RESOLUTION PROPOSING TO UNDERTAKE"
REDEVELOPMENT PROJECT NO. 1 AND
AUTHORIZING SUBMITTAL TO THE CITY COUNCIL
FOR ITS APPROVAL A REDEVELOPMENT PLAN
THEREFORE AND A TAX INCREMENT FINANCING
PLAN FOR TAX INCREMENT FINANCING DISTRICT
NO. 1
BE IT RESOLVED by the Housing and Redevelopment
Authority in and for the City of Lakeville, Minnesota, as
follows:
Section 1. Recitals.
1.01. There has been prepared and presented to the
Authority a written redevelopment plan (the Redevelopment Plan)
proposing that a redevelopment project be undertaken by the
Authority within the City, designated as Redevelopment Project
No. 1 (the Project) and a financing plan for the first phase
of the Project, designated as Tax Increment Financing Plan (the
Financing Plan) for Tax Increment Financing District No. 1 (the
District).
1.02. The Project and the District, when established,
will each constitute a "redevelopment project" as defined in
Minnesota Statutes, Section 462.421 Subdivision 13. The District
when established will constitute a "project" and a "Redevelopment
district" which is a type of "tax increment financing district"
within the meaning of Minnesota Statutes, Section 273.73
Subdivision 10 (a) (1) .
1.03. The Authority has investigated the facts and
reviewed the Redevelopment Plan and the Financing Plan and
hereby finds, determines and declares that it is necessary and
in the best interests of the City and its inhabitants for the
Authority to undertake and complete the Project in accordance
with the Redevelopment Plan, and phase one of the Project in
accordance with the Financing Plan.
1.04. The undertaking and completion of the Project
in accordance with the Redevelopment Plan, will result in the
accomplishment of the public purposes and objectives set forth
in Minnesota Statutes, Sections 462.411 through 462.585 and is
necessary to carry out and implement the Project.
1.05. One parcel of land in Phase One of the Project
to be acquired by the Authority is improved with a building.
That parcel is designated as the "City Site" in the Redevelopment
Plan and Tax Increment Financing Plan, and is improved with a
City Hall -Fire Station facility. That facility no longer meets
the needs of the City with respect to adequate fire protection
due to poor location and inadequate design and size and is
therefore found to be detrimental to the safety and health of
the community. Another parcel in Phase One of the Project is
that portion of Hughes Avenue lying between 207th Street South and
208th Street South to be vacated by the City, which is improved
with utilities in need of repair.
1.06. The acquisition of the Project area is necessary
to carry out and implement Phase One of the Redevelopment Plan.
Section 2. Submission to Planning Commission The
Secretary is authorized and directed to submit a certified copy
of this resolution and the Redevelopment Plan to the Planning
Commission of the City and to request the Commission to issue
its written opinion as to whether said redevelopment plan
conforms to the comprehensive plan for the development of the
City, the zoning ordinance, and any other general plan for the
development of the Project area and the surrounding area.
Section 3. Submission to County and School Districts
The Secretary is authorized and directed to submit a certified
copy of this resolution, the Redevelopment Plan and the Financing
Plan to the Dakota County Board of Commissioners and the School
Board of Independent School District No. 194, along with a request
• for their comments on the Redevelopment Plan and Financing Plan
and with notices of public hearings on the Redevelopment Plan and
Financing Plan.
Section 4. Submission to City Council In order for
the Authority to proceed with the Project and to carry out the
Redevleopment Plan and the Financing Plan, it is necessary that
the City approve the Redevelopment Plan and the Financing Plan.
The Secretary, upon receipt of the written opinion of the Plan-
ning Commission, is authorized and directed to submit a certified
copy of this resolution, the Redevelopment Plan, the Financing
Plan and the opinion of the Planning Commission to the City
Council, which is hereby requested to approve the Redevelopment
Plan in accordance with Minnesota Statutes, Section 462.521 and
the Financing Plan in accordance with Minnesota Statutes,
Section 273.74 Subdivision 3.
Adopted in Regular Session of the Housing and
Redevelopment Authority in and for the City of Lakeville,
Minnesota, held this 3rd day of November, 1980.
