HomeMy WebLinkAbout0533 ORDINANCE NO. 533 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 7 OF THE LAKEVILLE CITY CODE CONCERNING. THE USE OF MOTORIZED GOLF CARTS THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: SECTION L Title 7, Chapter 8 of the Lakeville. City Code is amended by adding Section 7-8-5 to read: 7-8-5: MOTORIZED GOLF CARTS. A. Permit. Motorized golf carts may be operated on bike paths, designated streets, and designated bike lanes by permit issued by the Lakeville Police Department subject to the requirements of this section. B. Permits may only be issued to physically disabled persons as defined by' Minn. Stat. § 169.345,. Subd. (2) who have a physician's or chiropractor's statement certifying that the person is a physically disabled person within the meaning of the statute and that the person is able to safely .operate a motorized golfcart on bike paths..Permits shall. be issued for a one year period. A permit may be revoked at .any time if there is evidence that the permittee cannot safety operate the motorized golf cart. The permit may be revoked following a hearing conducted by the Police Chief or his or her designee following written notice to the permittee.. The Police Chiefmay suspend the permit prior to the hearing if public safety would otherwise be endangered. C. .Times of Operation. Motorized golf carts may only be operated on bike paths, designated streets, and bike lanes from sunrise to sunset. They shall not be operated in inclement weather or when visibility is impaired by weather, smoke, or other conditions, or at any time when there is insufficient light to clearly see persons on the bike paths or designated streets at a distance of 500 feet. D. Slow-moving Vehicle Emblem. Motorized golf carts shall display the slow- moving vehicle emblem provided for in Minn. Stat. § 169.522 and an orange or blaze pennant extending at least five (5) feet above the bumper of the golf cart when operated on bike paths and. designated- streets. 16670• r10/10/94 E. Insurance. Every permit holder shall. have in possession at all times while operating a motorized golf cart and shall produce on demand of a police officer proof of insurance as specified in Minn. Stat. § 169.791. F. Crossing Intersecting Streets. The operator, under permit, of a motorized golf cart may cross any street at an intersection. G. Application of Traffic Laws. Every person operating a motorized golf cart under permit on bike paths, designated streets, and bike lanes has all the rights and duties applicable to the driver of any. other vehicle under the provisions of Minn. Stat. Chapter 169, except when .those provisions cannot reasonably be applied to motorized golf carts. H. Non-application. of Certain Laws. The provisions of Minn. Stat. Chapter 171 are not applicable to persons operating motorized. golf carts under permit on bike paths, designated streets, and bike lanes pursuant to this section. Except for the requirements of Minn. Stat. § 169.70, the provisions of Minn. Stat. Chapter 169 relating to equipment on vehicles is not .applicable to motorized golf carts operating under permit. I. Designation of Streets. and Bike Lanes. The permit issued pursuant to this section shall .designate the local streets and bike lanes upon which the motorized golf cart may be operated. SECTION 2. Title 7, Chapter 8 of the Lakeville City Code is amended by amending Section 7-8-3, subparagraphs B and C to read:.. B. Bike Lanes: Except as provided in Section 7-8-5, vehicles are prohibited from using a designated bike lane except in an emergency, when. disabled, or when. necessary to: 1. Make a permissible left, right, or U turn; 2. Pick up or discharge passengers or goods; or 3. Park. C. Bike Paths: Except as provided in Section 7-8-5, all vehicles are prohibited from using a designated bike path. SECTION 3.
