City of Lakeville Resolution Date February 5, 2001 Resolution No. 01-19 Motion By Luick Seconded By Mulvihill Resolution Authorizing Sale of Forfeited Property WHEREAS, the Lakeville Police Department commonly comes into possession of firearms through court order, found property, evidence and/or safekeeping; and, WHEREAS, after the firearms are legally forfeited by judicial procedure or after all reasonable attempts to contact the legal owner of the lost firearms have been exhausted, and time requirements have been met, the firearms become the property of the City of Lakeville; and, WHEREAS, Minnesota Statute 609.5315 directs police agencies to destroy such confiscated firearms or sell them to a Federally Licensed Firearms Dealer; and, WHEREAS, the Lakeville Police Department will destroy all handguns and illegal firearms, but wishes to sell the long guns to such Federally Licensed Firearm Dealers. • NOW, THEREFORE, BE IT RESOLVED, by the City Council of Lakeville, Minnesota that the sale of forfeited and unclaimed property (long guns) as shown on attached Schedule A is authorized to be sold to a Federally Licensed Firearms Dealer on February 6~', 2001.
