RESOLUTION VACATING A PUBLIC
• PONDING, DRIANGE AND UTILITY EASEMENT
WHEREAS, the Planning Commission has conducted a public hearing, preceded by
two (2) weeks published notice, to consider the following described easement vacation,
and
WHEREAS, the City Council has determined that it is in the public interest to
approve the easement vacation.
NOW, THEREFORE, BE LT RESOLVED by the Lakeville City Council:
1. The following public ponding, drainage and utility easement, recorded as
Document No. 387821, situated in Dakota County,. Minnesota and legally
described as follows is hereby vacated:
(see attached Exhibit A).
2. The City Clerk is directed to file a certified copy of this resolution with the Dakota
County Recorder.
APPROVED AND ADOPTED this 20"' day of August, 2001.

Exhibit A
All that part of the Southwest Quarter of Section 12, Township 114, Range 21, Dakota
County, Minnesota, described as follows:
Commencing at the northeast corner of Lot 2, Block 3, LAKE VILLA GOLF
ESTATES 9 "ADDITION, according to the recorded plat thereof, Dakota County,
Minnesota; thence on an assumed bearing of North 87 degrees 58 minutes 08
seconds West, along the north line of said Lot 2, a distance of 96.44 feet; thence
North 02 degrees 01 minutes 52 seconds East, a distance of 90.00 feet to the
northerly right-of-way line of 179th Street West, as delineated and dedicated in
LAKE VILLA GOLF ESTATES FIRST ADDITION, according to the recorded plat
thereof, said Dakota County and to the point of beginning of the land to be
described; thence North 87 degrees 58 minutes 08 seconds West, along said
northerly right-of-way line, a distance of 152.56 feet; thence northwesterly, a
distance of 89.21 feet, along said northerly right-of-way line and along a tangential
curve, concave to the north, having a central angle of 23 degrees 08 minutes 58
.seconds, and a radius of 220.79 feet; thence North 80 degrees 00 minutes 16
seconds East, not tangent to said curve, a distance of 60.81 feet; thence North 59
degrees 34 minutes 48 seconds East, a distance of 51.35 feet; thence North 88
degrees 55 minutes 15 seconds East, a distance of 89.96 feet; thence South 72
• degrees 51 minutes, 33 seconds East, a distance of 50.62 feet; thence South 01
degrees 14 minutes 21 seconds West, a distance of 49.60 feet to the point of
beginning.

A 20 foot wide easement lying over, .under, and across all that part of the Southwest
Quarter of Section 12, Township 414, Range 21, Dakota County, Minnesota, the center
line of said easement is described as follows:
Commencing at the northeast corner of Lot 2, Block 3, LAKE VILLA GOLF
ESTATES 9 "ADDITION, according to the recorded plat thereof, Dakota County,
Minnesota; thence on an assumed bearing of North 87 degrees 58 minutes 08
seconds West, along the north line of said Lot 2, a distance of 96.44 feet; thence
North 02 degrees 01 minutes 52 seconds East, a distance of 90.00 feet, to the
northerly right-of--way line of 179th Street West, as delineated and dedicated in
LAKE VILLA GOLF ESTATES FIRST ADDITION, according to the recorded plat
thereof, said Dakota County; thence South 87 degrees 58 minutes 08 seconds
East, along said northerly right-of--way line, a distance of 112.44 feet; thence
southeasterly a distance of 270.98 feet, along said northerly right-of--way, a long a
tangential curve, concave to the southwest, having a central angle of 24 degrees 11
minutes 54 seconds, and a radius of 641.62 feet to the point beginning of the line to
• be described; thence North 05 degrees 00 minutes 58 seconds West, a distance ofi
69.76 feet and there terminating. The sidelines of said easement shall be
prolonged or shortened to terminate on said northerly right-of-way line.
