RESOLUTION ORDERING THE 2011 STREET IMPROVEMENT PROJECT AND
AUTHORIZING THE PREPARATION OF PLANS AND SPECIFICATIONS
Proposed Action
Staff recommends adoption of the following motion: Move to approve the attached
Resolution ordering the 2011 street improvement project and authorizing the
preparation of plans and specifications for 2011 street improvement project within
portions of Glenn, Four Star 1 Floyd Bentson, Park Terrace 1st -3rd, South Creek, Gilb
Fitzpatrick, Overland 1 st_2nd Lake Vale 1 -2 Lidco, McNearney and Playfield
Additions. These street improvements constitute City Improvement Project 11 -02.
Overview
At its December 20, 2010 meeting, the Lakeville City Council received a Feasibility
Report for the 2011 street improvement project and set a public hearing for January 18,
2011. Notice of the public hearing was published and forwarded to the affected
property owners. All responses from property owners prior to the Public Hearing have
been logged and are attached.
Prior to the public hearing, City staff along with staff from WSB & Associates will
provide a brief presentation of the project, project costs and assessments.
Following the public hearing and if the City Council elects to proceed with the project,
City staff recommends that the City Council approve the attached resolution ordering
the 2011 street improvement project and authorizing the preparation of plans and
specifications.

RESOLUTION ORDERING THE 2011 STREET IMPROVEMENT PROJECT AND
AUTHORIZING THE PREPARATION OF PLANS AND SPECIFICATIONS
WHEREAS, on December 20, 2010, the City Council fixed a date for public
hearing on the 2011 street improvement project within portions of Glenn, Four Star 1St,
Floyd Bentson, Park Terrace 1 -3 South Creek, Gilb Fitzpatrick, Overland 1St - 2nd,
Lake Vale 1 St -2 "d , Lidco, McNearney and Playfield Additions, City Improvement Project
11 -02; and
WHEREAS, the required ten days published notice of hearing through a weekly
publication was given, and the hearing was held on January 18, 2011, at which time all
persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Lakeville,
Minnesota:
1. The 2011 street improvement project is hereby ordered as identified in the
Feasibility Report for Project 11 -02, dated December 16, 2010.
2. WSB & Associates, Inc. is hereby authorized to prepare plans and
specifications for the making of such improvements.
APPROVED AND ADOPTED this 18 day of January, 2011.

NOTICE OF HEARING ON IMPROVEMENT
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that the City Council of Lakeville will meet at
7:00 p.m. on Tuesday, January 18, 2010, at the City Council Chambers, 20195
Holyoke Avenue, Lakeville, Minnesota, to consider the 2011 street improvement
project within portions of Glenn, Four Star 1 Floyd Bentson, Park Terrace 1
3 South Creek, Gilb Fitzpatrick, Overland, Lake Vale 1 St -2 "d , Lidco, Lakeville
Family Housing, McNearney and Playfield Additions; City Improvement Project
11 -02, pursuant to Minn. Stat. 429.011 to 429.111.
The area proposed to be assessed for the improvements is as follows:
The project will include property in that part of Sections 28 & 29 Township
114 Range 20, lying east of Interstate 35 within the City of Lakeville, Dakota
County, Minnesota, and also being in subdivisions: Glenn, Four Star 1 Floyd
Bentson, Park Terrace 1 -3 South Creek, Gilb Fitzpatrick, Overland, Lake Vale
1st -2nd, Lidco, Lakeville Family Housing, McNearney and Playfield.
The estimated cost of the improvement is $2,820,000. Such persons as
desire to be heard with reference to the proposed improvement will be heard at
this meeting.

Dear Property Owner:
This letter is to inform you that a Public Hearing will be held on Tuesday, January 18, 2011, at
7:00 P.M. in the Lakeville City Hall Council Chambers, 20195 Holyoke Avenue, for City
Improvement Project 11 -02. The proposed roadway improvements will affect your property.
Following public comment, the City Council will consider ordering the improvements.
The estimated cost for the road reconstruction is $2,820,000. Funding for the project will be
60% from the City and 40% from assessments to the benefiting properties. A reasonable estimate
of the cost of the assessment will be available at the hearing. The amount proposed to be
assessed is as follows:
Glenn Addition: $6,655.59 per single family unit
$3,327.80 per townhome unit
All other Neighborhoods:
A Neighborhood Meeting to discuss this project was previously held on October 28, 2010 . at the
Lakeville Senior Center. Please refer to the attached meeting minutes for additional information
on this meeting.

Response
Conversation with Monica Heil at Neighborhood Meeting: Advised maximum
permissible driveway width without a Driveway Permit is 24' and can be expanded up
to 28' with a permit. Advised I would discuss existing conditions and proposed curb cut
with street reconstruct with Staff should the project move forward.

Conversation with Monica Heil: Advised resident the City's assessment policy was to
assess 40% of the project costs to benefiting property owners, and that the
assessments were calculated on a per unit basis, with all single family units within the
project being assessed the same rates. Advised all streets being reconstructed within
a given year are included as a part of the "project area," and that larger projects
typically receive better bid prices than if several smaller projects were bid. Advised
resident there would be a public hearing in January if the project moved forward, and
that she could voice her concerns about the assessment policy at that meeting, or by
filling out a comment card, or writing her Council Members. Also advised that all
comments collected from residents will be presented in the feasibility report that will be
presented to the City Council.
Comment
Concerned about how wide his new driveway curb cut will be. Existing bituminous
driveway is about 24' wide. There is an additional 8' -9' of gravel surface adjacent to
the bituminous driveway in which this resident uses to park his camper. He is
concerned that he will not be able to get his camper in /out of the driveway if the curb
cut is installed between 24-28'.
We need the project!
Concerned about drainage issues adjacent at his property. He is one of the two
residents that has a 15" CMP culvert running along their shared lot lines that drains half
of Hughes Avenue.

replace the culvert entirely himself.
Comment
There are drainage issues at the westerly intersection of 208th Street and Lower 208th
Street. In the winter, this area ices over, and this particular comer is a bus stop for
children. The icing at the intersection is a safety concern for these children waiting for
the bus.
Resident concerned with the number of heavy vehicles using the residential streets in
his neighborhood and the effect these vehicles have on the deterioration of the road.
Resident did not want to give his name or address, but indicated he lived on 208th
Street. The wanted to know the what vehicle weights would be supported with the new
road design and what effects waste haulers are having on these streets. According to
this resident, five different waste haulers service his neighborhood and he is concemed
that he will be paying to reconstruct a road that the waste haulers will destroy again.
Resident missed the Neighborhood Meeting, and requested a summary of what was
discussed. Resident stated that she felt the existing storm sewer facilities adjacent to
her property were sufficient and she did not believe that she should be assessed for
storm sewer improvements that benefitted property owners elsewhere within the
neighborhood. Resident also indicates that there were drainage issues at the
intersection of 208th Street at 208th Street.
Resident called again to re- iterate that she did not believe streets should be "lumped"
together in neighborhoods, and that she should only be assessed for the work done on
her street. Resident wanted to know how she could, "stop this" process if she did not
think the City's assessment policy was fair or if she couldn't afford the assessment

Phone Conversations Continued
Conversation with Assistant City Engineer, Zech Johnson. Zach answered all of Mr.
IEinch's questions and will be sending him a copy of the Notice of Public Hearing.
Conversation with Chris Petree: Mr. Petree answered general questions about the
City's assessment policy, and did indicate that Senior Citizen deferrals are available.
Mr. Petree informed Mr. Kass the City is considering a 20 -year term for the
assessments. Mr. Kass inquired if interest would accrue on the assessment if payment
was deferred, and Mr. Petree responded that it would. Mr. Kass did not want any
additional information on Senior Citizen defers after learning that interest would accrue.
Mr. Petree also gave Mr. Kass a brief history of the City's Pavement Management
Program and how streets throughout the City have been rated. Mr. Petree indicated
that based on the condition of the streets within his neighborhood, it is no longer cost
effective to perform general maintenance. Mr. Petree also discussed the drainage

Conversation with Zach Johnson: As -built records indicate that the westerly 60' of
205th Street (and catch basins at the Holyoke Avenue /205th Street intersection) was
reconstructed as part of the downtown improvements in 1995/1996. Mr. Johnson
indicated that we will have information to share with Mr. Marrinan by the meeting if he
is interested about the extent of the mid- 1990's improvements completed with Holyoke
Avenue along 205th Street.
Conversation with Zech Johnson: The City will mail Mrs. Bouska a copy of the City's
policy on Monday, January 4th.
Conversation with Zech Johnson: 1.) The homeowner can try to reach a separate
agreement with the City's contractor, but replacing her driveway cannot be done as a
part of the City contract. 2.) The City's contractor will be responsible for coordinating
construction with the homeowner 3.) Mailboxes are not scheduled for replacement in
her neighborhood. Mr. Johnson also explained to Ms. Ennenga the general timeline
for the project. WSB will follow up with the homeowner during design regarding curb
replacement so Ms. Ennenga can plan for driveway repairs.
Response
Mr. Einck is in the process of purchasing the home at 8423 208th Street (closing in
January). Mr. Einkc had questions about What is the project? When will the project
be constructed? WII 208th Street be closed during construction? What are the terms
of the proposed assessment? How was the proposed assessment calculated?
Mr. Kass had general questions about the City's assessment policy, and inquired about
Senior Citizen deferrals for the assessments. Mr. Kass did not attend the 10/28/10
Neighborhood Meeting for the project and had questions about the need for the project.
He thinks the streets will be still be "good" for another 8 -10 years without reconstructing
them.
Mr. Mike Marrinan called 12/30/10 requesting information as to the proposed
construction limits. He lives at the northwest comer of Holyoke Avenue and 205"'
Street and was surprised to hear that 205"' Street was part of this proposed project as
his recollection was that it isn't that old. He remembered that Holyoke Avenue was
reconstructed in the mid- 1990's and thought 205"' Street was completed around that
time as well. Mr. Marrinan will be attending the assessment hearing.
Mrs. Bouska called requesting information on the City's policy for Deferments of
Special Assessments for senior citizens.
Ms. Ennenga called with questions about the selected contractor. She explained that
she is in the process of scheduling repairs for her concrete driveway and had the
following questions: 1.) Can the City's contractor reconstruct her driveway 2.) Can the
City's contractor coordinate with her contractor of choice 3.) Will she be getting a new
mailbox and what will it look it
Comment
I think these street improvements are long overdue and very much needed, especially
the additional drainage. In the long run I think this will benefit all. I'm excited for this to
get going.
