereby authorized to invoke the "quick-take" provisions of Minn. Stat. §.117.042; since it may be necessary for the City to acquire the Easements affecting the Parcels on an expedited basis in order to accomplish the construction and completion of the Project work in 2002; and 4. Pursuant to Minn. Stat. § 117.042, the City, through its attorneys, Rider,.Bennett, Egan & Arundel, LLP, is hereby authorized to retain an appraiser to determine the City's .approved appraisal of value for the Easements and to deposit the. approved appraisal value 'into District Court and to obtain an order transferring title. and possession of the. properties involved to the City pursuant to Minn.
