RESOLUTION AUTHORIZING ACQUISITION BY CONDEMNATION
OF CERTAIN PROPERTY ADJACENT TO COUNTY ROAD 46
WHEREAS, Dakota County and the City of Lakeville have entered into a cooperative
agreement to acquire right -of -way for the improvement of County Road 46; and
WHEREAS, the acquisition of right -of -way will result in the creation of certain remnant
parcels that will be irregular in form and shape or of inadequate size; and
WHEREAS, acquisition of the remnants is designated as a redevelopment project in the
redevelopment plan for the area.
NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment
Authority in and for the City of Lakeville:
The HRA Attorney is hereby authorized and directed to work in cooperation with the
County Attorney to acquire, by negotiation or by eminent domain proceedings, the
remnants of those parcels located within the City of Lakeville and acquired by the
County for right of way purposes on the County Road 46 Improvement Project identified
as follows:
Right of Way Map No. 145 - Parcels 2A, 2B, 3A, and 3B
Right of Way Map No. 146 - Parcels 1B, 3B, 4B, 8B, 8C, 8E, 8F, 9B, 9D, 10A,
10B, 13, 14B, 15B and 16B
Right of Way Map No. 147 - Parcels 8A and 11A
The HRA Attorney is further directed and authorized to acquire the remnant parcels in
accordance with the "quick take" provisions of Minnesota Statutes § 117.042.
